24-1458RESOLUTION NO.24-ab� RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, MODIFYING FEES AND CHARGES FOR SERVICES PROVIDED BY THE CITY OF MENIFEE WHEREAS, the City of Menifee provides development related public services of a discretionary nature, as these services can be withheld from customers for non-payment, which are in addition to community supported public services that are paid for by City tax revenues for general social, safety or welfare reasons; and WHEREAS, the State of California Government Code Section 66014 et.al. allows local agencies to charge fees for various activities as long as those fees do not exceed the estimated reasonable cost of providing the services for which the fee is intended; and WHEREAS, the City of Menifee adopted a comprehensive fee schedule update by Resolution 24-1423 on May 15, 2024, and now desires to adjust certain fees and charges based on clarifying non -applicability of an annual Consumer Price Index (CPI) adjustment to federal and/or state set fees, deposit -based fees, and existing surcharges. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Menifee hereby makes the following findings: Section 1. It is hereby found and determined that federal and/or state set fees, deposit - based fees, and existing surcharges set forth and included within Exhibit A attached hereto are not subject to the annual Consumer Price Index (CPI) adjustment; and Section 2. The adoption of this Resolution is exempt from the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), because it approves and sets forth a procedure for determining fees for the purpose of meeting the operating expenses of City departments, as set forth in Public Resources Code Section 21080(b)(8)(A). Section 3.
