1. CALL TO ORDER
Chair LaDue called the meeting to order at 6:00 PM.
2. ROLL CALL

Chair LaDue called on Commissioner Madrid to lead the flag salute.

The agenda was approved unanimously (5-0) with no modifications.

ACTION:
1. Continued item off calendar to bring back to the Planning Commission at a future
date.

9.2 Burger King
Deputy Community Development Director Orlando Hernandez introduced the item and
Assistant Planner Jessica Williams provided the presentation.
Chair LaDue opened the Public Hearing at 6:32PM.
Administrative Assistant Rachel Valencia stated the Public Hearing was legally noticed
and correspondence was received and placed in each of the Planning Commissioner's
folders.
Applicant Gabriela Marks and Burger King Franchisee Jacob Rumble addressed the
Planning Commission and agreed to the conditions of approval with the modifications
included in the memo provided to the Planning Commission right before the meeting.
The Planning Commission discussed in detail the request of the variance and the
findings required for approval.
Chair LaDue closed the Public Hearing at 6:43PM.
ACTION:
1. Determined the Project is exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15303 ("New Construction or Conversion of Small
Structures") and direct staff to file a Notice of Exemption; and
2. Adopted Resolution No. PC24-625 approving Major Plot Plan No. PLN23-0126,
Conditional Use Permit No. PLN23-0127, Variance No. PLN23-0214 and Minor
Exception No. PLN24-0030, located at the northeast corner of McCall Boulevard
and Bradley Road.

Deputy Community Development Director Orlando Hernandez introduced the item and
Senior Planner Russell Brown provided a presentation.
Chair LaDue opened the Public Hearing at 7:10PM. Administrative Assistant Rachel
Valencia stated the Public Hearing was legally noticed and no correspondence was
received.
Applicant Oliver Mujica addressed the Planning Commission and agreed to the
conditions of approval.
Chair LaDue closed the Public Hearing at 7:11 PM.
ACTION:
1. Adopted Resolution No. PC24-626 adopting a Mitigated Negative Declaration
and direct staff to file a Notice of Determination (NOD); and
2. Adopted Resolution No. PC24-627 approving Tentative Parcel Map (TPM) No.
38674 (PLN23- 0025) and Plot Plan (PP) No. PLN23-0026, collecting known as
DEV2023-002 — Di Capri Residential, located on the southwest corner of
Chambers Avenue and Murrieta Road.

9.4 Menifee North Specific Plan Amendment No. 5, Tentative Tract Map No. 38132, and

Deputy Community Development Director Orlando Hernandez introduced the item and
Associate Planner Brandon Cleary provided a presentation.
Chair LaDue opened the Public Hearing at 7:50PM.
Administrative Assistant Rachel Valencia stated the Public Hearing was legally noticed
and correspondence was received and placed in each of the Planning Commissioner's
folders.

Applicant Representative Lance Retuya and Civil Engineer Keith Osbourne addressed
the Planning Commission and agreed to the conditions of approval.
Commissioner Thomas discussed concerns with proposed permitted uses listed in the
specific plan. Concerns include allowing group homes in residential zones and the
legality of removing them as permitted uses.

ACTION:
1. Adopted Resolution No. PC24-628 recommending the City Council adopt
Addendum No. 2 to the certified Final Environmental Impact Report (State
Clearinghouse No. 1989100207) for the Menifee North Specific Plan; and
2. Adopt Resolution No. PC24-629 recommending the City Council approve
Planning Application No. PLN21-0276 Menifee North Specific Plan Amendment
No. 5; and
3. Adopted Resolution No. PC24-630 recommending the City Council approve
Tentative Tract Map No. 38133 (PLN21-0272) generally located at the southeast
corner of Watson Road and Malone Avenue; and
4. Adopted Resolution No. PC24-631 recommending the City Council approve
Tentative Tract Map No. 38132 (PLN21-0274) generally located on the east side
of Palomar Road, approximately 350 feet south of the of the Watson Road and
Palomar Road intersection.
