2023/04/28 Prestige Golf Cars Golf Cart Rental Agreementwww.PrestigeGolfCars.com RentalManager@PrestigeGolfCars.com Murrieta: 26525 Jefferson Avenue, Murrieta CA, 92562 Las Vegas: 2111 S Industrial Road, Las Vegas NV, 89102 TERMS AND CONDITIONS FOR GOLF CART RENTAL (PLEASE READ CAREFULLY BEFORE SIGNING AND RETURNING) In consideration for the rental of the golf cart(s) provided by Prestige Golf Cars, I, _______________________, PRINTED NAME agree to the following conditions. In the event, that I violate any of the following conditions, I agree and understand that further use of the golf cart may be revoked immediately and without notice: 1.I promise to return the golf cart to the location where it was delivered immediately upon completion of the rental period in the same condition as I received the golf cart, normal wear and tear excepted. I will operate the golf cart safely and responsibly, and I will preserve and protect the golf cart from loss or damage to the cart itself, my person or property, and the persons or property of others. I agree and understand failure to comply with the terms of this agreement will result in a forfeiture of my rental fees and deposit. I Acknowledge that I will be charged for all costs of repairs to and/or replacement of the golf cart. I acknowledge that there are risks in driving the golf cart, just as there are risks in driving any vehicle, and that such risks may include loss of personal property and bodily injury. I hereby, individually and on behalf of my guests and passengers, specifically release Prestige Golf Cars, its employees, officers, and agents to the fullest extent allowed by law from all rights, claims, demands and damages of any kind known or unknown, existing or arising in the future resulting from my use of the golf cart, except for claims that arise from the gross negligence or willful misconduct of Prestige or its employees. INITIAL 2.I agree to indemnify and hold harmless Prestige Golf Cars from and against any and all liabilities, claims, demands, losses, costs, expenses, obligations, damages and deficiencies, including reasonable attorneys’ fees (in excess of any insurance available to me) which arise out of, or result from, or are attributable to the use of the golf cart while it is in my possession, including but not limited to the costs of repairs to or Replacement of the golf cart and for the loss, damage and/or injuries to my person or property and for the loss, damage and/or injuries to the persons and property of others. I hereby covenant to reimburse Prestige Golf Cars for any costs incurred by Prestige Golf Cars in defending any claim that arises out of, is Attributable to, or results from the use of the golf cart while the golf cart is in my possession, under my control, or at any time during the rental period, including but not limited to deductibles and any uninsured losses. If any action or proceeding is initiated to enforce this Agreement, I agree to reimburse Prestige Golf Cars for the reasonable attorneys’ fees and costs therein incurred. Prestige shall defend and indemnify Customer, its agents, and employees from and against any and all claims, losses, damages, liability, obligations and expenses (including reasonable attorneys' fees) involving the personal injury, bodily injury (including death), or property damage of any person resulting from the intentional or negligent acts or omissions of Prestige, its employees and agents. I agree to immediately contact Prestige Golf Cars if I have any questions or concerns about operating the golfcart or if my guest(s) or I have caused any damage to the golf cart or to others through the use of the golf cart. I agree to examine and inspect the safety and mechanical condition of the golf cart, and immediatelyreport any concerns or problems, before driving the vehicle. INITIAL 4. I and my guest(s) shall operate the golf cart in accordance with the laws of the State of California, including but not limited to the requirement that persons driving the golf cart must not be under the influence ofalcohol and/or drugs. I further agree that I will be personally responsible for all moving and/or parking violations issued to said cart; while it is in my possession, under my control, or at any time during the rentalperiod. INITIAL 5.I agree that only persons who are 16 years or older and who possess a valid driver’s license, shall drive the golf cart. I further agree to not exceed the maximum number of occupants on the golf cart, includingchildren. INITIAL 6.I agree that the privilege of using the golf cart can be revoked at any time without notice by Prestige Golf Cars in its sole discretion, for any violation of this agreement. I further agree I shall not be entitled any rentalrefund or deposit for such revocation of privilege. INITIAL 7.I understand that if the golf cart should become inoperable through no fault of mine, Prestige Golf Cars will take reasonable steps to have the vehicle repaired. In the event the golf cart cannot be repaired or replaced, arefund will be issued towards the unused rental agreement period. Any cost to repair or replace the vehicle(s) and their accessories as a result of any acts of accident, vandalism, fire or theft will be the responsibility of the Customer, so long as such acts are not committed by Prestige, its employees or agents. Customer is responsible for routine maintenance of the vehicle(s) for the term of this agreement including but not limited to charging of batteries, oil, air pressure, etc.. Recipient will be responsible for maintaining the water level on electric carts. Gas carts are only to be filled with clean fresh unleaded gas. Electric cart charger(s) need to be kept out of the weather and off the beach at all times. It is recommended that the charger be left at the residence while operating cart. Chargers are “automatic” and will shut off when the cart is fully charged. The power cord end requires 110v service only with a recommended 20-amp circuit. It is your responsibility to ensure that receptacles with adequate power are available to charge the cart. Electric Carts may be equipped with a battery light, indicating when the batteries are getting low. When the light comes on the cart will need to be plugged into the charger. It is recommended the Cart is recharged anytime not in use or at a minimum charged every night regardless of the battery condition. This will insure you get the most out of the cart for the duration of your rental. Keep in mind, electric carts cannot and are not designed to run continuously without charging the batteries. Run times do vary and will be shortened if cart is driven on inclines, loose gravel or when carrying more passengers than allowed. Prestige Golf Cars is not responsible for flat tires during rental period. In the event a flat tire does occur you will be charged for the price of the tire, a service call fee (to be determined by location), and an hourly labor fee of $110.00/hr. Prestige Golf Cars is not responsible for dead batteries during rental period. In the event a battery is drained and not able to be charged with a standard charger, you will be charged for the Cart to return to our location to be serviced. If the battery has been drained to the point it cannot be charged you will be responsible for the cost to replace the battery and hourly labor fee of $110.00/hr. Key must be removed from the cart anytime it is left unattended. There will be a $5.00 charge for all unreturned keys. Carts must be returned free of trash and unwanted items. Cart returned with unclaimed items will be charged a $20.00 cleaning fee. Carts must be returned to an area where they are easily accessible to the driver, large venues have designated cart return areas, and the carts must be returned to these areas. Failure to do so will result in an additional $50.00 pickup fee. In the event the golf cart becomes inoperable please leave the cart in the closest safe location, and contact the rental department at 951-434-8482, to avoid this fee. Prestige Golf Cars has the right to terminate any rental agreement and take possession of the cart(s) if the Customer violates the terms and conditions for golf cart rental. The ignition is usually located below and to the right of the steering wheel. Note: You may not hear the golf carts engine come on, most golf carts only make noise when they are driving • Put the golf cart in the forward “F” position to go forward. The reverse “R” position is to go backwards. Note: On most carts, when the cart is in reverse once you accelerate you will hear a beeper if you are driving in reverse. • To stop the golf cart, you will want to gradually press down on the brake until you hear it lock in place. It is CRITICAL that the brake is locked in place otherwise the golf cart will not remain parked. • Do not leave any accessories (lights, strobe light, etc.) on when not in use, and ensure the key is off. This will drain the battery, once batteries reach a critical level, they will not charge with a standard charger. • Never leave keys in an unattended vehicle. This will increase the risk of theft for the vehicle or the key • Please operate these vehicles with caution. • Check tire pressure on a weekly basis and fill if necessary. Electric Only Carts: • Never run the cart when the batteries are low. Once the batteries reach a critical level, they will not charge with a standard charger. • Plug in the vehicle when not in use, to help prevent the batteries from draining. • Check the water level on your batteries at least once a week and refill with distilled water if necessary. • All electric vehicles come with a Tow/Run Switch. If the cart is not accelerating flip up the seat, the tow switch is typically located at the top of the battery compartment. Make sure it is switched to run. If the switch is in the run position, please switch to tow wait 30 seconds, switch back to run (on most carts, you will hear a click.) Gas Only Carts: • Do not tamper with any mechanical component on the golf cart, this can cause injury to you and the vehicle. • Do not drive the vehicle at low speeds for extended periods of time, it will rapidly drain the battery. Gas golf carts run on starter generators and the battery is charged when the cart is run at full speed. If you have to run the cart at slow speeds it will need to be taken to an area where you are able to drive at full speed, in order to charge the battery. • Check fuel levels daily. Gas golf carts take regular unleaded unless specified to take diesel. • Check oil levels daily. • If your gas cart is having trouble accelerating when you first start it, please use the choke typically located on the driver’s side. Prior to rental, all carts are serviced by one of our technicians, who perform routine maintenance and battery discharge tests. This is to ensure you get the most use out of the cart with each charge. In the event a problem does arise we ask that you first check to ensure that all operating instructions are being followed and the charger has sufficient power and is connected properly. If this does not resolve the problem, contact Prestige Golf Cars immediately, at 951-434-8482, and advise of the issues, if after hours please leave a detailed message. In the event we are requested to make a service call and it is determined that the problem is the result of improper operation of the cart or failure to properly connect the charging system there will be a service call fee and, if applicable parts and/or labor fee(s). DO NOT FOR ANY REASON ATTEMPT TO PERFORM MAINTENANCE OR REPAIRS ON CARTS. Customers who attempt to perform maintenance on Carts will be responsible for Cart Inspection Costs at a rate of $110.00/hr. DAMAGES All carts are inspected for damage at the point of delivery and pickup. In the event the cart is damaged during the rental period an estimated repair cost will be charged to your credit card. The Recipient shall defend, indemnify and hold harmless Prestige Golf Cars, as well their agents, employees and affiliates, from and against all losses, damages, liabilities or expenses including, but not limited to, reasonable attorney’s fees and litigation costs which any of them incur arising out of the possession or use of the vehicle(s) by the recipient. A certificate of insurance is a one pager that provides policy details on your liability insurance coverage, verifying that you have the liability insurance. The details it shares include the types and limits of coverage, the issuing insurance company, your policy number, the named insured and the policy’s effective dates. We apologize for any inconvenience, but the COI requirement cannot be waived. COI must show a valid general liability policy of no less than $1 million (suggested). We will also need to have Prestige Golf Cars named as the additionally insured.
