Mr. Brown provided a presentation and reported on the project location; General Plan Land Use and Zoning; project description; site plan; landscape plan; architecture; comment received by the public; environmental review; and staff recommendation. Commissioner Thomas inquired about the perimeter wall height. Chair Diederich opened the public hearing at 6:14 PM. Deputy City Clerk Stephanie Roseen stated the public hearing was legally noticed. Correspondence had been received from the following. Regina and David Wood - concerns regarding noise impacts Mike Luders - support of the project There were no public comments. Applicant, Doug Ely, introduced the owner, Abhishek Singh. Mr. Singh discussed the reasons why he chose Menifee. Mr. Ely commented on the noise concern, operations, and location. The Commissioners inquired about time of outdoor activity and available parking. The applicant stated he agreed to conditions of approval with proposed staff revision. Chair Diederich closed the public hearing at 6:26 PM. Commissioner LaDue spoke in favor of the project as presented. The Commissioners and staff discussed parking, street speed limit, and driveway access. Commissioner Thomas stated he would be in favor of Winterhawk Road marked as school zone. Staff stated they would assess that concern during final engineering. Mr. Singh stated he did not anticipate a need for parents to park across the street to pick up and drop off due to the amount of available parking spots and stated that drop off and pick up is not a set time and not all parents would be arriving at the same time. Commissioner White inquired about the businesses in the area selling alcohol. Chair Diederich opened the public hearing at 6:49 PM. Applicant representative Kassen Klein stated his appreciation of staff and stated he was available for any questions. Commissioner White inquired about the traffic along McCall Boulevard. Ms. Kitzerow provided summary of the required improvements. The Commissioners inquired about a tenant for the proposed restaurant, proposed signage, projected opening and electric car charging spaces. Mr. Klein confirmed he approved proposed conditions of approval. Chair Diederich closed the public hearing at 6:58 PM. Vice Chair Madrid spoke in favor of the project. PROJECT DESCRIPTION Major Master Sign Program No. PLN 19-0035 proposes a Major Master Sign Program for McCall Plaza, which was previously approved by the City of Menifee Planning Commission on October 25, 2017 (under Plot Plan No. 2016-124 and other associated land use entitlements) and included a 12,380 square foot retail plaza which included a convenience store, two (2) fast food restaurants with drive-thru’s, carwash, retail store, 4-pump diesel gasoline canopy, and 8-pump gas station canopy. The McCall Plaza Master Sign Program is a requirement of the original conditions of approval of Plot Plan No. 2016-124. The Master Sign Program lays out the wall sign locations, size limitations, and sign specifications for building and/or business signage in addition to the monument signs. Item Title:9.1 Major Master Sign Program No.PLN 19-0035 for “McCall Plaza” Item Page Number:1 City of Menifee Planning Commission Major Master Sign Program No. PLN 19-0035 for “McCall Plaza” April 28, 2021 Page 2 of 12 4 3 8 LOCATION The Project site is located at the southeast corner of McCall Boulevard and Sherman Road (APNs: 333-060-035 and -036). Location GENERAL PLAN/ZONING The General Plan land use designation of the site is Economic Development Corridor (EDC). The EDC designation allows various commercial uses (retail, office) as well as residential uses. Surrounding General Plan Land Use designations are Economic Development Corridor (EDC) to the north, south and west, and Residential 5.1-8 to the east and southeast. These land uses described above are compatible with the zoning classification of Economic Development Corridor - McCall Boulevard (EDC-MB) which allows retail services to the nearby residential uses. The Master Sign Program is a requirement of the conditions of approval for the approved development. Item Title:9.1 Major Master Sign Program No.PLN 19-0035 for “McCall Plaza” Item Page Number:2 City of Menifee Planning Commission Major Master Sign Program No. PLN 19-0035 for “McCall Plaza” April 28, 2021 Page 3 of 12 4 3 8 General Plan/ Zoning Map DISCUSSION Background: On October 25, 2017, the Planning Commission of the City of Menifee, at an advertised public hearing, considered and approved Plot Plan No. 2016-124, Conditional Use Permit Nos. 2016- 122, 2017-327, 2017-328, and 2017-329, Tentative Parcel Map No. 2016-123 (PM 37130), and Variance No. 2017-324, which were approved for a 12,380 square foot retail plaza (“McCall Plaza”) that included a convenience store, two (2) fast food restaurants with drive-thru’s, carwash, retail store, 4-pump diesel gasoline canopy, and 8-pump gas station canopy. This Project is for the approval of the associated Major Master Sign Program, which was a requirement of the conditions of approval requested by the Planning Commission at the Hearing for the Project entitlement. Typically, a project of this type would require a Minor Sign Program if it were consistent with the City’s code. However, the applicant is requesting the addition of separate LED fuel pricing signs (which prompts the requirement for a Major Master Sign Program), one proposed to be located on McCall Boulevard, and two LED fuel pricing sings on the west elevation of the diesel fuel canopy for the commercial diesel fuel pricing, because the price of commercial diesel fuel cannot be located on the same sign as regular fuel. Additionally, it provides visible fuel price options for prospective customers driving by. The car wash also proposes two (2) (6’x 2’-6”) internally illuminated menu boards for the drive thru carwash. Per Table 9.225-130-1 of the Municipal Code, each drive-thru is allowed one clearance bar and two (2) menu/order boards and are not counted as signs either in terms of number or area. The carwash will also have a 20-foot-tall carwash entrance clearance sign which provides height clearance information for larger vehicles. As a requirement of the Business and Professions Code (BPC), Chapter 14, Petroleum, Article 12 - BPC 13531(a), the diesel fuel pricing must be advertised and clearly displayed as separate pricing from regular Arco diesel fuel since the commercial diesel fuel is a separate entity of the Arco brand and according to the applicant, cannot share pricing signage. Additionally, BPC requires the pricing medium must be clearly visible from the street or highway adjacent to the premises. “The intent is to provide the motorist with the price information prior to entering the station, so that he/she can make a decision to purchase fuel at that price or not. The applicant is making an exception to the development standards for signage, requesting the addition of the LED diesel sign proposed to be located on McCall Boulevard, and the two (2) LED fuel pricing signs on the diesel fuel canopy, which would be additional signage beyond the allowance of the City’s Code. Initially, the applicant requested two (2) of the LED diesel fuel monument signs shown below. One LED diesel fuel monument would be placed on Sherman Road, and the other placed on McCall Boulevard. The Community Development Department worked with the applicant through various iterations of design to reduce the overall square footage of monument signage proposed for the site, which would provide better aesthetics to the site overall and reduce the number of signs that would otherwise be located throughout the property. The current proposal only includes one diesel pricing monument sign along McCall Boulevard. Arco and Diesel Fuel Canopy Signage The canopy Arco sign and Spark logo will be located on the north (street side/front) elevation for the gas canopy. The Arco fuel canopy sign will have 20-inch, internally illuminated channel letters with a 36-inch Spark logo. This section applies to construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on-premise signs. The proposed project is an application for a Major Master Sign Program to add on-premise signs for McCall Plaza, an Arco gas station convenient store, and fast-food establishments previously approved and located at the southeast corner of Sherman Road and McCall Boulevard. Therefore, the project is exempt from CEQA per Section 15311. In addition, the project site is not included on a list of hazardous materials sites compiled pursuant to Government Code Section 65962.5 (California Department of Toxic Substances Control list of various hazardous sites). PLN 19-0035 FOR THE SIGN PROGRAM FOR MCCALL PLAZA LOCATED AT THE SOUTHEAST INTERSECTION OF MCCALL BOULEVARD AND SHERMAN ROAD Whereas, on September 20, 2019, the applicant, McCall Plaza, LP, filed a formal application with the City of Menifee for a Major Master Sign Program for McCall Plaza located at the southeast intersection of McCall Boulevard and Sherman Road (APN 333- 060-035 and -036), within the City of Menifee; and Whereas, on April 28, 2021, the Planning Commission held a public hearing on the Project, considered all public testimony as well as all materials in the staff report and accompanying documents for Major Master Sign Program No. PLN 19-0035, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, notice to property owners within 300 feet of the Project boundaries, and to persons requesting public notice, and on-site posting; and, NOW, THEREFORE, the Planning Commission of the City of Menifee hereby resolves as follows: Section 1: The design, location, and scale of proposed signs for the integrated development are in keeping with the architectural character of the development. The McCall Plaza project (PP2016-124) was approved by the Planning Commission on October 25, 2017, for the establishment of a gas station and convenience store including a 4-pump diesel fuel canopy, 8-pump gasoline canopy, a drive-thru carwash, and a two (2) drive-thru fast-food restaurant. The signage, corner and street view monuments that will be located on Sherman Road and McCall Boulevard, will have a similar architectural design, and similar materials as those used for the building design. Therefore, this master sign program is in keeping with the architectural character of the development. Section 2: The design, location, and scale of proposed signs will not adversely affect the interests of the public or the interests of residents and property owners in the vicinity of the project. The Project site was approved for the establishment of an Arco gas station, convenience store, drive-thru carwash, and two (2) drive-thru fast-food restaurants. The Project is surrounded by vacant land, commercial office, and residential properties. The proposed sign program is compatible with the development of the gas station, convenience store, and drive-thru fast-food restaurants, which are compatible with the surrounding General Plan land use designations and zoning classifications and sign program is an allowed use as part of the development of the Project. The signs will incorporate the same architectural materials of McCall Plaza, which is under construction, and will adhere to the guidelines set in the municipal code and apply to all objectives, policies and requirements of this code and the General Plan. The monument signs and onsite signage will be designed and placed in a manner to not impede traffic or block the view of pedestrian pathways along the perimeter and within the boundaries of the project site. Therefore, approval of the application will not create conditions materially detrimental to the public health, safety, and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. Section 3: The proposed signs are consistent with the purposes of the General Plan or any applicable specific plan or development agreement. The Project site is designated Economic Development Corridor (EDC) per the City of Menifee’s General Plan and Zoning map. The EDC designation is intended for a variety of commercial, entertainment, and office uses. Specifically, the Project site is located within EDC: McCall Boulevard (EDC-MB). The General Plan encourages businesses which provide convenience goods and services that are on arterials adjacent to neighborhoods and communities throughout the city, but not rural residential areas. The Project is for a Major Master Sign Program for the McCall Plaza (previously approved by the Planning Commission on October 25, 2017 under Plot Plan No. 2016-124 and other associated land use entitlements). The Major Master Sign Program is consistent with the EDC-MB land use designation because the proposed gas station, convenience store, drive-thru car wash, and drive-thru fast- food restaurants required signage as part of the conditions of approval for the McCall Plaza (specifically Plot Plan No. 2016-124). Definitions. The words identified in the following list that appear in all capitals in the attached conditions of Major Master Sign Program No. PLN19- 0035 shall be henceforth defined as follows: APPROVED EXHIBIT S = Sign Program for Major Master Sign Program No. PLN 19-0035, dated March 24, 2021 4. Ninety (90) Days. The permittee has ninety (90) days from the date of approval of these conditions to protest, in accordance with the procedures set forth in Government Code Section 66020, the imposition of any and all fees, dedications, reservations and/or other exactions imposed on this project as a result of this approval or conditional approval of this project. 5. City of Menifee. The City of Menifee is a new City, incorporated on October 1, 2008; the City is studying and adopting its own ordinances, regulations, procedures, processing and development impact fee structure. In the future the City of Menifee will identify and put in place various processing fees to cover the reasonable cost of the services provided. The City also will identify and fund mitigation measure under CEQA through development impact fees. Such fees may include but are not limited to processing fees for the costs of providing planning services when development entitlement applications are submitted, which fees are designed to cover the full cost of such services, and development impact fees to mitigate the impact of the development proposed on public improvements. To the extent that Menifee may develop future financing districts to cover the costs of maintenance of improvements constructed by development, Permittee agrees to petition for formation of, annexation to or inclusion in any such financing district and to pay the cost of such formation, annexation or inclusion. Revocation. In the event the use hereby permitted under this permit, a) is found to be in violation of the terms and conditions of this permit, b) is found to have been obtained by fraud or perjured testimony, or c) is found to be detrimental to the public health, safety or general welfare, or is a public nuisance, this permit shall be subject to the revocation procedures. 8. Expiration Date This approval shall be used within three (3) years from the date of approval; otherwise, the Major Master Sign Program shall be null and void. Modifications or Revisions. The permittee shall obtain City approval for any modifications or revisions to the approval of this project. All Design components shall comply with applicable current adopted code provisions of the California Building, California Residential Code, Plumbing and Mechanical Codes; California Electrical Code; California Administrative Code, California Energy Codes, California Green Building Standards, California Title 24 Disabled Access Regulations, and City of Menifee Municipal Code. 14. Comply with Building and Safety Compliance with Department of Building and Safety directives and all required permits shall be obtained prior to establishment or continuation of the use. 15. Comply with Engineering/Public Works Department. Compliance with Engineering/Public Works Department directives and all required permits shall be obtained prior to establishment or continuation of the use. 16. Encroachment Permits. Any subsequent submittals required by these conditions of approval, including but not limited to grading plan, building plan or mitigation monitoring review, shall be reviewed on an hourly basis (research fee), or other such review fee as may be in effect at the time of submittal, as required by Resolution No. 18-741 (Cost of Services Fee Study), or any successor thereto. On January 11, 2017, the City of Menifee Planning Commission approved Plot Plan No. 2016- 252 (PP 2016-252) for the addition of a 5’ x 6’ (30 sq. ft.) monument sign for pricing. The approval also included the approval of an Administrative Relief allowing two (2) freestanding signs to be located at the subject site along the Newport Road frontage and allowed the Arco AM/PM to exceed the maximum number of allowable signs (maximum of four [4] total signs allowed under previous sign code – 9.76) for a service station by allowing a total of six (6) signs. The approval was not used within 2 years of the Planning Commission’s approval and the approvals expired. CONSISTENCY WITH CODE As previously mentioned, the zoning of the property is Specific Plan (Cal Neva Specific Plan No. 208). The Specific Plan refers back to the Scenic Highway Commercial zone (C-P-S). The project is for signage for an existing gas station and convenience store which was approved by the County of Riverside prior to the City’s incorporation. The gas station and convenience store are allowed uses in the C-P-S zone. Onsite advertising is regulated under the City of Menifee Municipal Code Chapters 9.90 (Sign Permit) and 9.220 (Sign Regulations). Pursuant to Chapter 9.220, service stations are allowed one monument sign with a maximum height of 8 feet and a maximum sign area of 36 square feet per street frontage. The proposed monument sign is 8 feet in height and has a total sign area of 30 square feet. Therefore, the design of the monument is consistent with Chapter 9.220. Although the design of the monument sign is consistent with Chapter 9.220, the addition of the monument sign along Newport Road would cause the service station to exceed the allowable number of signs along the Newport Road frontage. Chapter 9.220 allows one (1) monument sign per street frontage; however, the site contains an existing pylon sign along Newport Road that was previously approved by Riverside County. The addition of the proposed monument sign would cause two (2) signs to be located along the Newport Road frontage. As such, the applicant has also filed an Administrative Relief request for the allowance of the additional sign along Newport. Monument signs are typically approved through the Minor Plot Plan process and are approved administratively; however, due to the Administrative Relief request, the proposal is required to go before the Planning Commission. Site Plan The project proposes the addition of a 5’ x 6’ (30 sq. ft.) monument sign to be located in the northwestern portion of the project site as previously mentioned. The new monument sign will be located approximately 196 feet from the existing freestanding pylon sign at the site. The proposal also includes the request for an Administrative Relief that, if approved, will allow two (2) freestanding signs at the site along the Newport Road frontage as shown on the site plan. PLN20-0125 FOR THE NUMBER OF ALLOWABLE SIGNS ON A STREET FRONTAGE AT ARCO AM/PM LOCATED AT 26925 NEWPORT ROAD, (APN: 360-030-001) Whereas, on May 26, 2020, the applicant, Donco & Sons, Inc., on behalf of Yadolla Mahmoodzadeh, filed a formal application with the City of Menifee for the approval of Plot Plan No. PLN20-0135 for new construction of a 5’ x 6’ (30 square foot) internally illuminated monument sign; and, Whereas, on April 28, 2020, the applicant, Donco & Sons, INC, on behalf of Yadolla Mahmoodzadeh, filed a formal application with the City of Menifee for an administrative relief request to increase the number of allowable signs on a street frontage (Newport Road) from a maximum of one (1) to two (2) signs for the subject site; and, Whereas, on April 28, 2021, the Planning Commission of the City of Menifee held a public hearing on the Project, considered all public testimony as well as all materials in the staff report and accompanying documents for Plot Plan No. PLN20-0135 and Administrative Relief No. PLN20-0125, which hearing was publicly noticed by a publication in The Press Enterprise, a newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the Project boundaries, and to persons requesting public notice and on-site posting; and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Menifee makes the following Findings: Section 1:The proposed project is consistent with the adopted General Plan and any applicable specific plan. Consistency with General Plan The project site is designated Specific Plan (Cal Neva Specific Plan No. 208) per the City of Menifee’s General Plan. The Specific Plan designates the property for retail/commercial uses. An existing ARCO AM/PM service station is located at the subject site. The monument sign for the gas station and convenience store is allowed under the general plan land use designation and is consistent with the goals and policies of the general plan, including the following: CD-6: Attractive landscaping, lighting, and signage that conveys a positive image of the community. CD-6.8: Discourage the use of flashing, moving, or audible signs. Section 2:The proposed project meets all applicable standards for development and provisions of this Title 9 - Planning and Zoning. The zoning of the property is Specific Plan (Cal Neva Specific Plan No. 208). The specific plan refers back to the Scenic Highway Commercial zone (C-P-S). The gas station and convenience store are allowed uses in the C-P-S zone. Onsite advertising is regulated under the City of Menifee Municipal Code Chapters 9.90 (Sign Permit) and 9.220 (Sign Regulations). Pursuant to Chapter 9.220, service stations are allowed one monument sign with a maximum height of 8 feet and a maximum sign area of 36 square feet per street frontage. The approved monument sign is 8 feet in height and has a total sign area of 30 square feet. Although the monument sign approved as a part of this project would cause the subject service station to exceed the allowable number of signs along the Newport Road frontage, the Planning Commission may approve an Administrative Relief for the additional sign along Newport Road. Chapter 9.220 requires Administrative Relief approval when any deviation is proposed from the sign code regulations. As required by Chapter 9.220 and the Administrative Relief Findings, the Planning Commission finds that: (1) the proposal preserves the intent of the chapter; (2) the proposed sign will enhance and harmonize with other on- site signs and with the site, building, and/or use being identified by the sign; (3) the proposed sign will not negatively impact the aesthetics of the subject site or the surrounding properties; and (4) given the overall sign size, colors, materials, surface treatment, form, proportion, and scale of the subject monument sign, the sign has been determined to be compatible with the existing project site as well as surrounding project sites. Therefore, the proposed Project is consistent with Title 9. Section 3: Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. The proposed use has been determined to be Categorically Exempt (“Accessory Structures”) under the California Environmental Quality Act (CEQA) and CEQA Guidelines, Section 15311. This section applies to construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on-premise signs. The proposed project is an application for an on- site monument sign and associated Administrative Relief request for Arco AM/PM located at 26925 Newport Road. Therefore, the project is exempt from CEQA per Section 15311. In addition, the project site is not included on a list of hazardous materials sites compiled pursuant to Government Code Section 65962.5 (California Department of Toxic Substances Control list of various hazardous sites). The words identified in the following list that appear in all capitals in the attached conditions of Plot Plan (PP) No. PLN20-0135 and Administrative Relief (AR) No. PLN20-0125 shall be henceforth defined as follows: APPROVED EXHIBIT S = Sign Plan for Plot Plan (PP) No. PLN20-0135 and Administrative Relief (AR) No. PLN20-0125, dated March 23, 2021 4.Ninety (90) Days. The permittee has ninety (90) days from the date of approval of these conditions to protest, in accordance with the procedures set forth in Government Code Section 66020, the imposition of any and all fees, dedications, reservations and/or other exactions imposed on this project as a result of this approval or conditional approval of this project. 5.City of Menifee. The City of Menifee is a new City, incorporated on October 1, 2008; the City is studying and adopting its own ordinances, regulations, procedures, processing and development impact fee structure. In the future, the City of Menifee will identify and put in place various processing fees to cover the reasonable cost of the services provided. The City will also identify and fund mitigation measures under CEQA through development impact fees. Such fees may include, but are not limited to, processing fees for the costs of providing planning services when development entitlement applications are submitted, which fees are designed to cover the full cost of such services, and development impact fees to mitigate the impact of the development proposed on public improvements. To the extent that Menifee may develop future financing districts to cover the costs of maintenance of improvements constructed by development, Permittee agrees to petition for formation of, annexation to, or inclusion in any such financing district and to pay the cost of such formation, annexation, or inclusion. The permittee acknowledges it is on notice of the current development fees and understands that such fees will apply at the levels in effect at the time the fee condition must be met as specified herein. 6.Comply with All Conditions. The applicant/developer shall comply with all terms and conditions of Plot Plan (PP) No. PLN20-0135 and Administrative Relief (AR) No. PLN20-0125. 7.Revocation. In the event the use hereby permitted under this permit is found to: (a) be in violation of the terms and conditions of this permit; (b) have been obtained by fraud or perjured testimony; or (c) be detrimental to the public health, safety, or general welfare or is a public nuisance, this permit shall be subject to the revocation procedures. 8.Expiration Date. This approval shall be used within three (3) years of the approval date; otherwise, it shall become null and void and of no effect whatsoever. By use is meant the beginning of substantial construction contemplated by this approval within a three-(3)-year period which is thereafter diligently pursued to completion or to the actual occupancy of existing buildings or land under the terms of the authorized use. Prior to the expiration of the three-(3)-year period, the permittee may request up to a three-(3)-year extension of time in which to begin substantial construction or use of this permit. The development of the sign shall conform substantially to that shown on Exhibit S, dated March 23, 2021, on file under PLN20-0135 and PLN20- 0125. 12.Sign Category. The development of these premises shall comply with the standards of the Menifee Municipal Code and all other applicable City of Menifee ordinances or guidelines and State and Federal codes. The development of the premises shall conform substantially with that as shown on Exhibit S, unless otherwise amended by these Conditions of Approval. 15.Comply with Building and Safety. Compliance with Department of Building and Safety directives and all required permits shall be obtained prior to establishment or continuation of the use. 16.Compliance with Code. All Design components shall comply with applicable current adopted code provisions of the California Building, California Residential Code, Plumbing and Mechanical Codes; California Electrical Code; California Administrative Code, California Energy Codes, California Green Building Standards, California Title 24 Disabled Access Regulations, and City of Menifee Municipal Code. 17.Comply with Engineering/Public Works Department. Compliance with Engineering/Public Works Department directives and all required permits shall be obtained prior to establishment or continuation of the use. 18.Encroachment Permits. All work done within Riverside County and/or City of Menifee right-of-way shall have been authorized by an encroachment permit. 19.Lighting Hooded and Directed. Any outside lighting shall be hooded and directed so as not to shine directly on adjoining property or public right-of-way. Lighting shall have underground utility service unless the lighting is solar powered. The light from Item Title:9.2 Arco at Newport and Bradley Monument Sign and Administrative Relief PLN20-0135 and PLN20-0125 Item Page Number:19 Page 9 of 13 4 3 1 1 4 an illuminated sign shall not be of an intensity or brightness that will create glare of other negative impacts on residential properties in direct line of sight to the sign. 20.Comply with Menifee Municipal Code Chapter 6.01. All lighting shall comply with any applicable provisions of City of Menifee Municipal Code Chapter 6.01. 21.Required Landscaping. Per Section 9.220.130(C)(2)d of the City’s sign code, landscaping shall be provided at the base of the sign. At a minimum, the landscape area shall be equal to the area of the sign. The approval authority may reduce this ratio during formal project review if found necessary and/or appropriate for the overall design of the proposed project. Landscaping shall be complementary to the landscaping for the overall site, shall be appropriately irrigated and shall include floral arrangements that include drought-tolerant annuals and perennials, which are designed to facilitate maintenance as well as to enhance aesthetic quality. The design of the landscaping shall be such that natural growth will not obscure the sign from the public right-of-way. 22.Viable Landscaping. All plant materials within landscaped areas that will be disturbed due to construction of the proposed monument sign shall be replaced or repaired and maintained in a viable growth condition throughout the life of this permit. To ensure that this occurs, the Community Development Department shall require inspections in accordance with the Landscape/Irrigation Install Inspection Condition of Approval. 23.Maintenance. All signs shall be maintained by the property owner in a condition acceptable to the Community Development Director throughout the life of the permit. Damage to or malfunction of the sign shall be repaired within 48 hours. 24.Expiration Date. This approval shall be used within three (3) years from the date of decision, otherwise it shall become null and void and of no effect whatsoever. By use is meant the beginning of substantial construction contemplated by this approval within the three-year period which is thereafter diligently pursued to completion, or the beginning of substantial utilization contemplated by this approval. Extensions of time may be filed pursuant to Menifee Municipal Code Section 9.30.110C (Permit Extensions). 25.Subsequent Submittals. Any subsequent submittals required by these conditions of approval, including, but not limited to, grading plan, building plan, or mitigation monitoring review shall be reviewed on an hourly basis (research fee), or other such review fee as may be in effect at the time of submittal, as required by Resolution No. 18-741 (Cost of Services Fee Study) or any successor thereto. Each submittal shall be accompanied with a letter clearly indicating which condition or conditions the submittal is intended to comply with. Prior to Building Permit Issuance 26.Landscape and Irrigation Plans. The permittee shall submit Final Landscaping and Irrigation Plans to the Community Development Department for review and approval prior to installation. Said plan shall be submitted to the Division in the form of a plot plan application pursuant to Menifee Municipal Code along with the current fee. The location, number, genus, species, and container size of plants shall be shown. Emphasis shall be placed on using plant species that are drought tolerant and which have low water usage. Landscaping and Irrigation Plot Plans shall be prepared consistent with Menifee Municipal Code (as adopted and any amendments thereto), the Riverside County Guide to California Landscaping and Eastern Municipal Water District requirements. Landscaping plans for areas that are totally within the road right-of-way shall be submitted to the Engineering Department only. Slope Landscaping plans for slopes exceeding 3 feet in height shall be submitted to the Engineering Department. The irrigation plan shall be in compliance with Menifee Municipal Code Chapter 15.04, and include a rain shut-off device which is capable of shutting down the entire system. In addition, the plan will incorporate the use of in-line check valves, or sprinkler heads containing check valves to prohibit low head drainage. Director Authority to Defer. The Community Development Director shall have the authority to defer the requirement that the landscape and irrigation plans be approved prior to building permit issuance. Any deferral of the approval of the plans will be based on the status of the plans and severity of outstanding corrections. However, the requirement to submit plan prior to building permit issuance shall not be deferred. 27.Landscape Inspections. Prior to issuance of building permits, the permit holder shall open a Landscape Deposit Based Fee case and deposit the prevailing deposit amount to cover the pre installation, installation, and Six Month and One Year Landscape Inspections. The total cost for hours spent for pre installation, installation, and Six Month and One Year Landscape Inspections is estimated to be $2,500. 28.Submit Building Plans. Prior to the issuance of a building permit, the permittee shall submit building plans with the City of Menifee Building and Safety Department for building permits. The building plans shall be in substantial conformance with APPROVED EXHIBIT S. Building and Safety will require the following items: i. Plans shall be designed to the provisions of the 2019 edition (or current) of the California Building, Mechanical, Electrical and Plumbing, Energy and Green Codes. ii. Electronic set of drawings shall be submitted along with structural calculations and Title 24 Energy documentation. iii. All exterior lighting shall comply with Ordinance 2009-24, “Dark Sky Ordinance.” iv. All exterior lighting shall fall within current commercial standards. v. Separate plan submittal will be required by Riverside County Fire along with a formal transmittal issued by Building and Safety. Prior to issuance of Building Permits, the Property Owner and its successors shall enter into an agreement with the City of Menifee (through coordination with the City’s Public Works / Engineering Department) regarding the relocation of the 5’ x 6’ monument sign and the existing 20-foot pole sign. The agreement shall make the Property Owner or its successor responsible for the removal or relocation of either of these signs to a portion of the Property that falls outside of the Ultimate Right-of-Way (in accordance with Menifee Municipal Code Section 9.76) at Owner’s or Owner’s successor’s own cost and expense upon any future development of the Property or upon improvement of Newport Road along the project frontage by Owner or Owner’s successor. 30.Elevations. Elevations of the signs, including the monument sign, submitted for Building Permit plan check approval shall be in substantial conformance with the elevations shown on APPROVED EXHIBIT S. The color of the cap and the shroud on the monument sign will be Dunn-Edwards DE6224 (Treasure Chest). 31.Fees. Prior to issuance of Building Permits, the Community Development Department shall determine if the deposit-based fees for project are in a negative balance. If so, any outstanding fees shall be paid by the applicant/developer. Prior to Issuance of Final 32.Final Planning Inspection. The applicant shall obtain final occupancy sign-off from the Planning Division for each Building Permit issued by scheduling a final Planning inspection prior to the final sign-off from the Building Department. Planning staff shall verify that all pertinent Conditions of Approval have been met, including compliance with the approved elevations. The applicant shall have all required architectural details and sign lighting installed and in good condition. 33.Non-Permitted Signs Removed. Prior to issuance of final occupancy or final sign-off on the monument sign, the applicant shall remove all unpermitted signage, including the illuminated cabinet wall signs on the north elevation and on the east elevation of the building. All temporary signage shall be removed or the applicant shall obtain permits for the temporary signage, if allowed. 34.Landscape/Irrigation Install Inspection. The permittee landscape architect responsible for preparing the Landscaping and Irrigation Plans shall arrange for a Pre-Landscape installation inspection and a Landscape Completion Installation Inspection with the Community Development Department. The pre-landscape inspection shall be arranged at least fifteen (15) working days prior to installation of landscaping. The landscape completion inspection shall be arranged at least fifteen (15) working days prior to final inspection of the structure or issuance of occupancy permit, whichever occurs first. A One Year Post-Establishment Inspection will also be required. The Community Development Department will require a deposit in order to conduct the landscape inspections. 35.Landscape Installation. All required landscape planting and irrigation, including, but not limited to, onsite, shall have been installed in accordance with approved Landscaping, Irrigation, and Shading Plans, Menifee Municipal Code Chapters 15.04 (Landscape Water Use Efficiency Requirements) and 9.195 (Landscaping Standards) (as adopted and any amendments thereto), Eastern Municipal Water Item Title:9.2 Arco at Newport and Bradley Monument Sign and Administrative Relief PLN20-0135 and PLN20-0125 Item Page Number:22 Page 12 of 13 4 3 1 1 4 District requirements and the Riverside County Guide to California Landscaping. All landscape and irrigation components shall be in a condition acceptable to the Community Development Department. The plants shall be healthy and free of weeds, disease or pests. The irrigation system shall be properly constructed and determined to be in good working order. 36.Final Landscape Approval. The final landscape approval following installation shall be subject to the review and approval of the City’s Landscape Architectural Consultant and the Community Development Director. The Community Development Director may require additional trees, shrubs, and/or groundcover as necessary, if site inspections reveal landscape deficiencies that were not apparent during the plan review process. 37.Fees.
