A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE,
CALIFORNIA ADOPTING AN ADDENDUM TO THE PREVIOUSLY ADOPTED
MTTTGATED NEGATTVE DEGLARATTON FOR "CHtCK-FtL.A" (MAJOR
MODtF|CAT|ON NO. PLN2l-0393)
WHEREAS, on September 27,2017, the City of Menifee Planning Commission adopted
Resolution No. 17-349 adopting a Mitigated Negative Declaration for Plot Plan No. 201 7-021 (herein
referred to as the "2017 |S/MND), Conditional Use Permit No.2017-277 and Administrative Relief
No. 2017-276, which analyzed the environmental impacts for a 29,536 square foot grocery store,
17,000 square foot health club, and 8,700 square foot restaurant and determined the prolect's
environmental impacts to be less than significant with mitigation incorporation; and
WHEREAS, on December 7,2021, the applicant, Chick-fi|-A, filed a formal application with
the City of Menifee for the approval of Major Modification No. PLN21-0393 for a revision to approved
Plot Plan No.2017-021 to replace the approved 8,700 square foot restaurant with a 4,929 square
foot quick service restaurant, remove the approved 17,000 square foot health club and replace with
parking, and revise on-site circulation ("Project"); and
WHEREAS, the City is the Lead Agency under the California Environmental Quality Act,
Public Resources Code Section 21000 et seq. ("CEQA"); and
Sect ion 1.
WHEREAS, the approval of Major Modification No. PLN2'l-0393 constitutes a discretionaryapproval, which is part of a "project" as that term is defined in CEQA Guidelines Section 15378and which itself requires review under CEeA; and
WHEREAS, in connection with the proposed project, an addendum to the 2017 ls/MND isqrgposed, a copy of which is on file in the Community tievelopment Department and attached asExhibit A, has been prepared pursuant to the provisions oi Section 15i64 of the CEeA Guidelinesin order to determine whether any significant environmental impacts wnicn were not-iointified in the2017 ls/MND would result from-thJ proposed iroJeci oi*nether previousty identified significantimpacts would be substantiary more severe in connlction witn tne pioposeJ6r.;*t;;;
WHEREAS, the pranning commission conducted a dury noticed pubric hearing onseptember 14,2022' where the public was arloweo io comment on the proposed project includingthe Addendum to the 2017 lS/MNiD; and
wHEREAS, the Planning. commission has carefully considered all comments received fromthe public as well as the informaiion provided uy tne Ciiyt'staff regarding environmental review.
NOW, THEREFORE, the pranning commission of the city of Menifee hereby makesthe following findings as estabtished Oy CEe*

(a) There have not been any substantial changes in the "Project" that require major revisions of
the 2017 IS/MND due to the involvement of new signiflcant environmental effects or a substantial
increase in the severity of previously identified significant effects; and
(b) There have not been any substantial changes with respect to the circumstances under which
the proposed Project is undertaken that require major revisions of the 2017 IS/MND due to the
involvement of new significant environmental effects or a substantial increase in the severity of
previously identified significant effects; and
(c) There is no new information of substantial importance that was not known and could not
have been known with the exercise of reasonable diligence at the time the 2017 IS/MND was
adopted, that shows any of the following:
i. the proposed Project will have one or more significant effects not discussed in the 2017
IS/MND;
ii. significant effects previously examined will be substantially more severe than shown in the
2O17IS/MND;
iii. mitigation measures or alternatives previously found not to be feasible would, in fact, be
feasible and would substantially reduce one or more significant effects of the proposed
Project, but the Project proponent declines to adopt the mitigation measures or
alternatives;or
iv. mitigation measures or alternatives which are considerably different from those analyzed
in the 2017 IS/MND would substantially reduce one or more significant effects on the
environment, but the Project proponent declines to adopt the mitigation measures or
alternatives.
Section 3. ln connection with the proposed Project and this Planning Commission's review of the
addendum to the 2017 lS/MND, the Planning Commission had independently reviewed the
addendum to the 2017 lS/MND and had exercised its independent judgment in making the findings
and determinations set forth herein.
Section 4. Pursuant to the above findings, the Planning Commission determined that the 2017
IS/MND, together with the addendum, satisfy all the requirements of CEQA and are adequate to
serve as the required environmental documentation for the proposed Project and, therefore, hereby
adopts the Addendum to the 2017 IS/MND for the proposed Pro.lect.
