WHEREAS, on July 8, 2021, lhe applicant, Albert Womble, filed a formal
application with the City of Menifee for the approval of Tract Map No. (38219) PLN 21-
0238 for the subdivision of two (2) parcels for condominium purposes totaling 14.22
gross acres and the approval of Plot Plan No. PLN 21-0239 for development of a 198-
unit residential prqect consisting of detached townhomes and one (1) 2,800 square foot
recreation building located west of Bradley Road in between Potomac Drive and Lazy
Creek Road proposed under Plot Plan No. PLN21-0239.
WHEREAS, the thirty-(30)-day public review period for the lS/MND occurred
between May 9,2022 to June 8, 2022. The public review period was publicly noticed by
a publication in a newspaper of general circulation, notice to owners within 300 feet of
the Project site boundaries, and notice to related agencies and government agencies.
The proiect was also required to be transmitted to the State Clearinghouse for review by
State agencies.
WHEREAS, three (3) comment letters on the IS/MND were received during the
public review period from the following interested parties: (1) Santa Ana Regional Water
Control Board; (2) Mrs. Tomasek; and (3) Mrs. Powers.
WHEREAS, on June 22,2022, the Planning Commission held a duly noticed
public hearing on the proiect, considered all public testimony as well as all materials tn
the staff report and accompanying documents, which hearing was publicly noticed by a
publication in the newspaper of general circulation, an agenda posting, onsite sign
postings, and notice to property owners and occupants within 300 feet of the project
boundaries, and to persons requesting public notice; and
WHEREAS, the City has complied with CEQA and the IS/MND is an accurate
and objective statement that fully complies with CEQA, the CEQA Guidelines and
represents the independent judgment of the City; and
WHEREAS, no evidence of new significant impacts or increased severity of
environmental impacts, as defined by CEQA Guidelines Section 15088.5, have been
received by the City after circulation of the draft IS/MND which would require re-
circulation.

WHEREAS, pursuant to the requirements of the California Environmental
Ouality Act (CEOA), an lnitial Study ("1S") and Mitigated Negative Declaration ("MND")
have been prepared to analyze and mitigate the project's potentially significant
environmental impacts.
NOW, THEREFORE, the Planning Commission of the City of Menifee makes the
following findings as established by the CEQA:

as Exhibit "l" and incorporated herein by reference, will assure compliance
with the mitigation measures during project implementation.
The Planning Commission finds that the adoption of the IS/MND reflects the
Planning Commission's independent judgment and analysis.
The Planning Commission adopts an lS/MND for the project including but
not limited to the Mitigation and Monitoring Plan as attached to the lS/[/ND.

The program has been prepared in compliance with State law and the Mitigated Negative Declaration
(MND) prepared for the project by the City of Menifee (City).
The California Environmental Quality Act (CEQAI requires adoption of a reporting or monitoring
program for those measures placed on a project to mitigate or avoid significant effects on the
environment (Public Resource Code Section 21081.5). The law states the reporting or monitoring
program shall be designed to ensure compliance during project implementation.
The monitoring program contains the following elements:
1) The mitigation measures are recorded with the action and procedure necessary to ensure
compliance. ln some instances, one action may be used to verify implementation of several
mitigation measures.
2) A procedure for compliance and verification has been outlined for each action necessary. This
procedure designates who will take action, what action will be taken and when, and to whom and
when compliance will be reported.
3) The program has been designed to be flexible. As monitoring progresses, changes to compliance
procedures may be necessary based upon recommendations by those responsible for the
program. As changes are made, new monitoring compliance procedures and records will be
developed and incorporated into the program.
This Mitigation Monitoring and Reporting Program includes mitigation identified in the MND.
STANDARD CONDITIONS
Standard Conditions are presented in instances where the proposed Project would not create a
significant impact but would be required to adhere to regulatory requirements in order to ensure
impacts do not become significant. Standard Conditions outline compliance with various federal,
State, and/or local acts, laws, rules, regulations, municipalcodes, policies, etc.

As the Lead Agency, the City is responsible for ensuring full compliance with the mitigation measures
adopted for the proposed Project. The City will monitor and report on all mitigation activities.
Mitigation measures will be implemented at different stages of development throughout the Project
site. ln this regard, the responsibilities for implementation have been assigned to the Applicant,
Contractor, or a combination thereof. lf, during the course of Project implementation, any of the
mitigation measures identified herein cannot be successfully implemented, the City shall be
immediately informed, and the City will then inform any affected responsible agencies. The City, in
coniunction with any affected responsible agencies, will then determine if modification to the Project
is required and/or whether alternative mitigation is appropriate.

Phase lll and lv. Prior to final inspection, the developer/
permit holder shall prompt the Project Archaeologist to
submit two copies of the Phase lll Data Recovery report
(if required for the Project) and the Phase lV Cultural
Resources Monitoring Report that complies with the
Community Development Department's requirements
for such reports- The Phase lV report shall include
evidence o, the required cultural/historical sensitivity
traininS for the construction staff held during the pre-
grade meeting. The Community Development
Department shall review the reports to determine
adequate mitigation compliance. Provided the reports
are adequate, the Community Development Department
shall clear this condition. Once the repon(5) are
determined to be adequate, two copies shall be
submitted to the Eastern lnformation Center (ElC) at the
