2020-12-02 City Council Item No. 11.1 Hidden Hills Development Agreement Amendment Presentation Regular MEETING - Additional Meeting MaterialsHidden Hills Development Agreement Amendment Background •Hidden Hills TR 30142 (Peppertree & Cypress) approved by Riverside County on June 8, 2004 •511 single-family residential lots and 5.3 acre park •3 detention basins, 11 acres open space, 3.3 acre hillside area •1st Extension of Time approved by the County in 2007 •2nd Extension of Time approved by the City in 2009 •Construction began in 2009 •City approved a Development Agreement in 2010 for 10 year term to facilitate: •Development of Housing units •Construction of Parks/Trails Amenities –11 acres of public trails/paseos •Infrastructure –regional storm drain, parkway along north side of Garbani, full width improvements on Evans Road (Craig to Garbani) •Home Construction Original Development Agreement CONTENT OF 2010 DEVELOPMENT AGREEMENT 1.Civic Site conveyance -KB conveyed 20.18 acres of land at Evans and Craig Road to the City 2.DIF Reduction/Freeze -reduction equal to an 80%reduction in the original Development Impact Fees (compared to the 65%discount being offered to others as part of the city’s stimulus plan). 3.Model Homes Construction -allowed KB homes to pull building permits for up to six (6)model homes while the development agreement is being adopted. 4.Land Use/Zoning Vested -The City cannot change the general plan or zoning during the term of the development agreement. Original Development Agreement •Phase 1 constructed 2011 –2013 •Phases 2 + 3 resumed in 2015 •Construction began again in 2017 •Approximately 147 building permits remain to be issued Background •Extend the expiration date from March 2, 2020 through March 2, 2025 (additional 5 years) •Extend the allowable Development Impact Fees (DIF) Reduction for the term of the DA Amendment based on new City DIF: •80% DIF reduction on all lots from March 2, 2020 through March 1, 2022 •50% DIF reduction on all lots from March 2, 2022 through March 1, 2025 DA Amendment Provisions •Previous County DIF w/80% reduction: $795/unit •City DIF w/80% reduction: $1,975/unit (March 2, 2020 through March 1, 2022) •City DIF w/50% reduction: $4,937 (March 2, 2022 through March 2, 2025) •City DIF without DA reductions: $9,874/unit DA Amendment Provisions •On March 26, 2020, the proposed amendment was presented to the City Council Finance Subcommittee and received unanimous support. •On September 23, 2020, the Planning Commission recommended adoption of an Ordinance approving Development Agreement Amendment No. PLN20-0075 to the City Council by a unanimous vote (5:0) Previous Review •Conduct a Public Hearing. •Introduce first reading of an Ordinance approving Development Agreement Amendment No. PLN20- 0075.
