2021-04-07 City Council Item No. 11.1 Multiple Species Habitat Conservation Plan & Local Development Mitigation Fee Update Presentation Regular MEETING - Additional Meeting MaterialsMultiple Species Habitat Conservation Plan & Local Development Mitigation Fee Update Background •Menifee is a member agency of the Western Riverside Regional Conservation Authority (RCA) with 18 other cities •RCA acquires, administers, operates and maintains land and facilities to establish reserves for the conservation and protection of species covered by the Western Riverside Multiple Species Habitat Conservation Plan (MSHCP) MSHCP Member Agencies •500,000 acres of permanent conservation •Protection of 146 species •Developed in response to the need for future growth opportunities •Addresses State and Federal Endangered Species Acts •Streamlines environmental permitting processes •Without MSHCP, each project would need to conduct individual assessments and mitigations (less efficient, more costly) MSHCP Overview •Menifee receives local Measure A sales tax funds annually as a condition of the City’s participation in the MSHCP •$1.88 million received in FY 19/20 •For local streets, roads and other transportation projects MSHCP & MEASURE A •Nexus Study in 2003 established the Local Development Mitigation Fee (LDMF) •Acquisition of land to meet the target conservation acreage •25-year plan of land acquisition •Adopted by each MSHCP agency member LDMF Establishment •RCA prepared a new Nexus Study in 2020 •Needed to ensure adequate funding was available to complete reserve land acquisition •Extended the land acquisition by 15 years 2020 Nexus Study •On December 7, 2020 the RCA Board of Directors adopted the 2020 Nexus Study and MSHCP Mitigation Fee Implementation Manual •A phased fee schedule was also adopted: •50% fee increase on July 1, 2021 •100% fee increase on January 1, 2022 •All member agencies are required to adopt the Nexus Study no later than May for July 1st implementation 2020 Nexus Study CATEGORY CURRENT JULY 1, 2021 – DEC 31, 2021 JAN 1, 2022 – JUNE 30, 2022 Residential, density less than 8.0 dwelling units per acre (fee per dwelling unit) $2,234 $2,935 $3,635 Residential, density between 8.0 and 14.0 dwelling units per acre (fee per dwelling unit) $1,430 $1,473 $1,515 Residential, density greater than 14.0 dwelling units per acre (fee per dwelling unit) $1,161 $670 $670 Commercial (fee per acre)$7,606 $11,982 $16,358 Industrial (fee per acre)$7,606 $11,982 $16,358 Phased Fee Schedule •Fees can be prepaid under the current LDMF prior to July 1, 2021 if: •A project has an approved Planning Application AND •Plans have been submitted for Building plan review and the Building Permit fees have been paid •May also be applied to Grading Permit plan review/ Grading Permit fees Prepayment Option •Conduct a Public Hearing •Approve and adopt City of Menifee Ordinance for the Western Riverside MSHCP and Repeal Riverside County Ordinance No. 810.2 •Adopt a Resolution of the City of Menifee to establish the Western Riverside County MSHCP LDMF applicable to all developments in the Plan Area Recommended Action Questions? •City of Moreno Valley, San Jacinto –Adopted •City of Wildomar, Calimesa, Beaumont, Norco –1st reading occurred, pending 2nd reading •City of Riverside –1st reading on April 13th •All other cities –pending 1st reading Member Agency Adoption Status NO EXTENSION 5-YR EXTENSION 10-YR EXTENSION 15-YR EXTENSION $45,041 $28,625 $20,868 $16,358 Mitigation Fee per Acre
