AGREEMENT BETWEEN SEARLE CREATIVE GROUP LLC
AND THE CITY OF MENIFEE FOR MENIFEE POLICE DEPARTMENT: PROFESSIONAL
SERVICES FOR BRANDING/MARKETING CAMPAIGN FOR DEPARTMENT & PERSONNEL
RECRUITMENT
This is Amendment No. 1 to that certain AGREEMENT for Professional Services
Agreement ("Agreement") made on June 1, 2019 by and between the City of Menifee ("City") and
SEARLE CREATIVE GROUP LLC ("Consultant") for MENIFEE POLICE DEPARTMENT:
PROFESSIONAL SERVICES FOR BRANDING/MARKETING CAMPAIGN FOR DEPARTMENT
& PERSONNEL RECRUITMENT which Amendment is made and entered into on
August 14 , 2020 to increase compensation amount as indicated below:
1. Section 2, "Compensation" is amended to read as follows, increasing the contract amount
by: $15,700.00 (FIFTEEN THOUSAND SEVEN HUNDRED DOLLARS AND ZERO
CENTS)
Section 2. City hereby agrees to pay Consultant a sum not to exceed $101,675.00
(ONE HUNDRED ONE THOUSAND SIX HUNDRED SEVENTY FIVE DOLLARS AND ZERO
CENTS) notwithstanding any contrary indications that may be contained in Consultant's
proposal, for services to be performed and reimbursable costs incurred under this Agreement.
In the event of a conflict between this Agreement and Exhibit A, regarding the amount of
compensation, this Agreement shall prevail. City shall pay Consultant for services rendered
pursuant to this Agreement at the time and in the manner set forth herein. The payments
specified below shall be the only payments from City to Consultant for services rendered
pursuant to this Agreement. Consultant shall submit all invoices to City in the manner
specified herein. Except as specifically authorized in advance by City, Consultant shall not
bill City for duplicate services performed by more than one person.
2. All other terms and conditions of the Agreement remain in full force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE
DIRECTING AND AUTHORIZING FORMATION OF A MUNICIPAL POLICE
DEPARTMENT FOR THE CITY OF MENIFEE, AND DIRECTING THE CITY
MANAGER TO IMMEDIATELY IMPLEMENT THAT DIRECTION, INCLUDING
THE RECRUITMENT OF A POLICE CHIEF, THE IDENTIFICATION AND
SECURING OF BUILDING SPACE FOR THE MENIFEE PD, THE ACQUISITION
OF NECESSARYEQUIPMENT FOR THE MENIFEE PD, THE ESTABLISHMENT
OF OTHER CONTRACTS NECESSARY TO PROVIDE RESOURCES FOR THE
PROTECTION OF PUBLIC SAFETY IN THE CITY OF MENIFEE, THE
IDENTIFICATION AND ESTABLISHMENT OF RISK MANAGEMENT
RELATIONSHIPS TO GUARD AGAINST ADDITIONAL LIABILITIES
ASSOCIATED WITH THE OPERATION OF THE MENIFEE PD, THE
FORMATION OF PERSONNEL RULES AND REGULATIONS FOR THE
ENGAGEMENT OF SWORN AND UNSWORN PUBLIC SAFETY STAFF OF THE
MENIFEE PD, AND THE DELIVERY AT THE APPROPRIATE TIME OF A
NOTICE OF TERMINATION OF THE CITY'S CURRENT AGREEMENT WITH
THE COUNTY OF RIVERSIDE FOR THE PROVISION OF LAW ENFORCEMENT
SERVICES
WHEREAS, the City has contracted with the County of Riverside for law enforcement
services since its incorporation in October 2008; and
WHEREAS, the City's current law enforcement services contract with the County of
Riverside was entered into on July 1, 2017, and is set to expire on June 30, 2022; however, the
agreement provides that the City may terminate the agreement upon notice in writing of not less
than twelve (12) months; and
WHEREAS, the City has been very pleased with the quality of police services received,
but has become increasingly concerned over the costs of these services charged under the
contract; and
WHEREAS, the law enforcement patrol cost per hour in fiscal year 2013-14 was $139.29,
while law enforcement patrol costs in the current fiscal year are budgeted at $192.23 per hour,
and such costs are forecasted at $209.53 per hour during the next fiscal year; and
WHEREAS, overall law enforcement costs to the City in fiscal year 2013-14 were
$9,668,131, while law enforcement costs for the current fiscal year are budgeted at $17,135,207,
and such costs are forecasted at $19,186,508 during the next fiscal year; and
WHEREAS, law enforcement costs are forecasted to increase at a rate of six and one
half percent (6.5%) per year, plus an additional two and one half percent per year (2.5%) over
the next three years; and

WHEREAS, to address increasing law enforcement costs, and to remedy the systemic
inability of the City to control those costs through its existing contract with the County of
Riverside, since early 2017 the City has been examining alternative service delivery models for
police services; and
WHEREAS, in its examination of alternative service delivery models the City also sought
to improve response times, especially for priority three and four calls for service; increase patrol
presence in Menifee; and improve local control over the provision of police services; and
WHEREAS, over the past year the City has conducted discussions during regular City
Council meetings, during a Strategic Visioning workshop, during its budget workshop, and most
recently during a City Council special meeting/workshop, all of which were designed to solicit
public input and allow for open and transparent consideration of the City's options; and
WHEREAS, the City engaged the services of an outside consultant to conduct research
and prepare a feasibility study ("Feasibility Study"), and during that process the consultant
solicited data, input, and advice from (i) Riverside County Sheriffs Department management,
(ii) current and retired police chiefs, (iii) police personnel of all levels, (iv) city managers in cities
that currently have municipal police departments, and (iv) administrative and finance staff from
the City of Menifee; and
WHEREAS, the goal of the Feasibility Study was to determine whether the City can
provide equal or improved police services at a lower cost than under the law enforcement
services contract it currently holds with the County of Riverside; the City fundamentally sought
to determine whether it could provide critical public safety services in a more financially prudent
manner; and
WHEREAS, the Feasibility Study, coupled with in-depth analysis by City staff concluded
that (i) the City could create a stand-alone police department at a lower estimated cost than
would be provided under the current contract with the County of Riverside, and (ii) the City could
provide a law enforcement services at a level higher than what is currently being received,
including officers that would be available in the City on a 24/7 basis; providing for better response
times to calls for service; and improved coordination with code enforcement, fire and other City
services; and
WHEREAS, a municipal police department would also provide the public with better
access to police services since there would be a police facility in the City, as opposed to the
current circumstance, where the nearest full Sheriffs station is in the City of Perris.
WHEREAS, the City has sufficient current and forecasted resources to fund the start-up
costs for the formation of the Menifee PD, which costs are forecasted to be recouped in
operational savings within less than two (2) years after commencement of Menifee PD
operations.
WHEREAS, the City Council has thoroughly reviewed Feasibility Study, the staff analysis
of the Feasibility Study, and comments received from the public, all related to the comparison
between (i) the receipt of law enforcement services under the current contract with the County

of Riverside, and (ii) the receipt of law enforcement services from an "in-house" municipal police
department; and
WHEREAS, during its special meeting/workshop of October 18, 2018, the City Council
directed that City staff prepare and bring forward for City Council consideration a resolution
directing staff to aggressively and expeditiously proceed forward with the steps necessary to
form a City -operated Menifee Police Department, including without limitation (i) the recruitment
of a police chief for the Menifee PD, (ii) the identification and securing of building space for the
Menifee PD, (iii) the acquisition of necessary equipment for the Menifee PD, (iv) the
establishment of other contracts necessary to provide resources for the protection of public
safety, (v) the identification and establishment of risk management relationships to guard against
additional liabilities associated with the operation of the Menifee PD, (vi) the formation of
personnel rules and regulations for the engagement of sworn and unsworn public safety staff of
the Menifee PD, and (vi) the delivery at the appropriate time of a notice of termination of the
City's current agreement with the County of Riverside for the provision of police services
WHEREAS, the City Council herein finds that it is in the best interests of the City of
Menifee to form its own municipal police department and to separate from the existing law
enforcement services contract with the County of Riverside; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Menifee,
California:
Section 1. That the above recitals are hereby incorporated by reference.
Section 2. That the City Council finds and determines that the quality of services provided by
Riverside County Sheriff's department to the City since its incorporation have been exemplary,
but that the increasing costs of those services and the desire to obtain a greater level of local
control over the deployment of law enforcement services necessitate the City s adoption of a
different law enforcement service model.
Section 3. That the City Council hereby declares its intent to form a municipal police
department to be known as the Menifee Police Department.
Section 4. That the City Council hereby authorizes the City Manager to deliver a notice of
intent to terminate the City's contract for law enforcement services with the County of Riverside;
provided that such notice will not be delivered to the County of Riverside until the City Manager
has determined that the City will be prepared to provide its own law enforcement services within
(12) twelve months following the delivery of the notice.
Section 5. That the City Council direct the City Manager to oversee the preparation of a budget,
with identified funding sources and options, for formation of the Menifee PD, and to present that
budget to the Menifee City Council.
Section 6. That the City Council hereby directs the City Manager to immediately commence
and expeditiously complete the recruitment of a Police Chief for the Menifee PD; and that
following completion of the recruitment, that the Police Chief shall provide input,
recommendations, and assistance to the City in determining departmental organization,

deployment of law enforcement services, acquisition of equipment, configuration of building
space, and all other matters necessary and appropriate to the formation of the Menifee PD.
Section 7. That the City Council hereby directs City Attorney immediately commence and
expeditiously complete revisions to the Menifee Municipal Code for the formation of the Menifee
PD, including without limitation the establishment of a Director of Public Safety (Police Chief),
adoption of standards as required by State Law (Penal Code § 13500 et seq.), description of the
role of civilian employees of the Menifee PD, and any such additional matters as are necessary
and appropriate.
Section 8. That the City Manager immediately commence and expeditiously complete the
identification of appropriate building space for the Menifee PD; provided that if feasible the City
Manager will await finalization of any arrangements to secure such space until a Police Chief
has been engaged and provided input on the building selection.
Section 9. That the City Manager immediately commence arrangements for the acquisition of
all necessary equipment for the formation of the Menifee PD; provided that the City Manager
shall await finalization of the acquisition of such equipment until a Police Chief has been engaged
and can provide input on such acquisitions.
Section 10. That the City Manager shall immediately commence discussion for the
establishment of any and all contracts necessary for the protection of public safety, including
without limitation negotiations with the Murrieta Police Department for the formation of a joint
dispatch arrangement; provided that the City Manager shall await finalization of all such
negotiations until a Police Chief has been engaged and can provide input on such negotiations.
Section 11. That the City Manager shall immediately commence and expeditiously complete
arrangements to ensure the City has secured levels of insurance and other risk management
protections that are appropriate for the formation of the Menifee PD.
Section 12: That the City Manager shall immediately commence and expeditiously complete
the formulation of appropriate personnel rules and regulations for the engagement of sworn and
unsworn public safety staff for the Menifee PD.
Section 13. That the City Manager shall engage in all other steps that are necessary and
appropriate to facilitate the expeditious formation of the Menifee PD.
Section 14. That the City Council delegates to the City Manager the authority to enter into all
contracts, leases, and instruments as are necessary to implement the direction provided in this
Resolution, so long as such contracts, leases and instruments are substantially consistent with
thebudget required by Section 5, above.
