1. As required by the City of Menifee ("City") conditions of approval for Riverside
Mitland Investor 03 LLC, a Delaware limited liability company ("Owner") requests that the City
Council of the City of Menifee (the "City") initiate proceedings pursuant to the Mello -Roos
Community Facilities Act of 1982, as amended, Chapter 2.5 (commencing with Section 53311),
Part 1, Division 2, Title 5 of the Government Code of the State of California, for the formation of
a community facilities district over and including the property in the City of Menifee, California,
described in Exhibit "A" attached hereto (the "Property") to be designated "City of Menifee
Community Facilities District No. 2012-1 (Audie Murphy Ranch)" (the "CFD") to provide for
the funding, through the levy of special taxes, of the actual annual costs of. (i) the maintenance
and servicing of street lights, parks, parkways, streets, roads and open space, (ii) the operation
and maintenance of storm drainage systems serving the Property, (iii) a reserve fund for capital
replacement of such facilities, and (iv) payment of CFD administrative expenses.
2. Owner represents to the City Council that it is the owner of 118.37 acres of the
Property.
