REGARDING IMPLEMENTATION OF REGIONAL TRAILS PLANS
FOR AUDIE MURPHY RANCH--AMENDMENT#1
This Memorandum of Understanding dated as of&L, 2012, is entered into between
the City of Menifee ("City") and Sutter Mitland 01, LLC, Brookfield AMR/RG LLC, Brookfield
AMR/FR LLC and Riverside Mitland Investor 03, LLC ("Developer") concerning County of
Riverside and City conditions of approval ("Conditions") placed on Tentative Tract Map ("Tract
Map" or "Tract") No. 31391 (and City's extension of same) within the Audie Murphy Ranch
("AMR") Specific Plan and adjoining AMR Tracts 31390, 31392 and 31393, as well as Tract Map
No. 32025 within the Canyon Cove Specific Plan relative to regional trails and bikeways to be
implemented by Developer and Woodside AMR 107, Inc., and Woodside AMR 91, Inc. ("Guest
Builders") at AMR and Canyon Cove.
This document shall be referred to as the "Audie Murphy Ranch Trails MOU Amendment
#1" dated Feh_7 , 2012."
RECITALS
A. WHEREAS, the Developer and the City entered into a Memorandum of
Understanding regarding implementation of Regional Trails Plans for Audie Murphy Ranch on
June 7, 2011; and
B. WHEREAS, the Developer and City have since acquired additional information
about trail design and feasibility issues related to the site; and
C. WHEREAS, the purpose of this Amendment to the MOU is provide additional
standards and specific direction for implementation of the trail plan for the City and Developer.
NOW THEREFORE, THE PARTIES DO HEREBY AGREE TO AMEND THE MOU AS
FOLLOWS:
ADD DEFINITIONS All Class 1/Bike Path/Regional Trails identified in the Specific Plan
and that appear in green on Exhibit A will be constructed in accordance with Exhibit B
Regional Trail-In Rural Areas to complete the trail system as indicated in Exhibit A. The
material used for the surface of the trail shall be soil cement or other, similar material
deemed acceptable by agreement between the Developer and the City Engineer.
ADD SECTION 5. A. (1) Notwithstanding the requirement above, the concrete portion of
the Class 1 Bike Path/Regional Trail that extends along the north side of the park on
PA39, and the west side of the same park shall be 8 feet in width except where the
improvement may be reduced only on a portion of Lone Pine to 6' to avoid existing
utilities, not 10 feet as required in the standards. This modification is being made to
accommodate site-constraints related to grading in these locations (See Exhibit B-4).
ADD SECTION 5. E. Developer shall provide all trails and sidewalks as indicated on
Exhibit A and Exhibit C. The trail in 31392 (not shown on the Exhibit A) is still required
per other provisions in the MOU.
REVISE SECTION 6.G. Notwithstanding, in the event that the trail consultant determines
that a trail cannot be built in 31392, in lieu of the construction for the north south Class
1/Bike Path/Regional Trail, Developer shall pay to City the sum of$50,000. Such
amount shall be paid upon the issuance of the first building permit for 31392; the funds
shall be held in a segregated account and managed in the same manner as other
development impact fees, although the funds may be comingled for investment. Such
funds shall be expended for the acquisition of property for and /or the construction of a
north-south Class 1 Bike Path/Regional Trail which benefits the residents of the areas
described in the maps as well as 31390, 31391, 31392, 31393 and 32025. The $50,000
would not qualify for Developer Impact Fee credit unless the project is listed on the
list of eligible projects for fee credits.
