2010/10/22 Valley-Wide Recreation and Park District Aldergate Dog Park MOU Memorandum of Understanding -Aldergate Dog Park This Memorandum of Understanding (MOU) is made this 22"d day of October, 2010, by and between the City of Menifee ("City") and the Valley-Wide Recreation and Park District ("District") for City's contribution to the funding of the Aldergate Dog Park. RECITALS 1. The District owns and operates Aldergate Dog Park, which is located within the District's boundaries and within the City. 2. The District requires assistance in funding improvements to the Dog Park. 3. The Dog Park is of benefit to the citizens of Menifee and their pets. 4. The District is authorized to work with other public agencies to carry out its community recreation purposes. 5. The City is authorized to work with the District on projects of benefit to Menifee. 6. The City Council therefore wishes to provide partial funding for certain improvements of the Dog Park in return for certain commitments by District. Now, therefore, the parties agree as follows: 1. City Contribution: Upon execution of this MOU, the City shall pay District $4,250 as its one-time contribution to the improvement of the Dog Park. The City shall have no further obligation of any kind to fund or to operate the Dog Park. 2. District Obligation: a. The District shall utilize the funds provided under Section 1 above only for the following improvements to the Dog Park: -Fresh water Line to spigot inside park. - Double gate entry with concrete slab extended from parking lot. - Posted Dog Park Rules sign near entry as those may be revised from time to time. b. District shall complete such improvements. District at all times shall operate the Dog Park pursuant to its rules and regulations attached and incorporated as Exhibit A as well as any other applicable provisions of law or regulations. c. District shall coordinate with City so that all dog parks within the City operate utilizing the same regulations, which may require a change in current District regulations. Change in regulations shall be mutually agreed upon. 3. District Indemnification of City: District indemnifies, defends and holds harmless City, its officers, employees, agents and authorized volunteers, from and against any and all liabilities, claims, demands or causes of action for bodily injury (including but not limited to death) or property damage arising or alleged to arise as a result of District's ownership and/or operation or failure to operate Aldergate Dog Park, except as such arise from the sole negligence or misconduct of City. 4. Insurance: District shall show City satisfactory evidence that it has included City as an additional named insured on its insurance or self-insurance exclusively for Aldergate Dog Park. 5. Relationship of Parties: As a result of this Agreement, neither District nor City shall be deemed to be joint venturers nor shall the employees of one be deemed to be employees of the other. Except as otherwise provided in Section 3 above, each party shall bear the liability for its own actions. 6. Miscellaneous: This MOU may be modified only in writing signed by the parties. No waiver of any term or condition of this Agreement shall be a continuing waiver thereof. This MOU sets forth the entire agreement of the parties as to its subject matter. Time is of the essence in the performance of this MOU. IN WITNESS WHEREOF, the undersigned authorized parties have executed this Agreement as of the date set out above. Hours: Sunrise to Sunset 2. Your dog must wear a dog collar, have Proof of License, and be current on all shots 3. A maximum of two dogs per adult 4. Your dog must be leashed when entering or leaving the Park and the owner must carry the leash at all times when inside the Park with their dog 5. Once inside the Park, your dog must be off leash. Also ALL Halties and muzzles should be removed before entering the Park 6. For the safety of your dog(s) and other park visitors, choke, prong, and spike collars are strictly prohibited. If you use these types of collars, remove them before entering the park 7. No Children under the age of 16 is permitted unless accompanied by an adult 8. Aggressive dogs are not permitted on the premises. Dogs must be removed at the first sign of aggression 9. Female dogs in heat are prohibited from entering the park 10. Dog owners must be in the park and within view of their dogs at all times 11. No food. Dog treats, or personal dog toys are allowed inside the Park 12. Owner must clean up dog feces. Seal waste in the provided plastic bags before disposing in designated receptacles 13. Fill any holes your dogs dig 14. Proof of a current rabies vaccination and license is required upon request of a police or animal control officer. Tags may serve as proof 15. DOG OWNERS are LIABLE for any damage or injuries THEIR dog does to other people or other dogs 16. Failure to abide by the park rules may result in loss of privileges. 17.
