PC16-278Resolution No. PC 16-278 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE, CALIFORNIA ADOPTING A NEGATIVE DECLARATION FOR PLOT PLAN NO. 2016-113 FOR RICHARDSON'S RV CENTER SIGN PROGRAM LOCATED AT 26776 AND 26786 ENCANTO ROAD (APN: 331-120-022, -027, & -062) Whereas, on May 18, 2016, the applicant, Richardson's RV Center, filed a formal application with the City of Menifee for a Plot Plan proposing to allow a sign program for the existing Richardson's RV Center (approved by the County of Riverside under Conditional Use Permit No. 3410). The signage proposed under this sign program includes: one (1) 45-tall by 20'-wide free-standing freeway pylon sign (to replace/remodel the existing pole sign) with one (1) 20' by 15-7° electronic digital display and two (2) panels with internally illuminated channel lettering; two (2) 8'-tall by 8'-4"- wide free-standing monument signs; and two (2) 19'-4" by 3' internally illuminated channel letter wall signs (the "Project"); and, Whereas, pursuant to the requirements of the California Environmental Quality Act (CEQA), an Initial Study ("IS") and Negative Declaration ("ND") have been prepared to analyze the Project's potentially significant environmental impacts; and Whereas, between October 20, 2016 and November 9, 2016, the twenty-(20)- day public review period for the draft IS/ND occurred, which was publicly noticed by a publication in a newspaper of general circulation and by providing notice to property owners within 300 feet of the Project site boundaries, related agencies and government agencies; and Whereas, no comments on the IS/ND have been received during the public review period; and Whereas, on November 9, 2016, the Planning Commission of the City of Menifee held a public hearing on the Project and considered all public testimony as well as all materials in the staff report and accompanying documents for Plot Plan No. 2016-113. The hearing was publicly noticed by a publication in The Press Enterprise, a newspaper of general circulation, posting an agenda, and providing notice to both property owners within 300 feet of the Project boundaries and to persons who requested a public notice; and Whereas, the City has complied with CEQA, and the IS/ND is an accurate and objective statement that fully complies with CEQA and the CEQA Guidelines, and represents the independent judgment of the City; and Whereas, no evidence requiring a substantial revision, as defined by CEQA Guidelines Section 15073.5, has been received by the City after circulation of the draft IS/ND that would require re -circulation. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves as follows: 1. The Planning Commission finds on the basis of the evidence presented and the whole record before it, including the Initial Study and the draft Negative Declaration ("ND"), and any comments received, that there is no substantial evidence that the project will have a significant effect on the environment. Resolution No PC 16-278 November 9, 2016 2. The Planning Commission further finds that the adoption of the ND reflects the Planning Commission's independent judgment and analysis. 3. The ND, all documents referenced in the ND, and the record of proceedings on which the Planning Commission's decision is based are located at City of Menifee City Hall at 29714 Haun Road, Menifee, CA 92586, and the custodian of record for these proceedings is the City of Menifee City Clerk. 4. The City of Menifee Planning Commission adopts the draft ND for the project.
