PC15-200Resolution PC 15-200 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE, CALIFORNIA APPROVING PLANNING APPLICATION NO. 2014-251 FOR A SIGN PROGRAM FOR AN EXISTING MEDICAL OFFICE BUILDING LOCATED IN THE TEXAS ROADHOUSE CENTER AT 29878 HAUN ROAD. Whereas, on December 3, 2014, the applicant, Tony Rector, filed a formal application with the City of Menifee for a sign program for an existing 9,500 square foot medical office building located at 29878 Newport Road, within the City of Menifee; and Whereas, on February 11, 2015, the Planning Commission held a public hearing on the Project, considered all public testimony as well as all materials in the staff report and accompanying documents for Planning Application No. 2014-251, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the Project boundaries, and to persons requesting public notice; and, NOW, THEREFORE, the Planning Commission of the City of Menifee hereby resolves as follows: 1. Consistency with the General Plan. The plot plan is consistent with the General Plan Land Use Map, Specific Plan and applicable General Plan objectives, policies, and programs. The General Plan land use of the site is Specific Plan (Newport Hub); specifically Planning Area 1. The intent of this land use designation is to recognize areas where an existing Specific Plan is in place and to provide policies, standards and criteria for the development or redevelopment of these areas. The proposed sign program for an existing medical office building conforms to the zoning, design guidelines and development standards of the Specific Plan and therefore the program is consistent with the General Plan, 2. Consistency with the Zoning Code. The project is zoned Specific Plan (Newport Hub), Planning Area 1 as noted above. The project is consistent with existing zoning and development standards of the Specific Plan related to signage. Surrounding properties are zoned Specific Plan (Newport Hub), Planning Area 1 to the north, south, east and west. These zones are identical with the Specific zone of the project site. The proposed sign program is compatible with the surrounding zoning. 3. Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. The project is surrounded on the south, west and east by existing commercial and office uses. To the north are vacant parcels and existing medical office buildings. The proposed project is compatible with the surrounding land uses, General Plan land use designations and zoning classifications. The signage is consistent with the Specific Plan requirements. Therefore, approval of the Resolution No PC 15-200 2014-251 — Sign Program Application February 11, 2015 application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. 4. Environmental Review. The proposed use has been determined to be Categorically Exempt ("Accessory Structures') under the California Environmental Quality Act (CEQA) and CEQA Guidelines, Section 15311. This section applies to construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on -premise signs. The proposed project is an application for a sign program to add on -premise signs to an existing medical office building located at 29878 Haun Road. 5. Approval. The Planning Commission of the City of Menifee hereby approves Plot Plan No. 2014-251 subject to the above findings (as required under Ordinance No. 348 Section 18.30 C.) and the Conditions of Approval attached as Exhibit "A" to this Resolution. Project Description for Plot Plan No. 2014-251 Plot Plan No. 2014-251 proposes a sign program for an existing 9,500 sq. ft. medical office building located within the same site as Texas Roadhouse. The signage proposed includes two "DaVita" signs: one (1) 27.6 square foot (8'6"x3'3 '/4") and one (1) 43.24 square foot (107"x41"). Vinyl Lettering is also proposed on doors to provide hours of operation and identify the entrance. 2. Indemnification The developer/applicant shall indemnify, protect, defend, and hold harmless, the City and County and any agency or instrumentality thereof, and/or any of its officers, employees and agents (collectively the "City and County") from any and all claims, actions, demands, and liabilities arising or alleged to arise as the result of the applicant's performance or failure to perform under this application or the City's and County's approval thereof, or from any proceedings against or brought against the City or County, or any agency or instrumentality thereof, or any of their officers, employees and agents, to attack, set aside, void, annul, or seek monetary damages resulting from an action by the City or County, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning Plot Plan No. 2014-251 (PA 2014-251). 3. Definitions The words identified in the following list that appear in all capitals in the attached conditions of Pp 2014-251 shall be henceforth defined as follows: APPROVED EXHIBIT S = Sign Program for Plot Plan No. 2014-251 dated January 20, 2015. 4. Conform to Exhibit The development of the sign shall conform substantially to that shown on Exhibit S, dated January 26, 2015, on file under PP 2014-251. 5. Sign Category This plot plan is a permit authorizing the following sign category(ies): Free -Standing Conditions of Approval for 2014-251 Sign Program for Medical Offices Page 2 of 3 _X_ Affixed to Building Directional _ On -Site Identification _ For Sale, Lease or Rent Temporary Political _ Subdivision, On -Site _ Subdivision, Off -Site 6. New Hub Specific Plan Advertising as approved shall conform with the provisions of the New Hub Specific Plan (Specific Plan No. 248). 7. Comply with Ordinances and Codes The development of these premises shall comply with the standards of the New Hub Specific Plan and all other applicable Riverside County or City of Menifee ordinances or guidelines and State and Federal codes. The development of the premises shall conform substantially with that as shown on Exhibit S, unless otherwise amended by these Conditions of Approval. 8. Comply with Building and Safety Compliance with Department of Building and Safety directives and all required permits shall be obtained prior to establishment or continuation of the use. 9. Lighting Hooded and Directed Any outside lighting shall be hooded and directed so as not to shine directly on adjoining property or public right-of-way. 10. Comply with Ordinance 2009-24 All lighting shall comply with any applicable provisions of City of Menifee Ordinance No. 2009-24. 11. Maintenance All signs shall be maintained by the property owner in a condition acceptable to the Community Development Director throughout the life of the permit. Prior to Building Permit Issuance 12. Elevations. Elevations of the wall signs submitted for Building Permit plan check approval shall be in substantial conformance with the elevations shown on APPROVED EXHIBIT S. 13. Fees. Prior to issuance of Building Permits, the Community Development Department shall determine if the fees for project are in a negative balance. If so, any outstanding fees shall be paid by the applicant/developer. Prior to Final Occupancy 14. Final Planning Inspection. The applicant shall obtain final occupancy sign -off from the Planning Division for each Building Permit issued by scheduling a final Planning inspection prior to the final sign -off from the Building Department. Planning staff shall verify that all pertinent Conditions of Approval have been met, Conditions of Approval for 2014-251 Sign Program for Medical Offices Page 3 of 3 including compliance with the approved elevations. The applicant shall have all required architectural details and sign lighting installed and in good condition. END OF CONDITIONS The undersigned, as the applicant or representative of the applicant in the above noted approval, hereby acknowledge receipt of these Conditions, have no questions regarding the requirements contained herein and applied to the approval of the request and shall abide by all such Conditions.
