PC 14-168 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE RECOMMENDING APPROVAL OF TENTATIVE TRACT MAP NO. 2012-142 (TR 36485) FOR THE SUBDIVISION OF 292.34 ACRES EAST OF GOETZ ROAD AND NORTH OF NEWPORT ROAD Whereas, on October 2, 2012, Sutter Mitland 01, LLC applied to the City of Menifee for the approval of a tentative tract map (Tentative Tract Map No. 2012-142/TR 36485) which consists of a subdivision of 292.34 gross acres into 1,008 single family residential lots with minimum lot sizes ranging between 5,000 square feet to 7,200 square feet and forty-four (44) lots for open space; and Whereas, on January 28, 2014, the Planning Commission held a duly noticed public hearing on the tentative tract map, considered all public testimony as well as all materials in the staff report and accompanying documents for Tentative Tract Map No. 2012-142, which hearing was publicly noticed by a publication in the newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the project boundaries, and to persons requesting public notice; and Whereas, at the January 28, 2014 Planning Commission public hearing, the Commission found that: 1. Consistency with the General Plan. The Tentative Tract Map is consistent with the General Plan Land Use Map, Specific Plan and applicable General Plan policies and implementation actions. The General Plan land use of the site is Specific Plan (Audie Murphy Ranch Specific Plan). The proposed Tentative Tract Map meets the requirements of the Specific Plan land use designation. The project is within the Audie Murphy Specific Plan. The General Plan Land Use Designation described above is compatible with the underlying zoning classification of Specific Plan (Audie Murphy Ranch). The Tentative Tract Map is consistent with the design guidelines, zoning and development standards of the Specific Plan as amended by the concurrent Specific Plan Amendment and Change of Zone. The project is consistent with General Plan Implementation Action LU-5, which requires growth be focused within specific plans and economic development corridors. The project is consistent with the surrounding existing and planned land uses. The City of Menifee has two (2) active conservation plans within the City's boundary, the Western Riverside County MSHCP, and the Stephens' Kangaroo Rat Habitat Conservation Plan (SKR-HCP). The subject site is within the jurisdiction of the SKR-HCP and the Western Riverside County MSHCP. The project site is located inside the Stephen's Kangaroo Rat (Dipodomys stephensi) (SKR) Fee Area. The proposed project is located within the boundaries of the Western Riverside County Multiple Species Habitat Conservation Plan; however, the project is not located with a Criteria Cell or Cell Group. The project will be subject to the payment of fees for a residential project consistent with the Riverside County Ordinance 810.2 as adopted by the City of Menifee. Therefore, the project will not conflict with the provisions of the adopted HCP, Natural Conservation Community Plan, or other approved local, regional, or State conservation plan and the impact is considered less than significant. Resolution No. PC 14-168 Tentative Tract Map No. 2012-142 (TR 36485) 2. Consistency with the Zoning Code. The project is zoned Specific Plan (Audie Murphy Ranch Specific Plan). The Tentative Tract Map is consistent with proposed zoning and development standards as amended by the concurrent Specific Plan Amendment and Change of Zone. The surrounding zoning classifications are compatible with the Specific Plan (Audie Murphy Ranch Specific Plan) zone of the project site. 3. Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. The proposed project is compatible with the surrounding land uses, general plan land use designations and zoning classifications. Environmental impacts resulting from the project have been analyzed in an Addendum which did not identify any potentially significant impacts or increased impacts that were not already addressed in EIR No. 436. Therefore, the project is not anticipated to create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. 4. Consistency with Ordinance 460 Regulating the Division of Land. The Tentative Tract Map is a Schedule "A" subdivision. A Schedule "A" tract map is defined as any division of land into 5 or more parcels, where any parcel is less than 18,000 square feet in net area. The subdivision has been reviewed and conditioned for consistency with the requirements for streets, domestic water, fire protection, sewage disposal, fences, and electrical communication facilities. The subdivision is consistent with the Schedule "A" map requirements of Ordinance 460. 5. Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. An Addendum to EIR No. 436 has been completed for the proposed project. The Addendum did not identify any potentially significant impacts or increased impacts that were not already addressed in EIR No. 436. Now, therefore, the Planning Commission of the City of Menifee resolves and orders as follows: The Findings set out above are true and correct.
