PC 14-165 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE RECOMMENDING APPROVAL OF SPECIFIC PLAN AMENDMENT NO. 2012-033 (AUDIE MURPHY RANCH SPECIFIC PLAN AMENDMENT NO. 5) Whereas, on March 5, 2012, the applicant, Sutter Mitland 01, LLC, filed a formal application with the City of Menifee for the approval of an amendment to the Audie Murphy Ranch Specific Plan (Specific Plan No. 209). Whereas, on January 28, 2014, the City of Menifee Planning Commission considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the project site boundaries; and Whereas, on January 28, 2014, the City of Menifee Planning Commission made the following Findings for Specific Plan Amendment No. 2012-033: 1. Consistency with the General Plan, The Specific Plan Amendment is consistent with the General Plan Land Use Map, Specific Plan and applicable General Plan policies and implementation actions. The General Plan land use of the site is Specific Plan (Audie Murphy Ranch Specific Plan). The proposed Specific Plan Amendment meets the requirements of the Specific Plan land use designation. The project is within the Audie Murphy Specific Plan, The General Plan Land Use Designation described above is compatible with the underlying zoning classification of Specific Plan (Audie Murphy Ranch). The project is consistent with General Plan Implementation Action LU-5, which requires growth be focused within specific plans and economic development corridors. Surrounding General Plan Land Use designations are 2.1-5 du/ac Residential, Commercial Retail, Open Space -Recreation, Economic Development Corridor to the north, Specific Plan (Canyon Cove Specific Plan), Rural Residential 5 acre minimum, Rural Residential 2 acre minimum, City of Lake Elsinore to the south, 2.1-5 du/ac Residential, Open Space -Recreation, Rural Residential "/2 acre minimum, Economic Development Corridor, Rural Residential 1 acre minimum to the east, and City of Canyon Lake to the west. The project is consistent with the surrounding existing and planned land uses. The City of Menifee has two (2) active conservation plans within the City's boundary, the Western Riverside County MSHCP, and the Stephens' Kangaroo Rat Habitat Conservation Plan (SKR-HCP). The subject site is within the jurisdiction of the SKR-HCP and the Western Riverside County MSHCP. The project site is located inside the Stephen's Kangaroo Rat (Dipodomys stephensi) (SKR) Fee Area. The proposed project is located within the boundaries of the Western Riverside County Multiple Species Habitat Conservation Plan; however, the project is not located with a Criteria Cell or Cell Group. The project will be subject to the payment of fees for a residential project consistent with the Riverside County Ordinance 810.2 as adopted by the City of Menifee. Therefore, the project will not conflict with the provisions of the adopted HCP, Natural Resolution No. PC 14-165 Specific Plan Amendment No. 2012-033 Conservation Community Plan, or other approved local, regional, or State conservation plan and the impact is considered less than significant. 2. Consistency with the Zoning Code. The project is zoned Specific Plan (Audie Murphy Ranch Specific Plan). The proposed concurrent Change of Zone is for the purposes of applying development standards consistent with the proposed Specific Plan Amendment and concurrent Tentative Tract Maps. Surrounding zoning includes General Commercial (C-1/C-P), Residential Agricultural (R-A), One -Family Dwellings (R-1), Watercourse, Watershed, and Conservation Areas (W-1) to the north, Canyon Cove Specific Plan (SP), Residential Agricultural 5 acre minimum (R-A-5), Residential Agricultural 2 1/2 acre minimum (R-A-2 '/), City of Lake Elsinore to the south, One -Family Dwellings (R-1), Watercourse, Watershed, and Conservation Areas (W-1), Scenic Highway Commercial (C-P-S), Mobilehome Subdivision and Mobilehome Park (R-T), One -Family Dwelling 20000 sq. ft. minimum (R-1-20000) to the east, and City of Canyon Lake to the west. These classifications are compatible with the Specific Plan (Audie Murphy Ranch Specific Plan) zone of the project site. 3. Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. The northern boundary abuts rural residential and single-family residential land uses primarily. To the east lies primarily single-family residential with some vacant and rural residential land uses. To the south is primarily vacant land with some rural residential land uses. To the west is single-family residential within the City of Canyon Lake. The proposed project is compatible with the surrounding land uses, general plan land use designations and zoning classifications. Environmental impacts resulting from the project have been analyzed in an Addendum which did not identify any potentially significant impacts or increased impacts that were not already addressed in EIR No. 436. Therefore, the project is not anticipated to create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the project vicinity. Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. An Addendum to EIR No. 436 has been completed for the proposed project. The Addendum did not identify any potentially significant impacts or increased impacts that were not already addressed in EIR No. 436. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: The Findings set out above are true and correct.
