A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MENIFEE APPROVING MINOR CHANGE 2013-168 TO APPROVED
TENTATIVE TRACT MAP NO. 30422 FOR THE SUBDIVISION OF 399
ACRES EAST OF MENIFEE ROAD AND SOUTH OF NEWPORT ROAD
Whereas, on August 22, 2013, CV Communities applied to the City of Menifee
for the approval of a minor change to an approved tentative tract map (TR30422) which
consisted of a subdivision of 399 acres into 992 total single-family lots; and
Whereas, the minor change would decrease the total number of single-family
lots within TR30422 as originally approved from 992 single-family lots to 971 single-
family lots. More specifically the lot reduction will occur in TR30422-3 (273 single-family
lots as originally approved to 252 single-family lots as modified); and
Whereas, on December 10, 2013, the Planning Commission held a duly noticed
public hearing on the minor change, considered all public testimony as well as all
materials in the staff report and accompanying documents for Minor Change No. 2013-
168, which hearing was publicly noticed by a publication in the newspaper of general
circulation, an agenda posting, and notice to property owners within 300 feet of the
project boundaries, and to persons requesting public notice; and
Whereas, at the December 10, 2013 Planning Commission public hearing, the
Commission found that:
Consistency with the General Plan. The minor change is consistent with the
General Plan Land Use Map and applicable General Plan objectives, policies,
and programs.
The General Plan land use of the site is a mix of Medium Density Residential
(MDR) primarily with Medium High Density Residential (MHDR), Very High
Density Residential (VHDR), and Commercial Retail (CR). The proposed project
meets the requirements of the Medium Density Residential (MDR) primarily with
Medium High Density Residential (MHDR), Very High Density Residential
(VHDR), and Commercial Retail (CR) land use designations.
Surrounding General Plan Land Use designations include Medium Density
Residential (MDR) to the north, east, south, and west, Commercial Retail (CR) to
the north and west, Low Density Residential (LDR) to the west, Open Space —
Recreation to the east and west, and Agriculture (AG) to the east. These land
use designations are generally compatible with those proposed for the site as
previously approved under Specific Plan 247 and TR30422.
The future proposed General Plan land use designation for the property is
Specific Plan. The intent of this land use designation is to recognize areas where
an existing specific plan is in place and to provide policies, standards and criteria
for the development or redevelopment of these areas. The project is consistent
with the existing General Plan land use and there is a reasonable possibility that
the project will be consistent with the future General Plan and therefore, shall not
interfere with the future adopted General Plan, including a Housing Element that
is consistent with State Housing Element law.

Minor Change No. 2013-168 to TR30422
The City of Menifee has two active conservation plans within the City's boundary;
the Western Riverside County MSHCP and the Stephens' Kangaroo Rat Habitat
Conservation Plan (SKR-HCP). The subject site is within the jurisdiction of the
SKR-HCP and the Western Riverside County MSHCP. The project site is
located inside the Stephen's Kangaroo Rat (Dipodomys stephenst) (SKR) Fee
Area. The proposed project is located within the boundaries of the Western
Riverside County Multiple Species Habitat Conservation Plan; however, the
project is not located with a Criteria Cell or Cell Group. The project will be
subject to the payment of fees for a residential project consistent with Riverside
County Ordinance 810.2 as adopted by the City of Menifee. Therefore, the
project will not conflict with the provisions of the adopted HCP, Natural
Conservation Community Plan, or other approved local, regional, or State
conservation plan and the impact is considered less than significant.
2. Consistency with the Zoning Code.
The project is zoned Specific Plan (SP 247, Menifee East). The project is
consistent with the existing zoning and applicable development standards.
Surrounding zoning includes Specific Plan (SP 158, Menifee Villages) to the
north and west, One -Family Dwelling (R-1) to the south and west, Planned
Residential (R-4) to the north and south, Heavy Agriculture 10-acre minimum (A-
2-10) to the east, and Rural Residential (R-R) to the east. These zoning
classifications are compatible with the uses proposed for the site as previously
approved by the current Specific Plan and TR30422.
3. Consistency with Ordinance 460 Regulating the Division of Land.
The overall tentative tract map is a Schedule "A" subdivision of 399 acres. A
Schedule "A" tract map is defined as Any division of land into 5 or more parcels,
where any parcel is less than 18,000 square feet in net area. The subdivision
has been reviewed and conditioned for consistency with the requirements for
streets, domestic water, fire protection, sewage disposal, fences, and electrical
communication facilities. The subdivision and current minor change are
consistent with the Schedule "A" map requirements of Ordinance 460.
4. Surrounding Uses. Approval of the application will not create conditions
materially detrimental to the public health, safety and general welfare or injurious
to or incompatible with other properties or land uses in the project vicinity.
Surrounding land uses include single-family residential uses to the north, east,
south, and west, agricultural and recreational uses to the east, elementary school
to the west, and vacant land to the north, east, and south.
The proposed project as originally approved under Specific Plan 247 and
TR30422 is compatible with the surrounding land uses, General Plan land use
designations and zoning classifications. Environmental impacts resulting from
the project have been analyzed in a previously adopted EIR for the original
Specific Plan 247 and Addendum to the EIR for the subsequent Specific Plan
Amendment and TR30422. The proposed Minor Change would decrease the
total number of single-family lots and the Specific Plan Substantial Conformance
would expedite the construction of a park. Therefore, the project is not
anticipated to create conditions materially detrimental to the public health, safety

and general welfare or injurious to or incompatible with other properties or land
uses in the project vicinity.
5. Compliance with CEQA. No Further Environmental Documentation
Required.
All impacts related to the minor change were analyzed in an Environmental
Impact Report (SCH 1989071715) prepared for the original Specific Plan 247
and an Addendum (EA 38703) prepared for an Amendment to the Specific Plan
and TR30422, which was adopted by the County of Riverside Board of
Supervisors. No new environmental impacts have been identified. No further
environmental review is required. The previously prepared EIR and Addendum
are still accurate and applicable for this approval.
Now, therefore, the Planning Commission of the City of Menifee resolves and
orders as follows:
Section 1. The Findings set out above are true and correct.
Section 2. Minor Change No. 2013-168, is approved subject to the Conditions of
Approval as set forth in Exhibit "1" to this Resolution as modifications to
existing conditions of TR30422 and as approved by the Planning
Commission on December 10, 2013.

Minor Change 2013-168 reduces the total number of single-family lots from 992 as
originally approved by TR30422 to 971. Specifically, the Minor Change proposes to
reduce the number of single-family lots within TR30422-3 from 273 to 252. With this
reduction in lots, lot alignment, grading, and street alignments would also change slightly
compared to the original TR30422. Conditions of Approval are also added to TR30422

The developer shall construct and complete the park within Planning Area 18 by June 1,

PRIOR TO THE ISSUANCE OF THE 726th building permit within the SPECIFIC PLAN,
detailed park plans shall be submitted to and approved by the Community Development
Department and the Valley Wide Recreation and Parks District or other entity set forth in
the Community Development Department's condition entitled "SP - Common Area
Maintenance" for the park site designated as Planning Area 18. The detailed park plans
shall conform with the design criteria in the specific plan document for Planning Area 18
and with the requirements of the Valley Wide Recreation and Parks District or other
entity set forth in the Community Development Department condition entitled "SP -
Common Area Maintenance". The park plans need not be working drawings, but shall
include landscape and irrigation plans, descriptions and placement of recreational
facilities and documentation evidencing a permanent maintenance mechanism for the
