A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MENIFEE, CALIFORNIA, INTERPRETATING MUNICIPAL CODE
ARTICLE XIII, LIGHT AGRICULTURAL ZONE, SECTION 13.1
"PERMITTED USES", TO ALLOW SILK SCREENING AS A USE
PERMITTED WITH APPROVAL OF A CONDITIONAL USE PERMIT.
WHEREAS, the City of Menifee incorporated on October 1, 2008, as a general
law city of the State of California; and
WHEREAS, the City formed a Planning Commission effective July 1, 2009,
which has the authority under the provisions of the City's Municipal Code to interpret the
uses allowed within specific zoning districts of the City, when specific provisions have
been met; and
WHEREAS, the City's Planning Commission was requested to consider if, where
and under what circumstances the land use activity known as silk screening would be
allowed within the City of Menifee, specifically within the City's Light Agricultural zoning
district; and
WHEREAS, at a regularly scheduled meeting, open to the public, on September
10, 2013, the Planning Commission, following a staff presentation and public comment
discussed the provisions and allowances for interpretations of the Municipal Code as
allowed under Article XIII, "Light Agricultural Zone" (A-1), Section 13.1 "Permitted Uses",
Subsection "d", which reads as follows:
"d. Any use that is not specifically listed in Subsections a. and b. may be considered a
permitted or conditionally permitted use provided that the Planning Director finds that
the proposed use is substantially the same in character and intensity as those listed in
the designated subsections. Such a use is subject to the permit process which governs
the category in which it falls."
WHEREAS, at the regularly scheduled meeting of September 10, 2013, the
Planning Commission considered the nature of silk screening activities, the intensity of
such use and the possible impacts from such a use and further considered the uses,
intensity and possible impacts from other such uses currently permitted or conditionally
permitted within the Light Agricultural zone and whether silk screening could be
considered "...substantially the same in character and intensity as those (uses) listed...".
NOW, THEREFORE, the Planning Commission of the City of Menifee, California,
does resolve and order as follows:
SECTION 1. SILK SCREENING A CONDITIONALLY PERMITTED USE. As
permitted under the provisions of Menifee Municipal Code Article XIII, "Light Agricultural
Zone", Section 13.1 "Permitted Uses", Subsection "d", the Planning Commission finds
that the land use activity known as silk screening is substantially the same in character
and intensity as those uses presently listed as conditionally permitted uses within the
Light Agricultural land use district and that such use may be permitted upon individual
properties so zoned with Planning Commission approval of a Conditional Use Permit.
