PC 13-152 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE RECOMMENDING APPROVAL OF PP 2011-155 VAR 2013- 196 HAUN PROFESSIONAL BUILDING SIGN PROGRAM Whereas, on November 7, 2011 the applicant, Haun Professional LLC, Steve Gibson, filed a formal application with the City of Menifee for the proposed sign program. Whereas, on October 8, 2013, the City of Menifee Planning Commission considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the project site boundaries; and Whereas, on October 8, 2013, the City of Menifee Planning Commission made the following Findings for Plot Plan No. 2011-155 and Variance No. 2013-196: An Environmental Impact Report was approved and mitigation measures adopted for Specific Plan 248. The proposed sign program and amendment to the sign standard may result in a negligible increase in signage and therefore does not require any further action under CEQA as a Class 3, per section 15303. New Construction or Conversion of Small Structures .and a Class 11, 15311 Accessory structures. 2. The project site is designated Community Development: Commercial Retail on the Sun City Menifee/Valley Area Plan. 3. The proposed project is consistent with the Specific Plan No. 248 Newport Hub, with approval of a variance. 4. The zoning for the subject site is Planning Area 1 of Specific Plan No. 248 Newport Hub. 5. The proposed signs are consistent with Planning Area 1 of Specific Plan No. 248 Newport Hub. The proposed project is consistent with the development standards set forth in Planning Area 1 of Specific Plan No. 248 Newport Hub, excluding those standards as noted in the subject Variance. The proposed sign program deviates from certain standards regarding amount of signs, sign height, and number of tenant names that are within the Specific Plan. The deviation from these standards, as requested through the subject Variance No. 2013-196, can be justified primarily from the location and orientation of the three lots which limit the visibility of signage on the eastern most parcel from Haun Road, thus necessitating enhanced signage in the form of one additional monument sign on the southwest vacant parcel to serve all three parcels, six (6) additional tenant names to provide for the number of anticipated tenants, and additional height to allow for the additional tenant names. Therefore, with the approval of the variance based on these findings, the proposed project is consistent with the Zoning Code. 8. There is a reasonable probability that the project will be consistent with the future adopted general plan, including a housing element that is consistent with state housing element law. This property is within a Specific Plan and the land use is not anticipated to change. 9. There is little or no probability that the project will be detrimental to or interfere with the implementation of the future adopted general plan, including a housing element that is consistent with State Housing Element Law. 10. The project proposes signage located on the east of Haun Road and north of Newport Road which is an existing commercial portion of the City. The project promotes the vision and values by focusing growth in an urban area. The project is consistent with the vision and values of Menifee. 11. The public's health, safety and general welfare are protected through project design. 12. The project is clearly compatible with the present and future logical development of the area. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: 1. The Findings set out above are true and correct. 2. Plot Plan No. 2011-155 and Variance No. 2013-196 is hereby approved subject to the Conditions of Approval Exhibit "A" to this Resolution. Project Description The use hereby permitted is Planning Department approval of a sign program for the Haun Professional Building. The proposed sign program would be in addition to existing signs on the site. The proposed sign program includes three (3) entrance monument signs, directional signage, and an outdoor directory sign. No other signs are part of this approval. Any additional signage not included within this program requires additional Planning Department approvals. 2. Indemnification. The developer/applicant shall indemnify, protect, defend, and hold harmless, the City and County and any agency or instrumentality thereof, and/or any of its officers, employees and agents (collectively the "City and County') from any and all claims, actions, demands, and liabilities arising or alleged to arise as the result of the applicant's performance or failure to perform under this Plot Plan or the City's and County's approval thereof, or from any proceedings against or brought against the City or County, or any agency or instrumentality thereof, or any of their officers, employees and agents, to attack, set aside, void, annul, or seek monetary damages resulting from an action by the City or County, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning Plot Plan No. 2011-155 (PP 2011-155). 3. Definitions The words identified in the following list that appear in all capitals in the attached conditions of PP 2011-155 shall be henceforth defined as follows: APPROVED EXHIBIT A = Site Plan for Plot Plan No. 2011-155, dated September 13, 2013. APPROVED EXHIBIT S = Signage Plan for Plot Plan No. 2011-155, dated September 13, 2013. SPECIFIC PLAN = Specific Plan No. 248 (Newport Hub) VARIANCE = Variance No. 2013-196. 4. Conform to Exhibit Conditions of Approval Plot Plan No. 2011-155 Houn Professional Building Sign Program August 15, 2012 The development of the sign shall conform substantially to that shown on APPROVED EXHIBIT A and APPROVED EXHIBIT S, on file with PP 2011-155. 5. Sign Standards Advertising as approved shall conform with the provisions of the SPECIFIC PLAN, with special reference to Section II. B. 4. H. of the SPECIFIC PLAN, excluding those standards specifically noted in the approved VARIANCE for the number of monument signs, directory sign height, and number of name spaces for a directory sign. 6. Building Permit Required Prior to the installation of the advertising device or structure, a building permit shall be obtained from the City of Menifee Department of Building and Safety. 7. Encroachment Permits All work done within Riverside County and/or City of Menifee right-of-way shall have been authorized by an encroachment permit. 8. Lighting Hooded and Directed Any outside lighting shall be hooded and directed so as not to shine directly on adjoining property or public right-of-way. 9. Comply with Ordinances/Codes The development of these premises shall comply with the standards of Ordinance No. 348 and all other applicable City of Menifee ordinances and State and Federal codes. 10. Comply with Ordinance 2009-24 All lighting shall comply with any applicable provisions of City of Menifee Ordinance No. 2009-24. 11. Expiration Date This approval shall be used within two (2) years from the date of approval; otherwise, the Plot Plan shall be null and void. Notwithstanding the foregoing, the applicant or a successor -in -interest may, prior to its expiration, request an extension of time in which to use the Plot Plan. If an extension is granted, the total time allowed for use of the Plot Plan shall not exceed a period of five years, calculated from the date of approval. The term "use" shall mean the beginning of substantial construction of the use that is authorized, which construction must thereafter be pursued diligently to completion, or the actual occupancy of existing buildings or land under the terms of the authorized use. 12. Signs Maintained All signs shall be maintained in a condition acceptable to the Planning Department throughout the life of the permit. Graffiti shall be removed from all signs within 24 hours. Tattered or faded flags shall be replaced or removed. END OF CONDITIONS
