PC13-151Resolution No. PC 13-151 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE RECOMMENDING APPROVAL OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE AMENDING THE SIGN STANDARDS WITHIN THE ARCHITECTURAL DESIGN GUIDELINES OF SPECIFIC PLAN NO. 248 NEWPORT HUB Whereas, on February 28, 2013 the applicant, Haun Professional LLC, Steve Gibson, filed a formal application with the City of Menifee to amend the sign standards found in the Architectural Guidelines of Specific Plan No. 248 "Newport Hub". Whereas, on October 8, 2013, the City of Menifee Planning Commission considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 300 feet of the project site boundaries; and Whereas, on October 8, 2013, the City of Menifee Planning Commission made the following Findings for Specific Plan Amendment No. 2013-046: 1. The project is located within Specific Plan No. 248 which was approved by the County of Riverside in 1991. 2. The Architectural Guidelines for Specific Plan No. 248 restrict Tenant Wall Signs for tenants with units less than 5,000 square feet. 3. This standard would not necessarily restrict the size or amount of signs on any side of a building, which is of primary concern. 4. This standard would restrict small tenants from the typical allowance for businesses to identify their location on the outside of their building. 5. The standards for maximum area for Tenant Wall Signs (1 square foot per 1 linear foot of building face) and Building Identification Sign (2 square feet per 2 linear feet of building face) as well as the requirement for Tenant Wall Signs to be located at the top story would still be applicable and would still restrict the size and location of signs to limit proliferation of wall signs. 6. The removal of the tenant unit area restriction would be consistent with the architectural design guideline's goal of enhancing the aesthetic appeal of the project. 7. The project site is designated as Community Development: Commercial Retail on the Sun City/Menifee Valley Area Plan and is zoned Specific Plan No. 248, 8. There is a reasonable probability that the project will be consistent with the future adopted general plan, including a housing element that is consistent with state housing element law. This property is within a Specific Plan and the land use is not anticipated to change. 9. There is little or no probability that the project will be detrimental to or interfere with the implementation of the future adopted general plan, including a housing element that is consistent with state housing element law. 10. The project proposes amending sign standards for development located north of Newport Road, west of 1-215, and east of Paloma Wash, which is an existing commercial portion of the City. The project promotes the vision and values by focusing growth in an urban area. The project is consistent with the vision and values of Menifee. 11. The public's health, safety and general welfare are protected through project design. 12. The amendment is clearly compatible with the present and future logical development of the area. 13. An Environmental Impact Report was approved and mitigation measures adopted for Specific Plan 248. The proposed sign program and amendment to the sign standard may result in a negligible increase in signage and therefore does not require any further action under CEQA as a Class 3, per section 15303. New Construction or Conversion of Small Structures .and a Class 11, 15311 Accessory structures. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: The Findings set out above are true and correct. 2.
