PC11-086Resolution PC 11-086 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE APPROVING VARIANCE NO. 2011-032 FOR THE SITING AND DESIGN OF THE REICH ACCESSORY STRUCTURE Whereas, in March of 2011, the applicant, Larry Heidler, filed a formal application with the City of Menifee for Plot Plan No. 2011-031 and Variance No. 2011- 032 (the "Project") for the siting and construction of an accessory structure on the property located at 29675 Watson Road, which would be larger than City Ordinance No. 2010-078 would allow. These application pertain to Assessor's Parcel Number (APN #) 327-310-059, which is ±38,929 square feet in size; and Whereas, between May 27, 2011 and June 14, 2011, the notice of public hearing was published in the North County Times; and, Whereas, on June 14, 2011 the Planning Commission held a duly noticed public hearing on the Project, considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in the newspaper of general circulation, an agenda posting, notice to property owners within 300 feet of the Project boundaries; and Whereas, the proposed structure is proposed to be 2,400 square feet in size, which is larger than the allowable size of 900 square feet for lots less than 40,000 square feet; and, Whereas, the height of the proposed structure is taller than the allowable height allowed by Ordinance No. 2010-078 for lots less than 40,000 square feet and greater than 20,000 square feet pursuant to Ordinance No. 2010-078; and, Whereas, there are special circumstances pertaining to the property that prevents this property from enjoying privileges of similarly properties within the immediate vicinity, and those special circumstances are as follows: a) The gross size of the property is 42,988 square feet, and the net size of the property is 38,929 square feet because of the dedication of Watson Road. Therefore, although this property is similar in size to its neighbors, the road dedication of Watson made the property 3% less in square footage that would allow a larger detached accessory structure. b) Several neighboring properties have accessory structures, and the installation of the proposed accessory structure will make this property similar in nature to the surrounding vicinity. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: 1. The Findings set out above are true and correct. 2.
