A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE
DENYING PLOT PLAN NO.2010-182 and VARIANCE NO. 2011-002 FOR THE
SITING AND DESIGN OF THE ROWBURY ACCESSORY STRUCTURES
Whereas, in December of 2010, the applicants, Denny and Nubia Rowbury, filed
a formal application with the City of Menifee for Plot Plan No. 2010-182 (the "Project") for
the siting and construction of two accessory structures on the property located at 27680
Grosse Point Drive. In addition, in January of 2011, the applicants also filed Variance
No. 2011-002 to allow for reduced development standards as prescribed in City
Ordinance No. 2010-78. These application pertain to Assessor's Parcel Number (APN
#) 335-253-008, which is ±8,530 square feet in size; and
Whereas, on October 1, 2008, the City of Menifee incorporated and then
became the local government authority for the project area; and
Whereas, a duly noted notice of public hearing was posted at the County Clerk
on January 10, 2010, in addition to the surrounding property owners within 300 feet; and,
Whereas, each of the two structures were constructed without permits; and,
Whereas, the siting and structures does not conform to City Ordinance No.
2010-78 with regards to required setbacks to the rear property line and setbacks to the
main structure; and,
Whereas, otherwise, the siting and structures are within the allowed floor area,
and height limits; and
NOW, THEREFORE, the Planning Commission of the City of Menifee resolves
and orders as follows:
The Findings set out above are true and correct.
2. City of Menifee Cases Plot Plan No. 2010-182 and Variance No. 2011-002 is
denied by the Planning Commission on January 25, 2011
