PC10-052Resolution No. 10-052 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE APPROVING EXTENSION OF TIME NO. 2010-016 FOR THE SECOND ONE-YEAR EXTENSION FOR TENTATIVE PARCEL MAP NO. 31221 Whereas, on April 1, 2003, Acre Consultants, the applicant, filed a formal planning application with the Riverside County for Environmental Assessment No. 39008 and Tentative Parcel Map No. 31221, to subdivide 5.11 acres into two (2) parcels with a minimum lot size of 2 Y2 acres south of Scott Road and east of Paradise Lane; and, Whereas, on January 1, 2004, the Riverside County Planning Director held a duly noticed public hearing on Environmental Assessment No. 39008 and Tentative Parcel Map No. 31221, to subdivide 5.11 acres into two (2) parcels with a minimum lot size of 2'/2 acres south of Scott Road and east of Paradise Lane and at the meeting the Riverside County Planning Director approved Tentative Parcel Map No. 31221; and, Whereas, prior to the January 12, 2007 expiration date, Acre Consultants, on behalf of the property owner Sharon Wright filed an application with Riverside County for the first one-year Extension of Time for Tentative Parcel Map No. 31221 to extend the map through January 12, 2008; and, Whereas, the first extension of time application was approved by Riverside County and the map expiration date was extended to January 12, 2008; and, Whereas, on February 13, 2008, Acre Consultants, on behalf of the property owner Sharon Wright filed an application with Riverside County for the second one-year Extension of Time for Tentative Parcel Map No. 31221 to extend the map through January 12, 2009 and although the application was submitted after the January 12, 2008 expiration date, the County accepted the application for processing; and, Whereas, on July 15, 2008, California Senate Bill 1185 was signed into law, which added sections 66452.11 through 66452.13 to the Subdivision Map Act (California Government Code) by automatically extending the life of any tentative Parcel map, vesting tentative Parcel map, or tentative parcel map for one additional year, if the map approval had not expired by July 15, 2008 but would expire before January 1, 2011; and Whereas, on July 15, 2009, Assembly Bill 333 was signed into law, which amended Section 65961 and added Section 66452.22 to the Subdivision Map Act (California Government Code) by automatically extending the life of any tentative Parcel map, vesting tentative Parcel map, or tentative parcel map for two additional years, if the map approval had not expired by July 15, 2009 but would expire before January 1, 2012; and, Whereas, the extension of Tentative Parcel Map No. 31221 was not processed by County staff in a timely manner or in accordance with the Subdivision Map Act prior to the expiration date and upon transmittal of the extension of time to the City of Menifee staff, City staff contacted the applicant and the applicant agreed to the additional recommended conditions of approval and had County staff processed the extension in accordance with the applicable time frames, the expiration date would have been extended to January 12, 2009 and therefore, Tentative Parcel Map No. 31221 would Resolution No. 10-052 EOT 2010-016 for PM 31221 then fall within the parameters of SIB 1185 and would automatically extended for one year, through January 12, 2010; and therefore, Tentative Parcel Map No. 31221 would then fall within the parameters of AB 333 and would automatically extend for two years; and, Whereas, on October 26, 2010, the City of Menifee Planning Commission, as part of their Consent Calendar, considered Planning Application No. 2010-016 for the second one-year extension for Tentative Parcel Map No. 31221 (in compliance with Ordinance No. 460 and the California Subdivision Map Act, which both allow up to five one-year extensions) and considered materials in the staff report and accompanying documents; and, Whereas, environmental review of the requested extension is not required, because the County of Riverside -approved Tentative Parcel Map No. 31221 received approval of a Environmental Assessment No. 39008 on January 12, 2004, which analyzed and mitigated all potential environmental impacts from the development of the project and the Environmental Assessment was reviewed in light of the additional conditions (set forth in the staff report and incorporated into the attached Conditions of Approval) and it was determined that there was no need for additional environmental review. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: 1. The Findings set out above are true and correct. 2. Planning Application No. 2010-016 is approved, as follows: (a) The second one-year extension for Tentative Parcel Map No. 31221 is approved and valid through January 12, 2009, but automatically extended by SB1185 to January 12, 2010; and then automatically extended again by AB 333 to January 12, 2012; and, (b) The Conditions of Approval set forth in Exhibit A to this resolution are approved as part of the second time extension for Tentative Parcel Map No. 31221; and (c) The Conditions of Approval set forth in Exhibit A have been modified and added to for the public health, safety and welfare of the City of Menifee; and (d) The Conditions of Approval set forth in Exhibit A supersede all previous conditions of approval placed on Tentative Parcel Map No, 31221 and all previous conditions of approval are rendered null and void; and (e) The Conditions of Approval set forth in Exhibit A have been agreed to by an authorized representative of as indicated by the signature at the end of the Conditions of Approval. Approved Project. The land division hereby permitted is to subdivide 5.11 acres into two (2) parcels with a minimum lot size of 2'/2 acres. 2. Maintenance of Parks and Landscaping. All parks, landscaping and similar improvements not maintained by a property owner's association or individual property owner must be annexes into a Lighting and Landscape Maintenance District, or other mechanism as determined by the City of Menifee 3. Fire Facilities Dedications. All fire facilities required by the project shall be dedicated to the City of Menifee. 4. Park Dedication. All Quimby or other park fees or dedication for parkland and park improvements shall be made or paid to the City of Menifee. 5. Previous Conditions of Approval. These Conditions of Approval and the subsequent new conditions from the County of Riverside supersede all previous conditions of approval placed on Tentative Parcel Map No. 31221 and all previous conditions of approval are rendered null and void. 6. Conditions in Construction Drawings. Any submittal of construction drawings, grading plans, improvement plans, etc., shall include a copy of these conditions of approval (in full) immediately following the cover sheet of such plans. 7. Newly Incorporated City. The City of Menifee is a new City incorporated on October 1, 2008; the City is studying and adopting its own ordinances, regulations, procedures, processing and development impact fee structure. In the future the City of Menifee will identify and put in place various processing fees to cover the reasonable cost of the services provided. The City also will identify and fund mitigation measure under CEQA through development impact fees. Such fees may include but are not limited to processing fees for the costs of providing planning services when development entitlement applications are submitted, which fees are designed to cover the full cost of such services, and development impact fees to mitigate the impact of the development proposed on public improvements. To the extent that Menifee may develop future financing districts to cover the costs of maintenance of improvements constructed by development, Developer agrees to petition for formation of, annexation to or inclusion in any such financing district and to pay the cost of such formation, annexation or inclusion. The developer acknowledges it is on notice of the current development fees and understands that such fees will apply at the levels in effect at the time the fee condition must be met as specified herein. (applicant initials) 8. Indemnification. The developer/applicant shall indemnify, protect, defend, and hold harmless, the City and County and any agency or instrumentality thereof, and/or any of its officers, employees and agents (collectively the "City and County") from any and all claims, actions, demands, and liabilities arising or alleged to arise as the result of the applicant's performance or failure to perform under this Plot Plan or the City's and County's approval thereof, or from any proceedings against or brought against the City or County, or any agency or instrumentality thereof, or any of their officers, employees and agents, to attack, set aside, void, annul, or seek monetary damages resulting from an action by the City or County, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning (PM31221). 9. Prior to Issuance of Grading Permits (Fugitive Dust Control) The project developer shall implement fugitive dust control measures in accordance with Southern California Air Quality Management District (SCAQMD) Rule 403. The project developer shall include in construction contracts the control measures required under Rule 403 at the time of development, including the following: (a) Use watering to control dust generation during demolition of structures or break- up of pavement. The construction area and vicinity (500-foot radius) must be swept (preferably with water sweepers) and watered at least twice daily. Site wetting must occur often enough to maintain a 10 percent surface soil moisture content throughout all earth moving activities. All unpaved demolition and construction areas shall be wetted at least twice daily during excavation and construction, and temporary dust covers shall be used to reduce dust emissions and meet SCAQMD District Rule 403. Wetting could reduce fugitive dust by as much as 50 percent; (b) Water active grading/excavation sites and unpaved surfaces at least three times daily; (c) All paved roads, parking and staging areas must be watered at least once every two hours of active operations; (d) Site access points must be swept/washed within thirty minutes of visible dirt deposition; (e) Sweep daily (with water sweepers) all paved parking areas and staging areas; (f) Onsite stockpiles of debris, dirt or rusty material must be covered or watered at least twice daily; (g) Cover stockpiles with tarps or apply non -toxic chemical soil binders; (h) All haul trucks hauling soil, sand, and other loose materials must either be covered or maintain two feet of freeboard; (i) All inactive disturbed surface areas must be watered on a daily basis when there is evidence of wind drive fugitive dust; 0) Install wind breaks at the windward sides of construction areas; (k) Operations on any unpaved surfaces must be suspended when winds exceed 25 mph; (1) Suspend excavation and grading activity when winds (instantaneous gusts) exceed 15 miles per hour over a 30-minute period or more, so as to prevent excessive amounts of dust; (m) All haul trucks must have a capacity of no less than twelve and three-quarter (12.75) cubic yards; (n) All loads shall be secured by trimming, watering or other appropriate means to prevent spillage and dust; (o) Traffic speeds on unpaved roads must be limited to 15 miles per hour; (p) Provide daily clean-up of mud and dirt carried onto paved streets from the site; (q) Install wheel washers for all exiting trucks, or wash off the tires or tracks of all trucks and equipment leaving the site; (r) All materials transported off -site shall be either sufficiently watered or securely covered to prevent excessive amount of dust; (s) Operations on any unpaved surfaces must be suspended during first and second stage smog alerts; and (t) An information sign shall be posted at the entrance to each construction site that identifies the permitted construction hours and provides a telephone number to call and receive information about the construction project or to report complaints regarding excessive fugitive dust generation. Any reasonable complaints shall be rectified within 24 hours of their receipt. Landscaping Conditions of Approval. Landscape Maintenance - The land divider, or any successor -in -interest to the land divider, shall be responsible for maintenance and upkeep of all slopes, landscaped areas and irrigation systems within the land division until such time as those operations are the responsibility of the individual home owners, a homeowners association, or any other successor -in -interest. 2. General Condition — Landscaping — All landscaping within the site shall be consistent with the requirements Menifee Municipal Code Chapter 15.04 "Water Efficient Landscaping." 3. Prior to Building Permit Issuance - Landscape Plans Required — Landscaping plans are required for existing properties with landscape areas of one acre or greater in size or to all new construction landscapes not installed on or after January 1, 2010, when such landscapes are homeowner -provided and or homeowner -hired in single family and multi- family projects with a total project landscape area equal to or greater than 5,000 square feet requiring a building or landscape permit, plan checks or design review and/or all other landscape projects with a landscape area equal to or greater than 2,000 square feet subject to discretionary permits, plan checks, design reviews, and/or approvals. The land divider shall file three (3) sets of a Landscaping and Irrigation Plan to the Planning Department for review and approval. Said plan shall be submitted to the Department in the form of a plot plan application pursuant to County Ordinance No. 348, Section 18.30.a.(1) (Plot Plans not subject to the California Environmental Quality Act and not subject to review by any governmental agency other than the Planning Department), along with the current fee. The plan shall be in compliance with Menifee Municipal Code Chapter 15.04 "Landscape Water Use Efficiency Requirements", the Riverside County Guide to California Landscaping and the TENTATIVE MAP conditions of approval and submitted by a landscape architect licensed by the State of California.. The plan shall address all areas and conditions of the property requiring landscaping and irrigation to be installed including, but not limited to, (slope planting and individual front yard landscaping). Landscaping plans shall incorporate the use of specimen (24" box or greater) canopy trees long streets. All trees and shrubs shall be drawn to reflect the average specimen size at 15 years of age. All trees shall be double -staked and secured with non -wire ties. Landscaping plans for areas that are totally within the road right-of-way shall be submitted for review and approval by the Transportation Department. Slope Landscaping plans for slopes exceeding 3 feet in height shall be submitted to the Planning Department for review. 4. Prior to Building Occupancy — Comply with Landscape and Irrigation Plan — Prior to issuance of a certificate of occupancy or final inspection, a regular maintenance schedule and a Certificate of Completion shall be submitted to the Community Development Director certifying that the landscaping has been completed in accordance with the approved Planting, Irrigation, Soil Management and Grading Design plans for the project. The Certificate of Completion shall be signed by a licensed landscape architect and shall provide the information provided in Menifee Municipal Code Chapter 15.04.070. Engineering Conditions Prior to Map Recordation — Improvements 2 (Amended) The cul-de-sac shall be constructed per Riverside County Standard No. 800 (A) with an asphalt pavement road section or other material to the satisfaction of the Fire Department. The cul-de-sac bulb shall be dedicated and constructed to accommodate a full turn -around per the design requirements for a 60' right-of-way. A hammerhead turn around or alternative turn around must be approved by the Fire Department. The property owner will be required to maintain the existing pavement and proposed fire turn around as a private street. All street improvements related to this map will not be accepted by the City for maintenance. 10. EVERY 001 MAP -DEFINITIONS Status: Conditions: GENERAL CONDITIONS INEFFECT Informational The words identified in the following list that appear in all capitals in the attached conditions of Tentative Parcel Map No. 31221 shall be henceforth defined as follows: TENTATIVE MAP = Tentative Parcel Map No. 31221, Amended No. 2, dated 9/09/2003. FINAL MAP = Final Map or Parcel Map for the TENTATIVE MAP whether recorded in whole or in phases. 10. EVERY 002 MAP - PROJECT Status: Conditions: GENERAL CONDITIONS DESCRIPTION INEFFECT Informational The land division hereby permitted is to subdivide 5.11 acres into two (2) parcels with a two and one-half acre minimum lot size. 10. EVERY 003 MAP - HOLD HARMLESS Status: Conditions: GENERAL CONDITIONS INEFFECT Informational The land divider or any successor -in -interest shall defend, indemnify, and hold harmless the County of Riverside COUNTY), its agents, officers, or employees from any claim, action, or proceeding against the COUNTY, its agents, officers, or employees to attack, set aside, void, or annul an approval of the COUNTY, its advisory agencies, appeal boards, or legislative body concerning the TENTATIVE MAP, which action is brought within the time period provided for in California Government Code, Section 66499.37. The COUNTY will promptly notify the land divider of any such claim, action, or proceeding against the COUNTY and will cooperate fully in the defense. (National Pollutant Discharge Elimination System) requirement to obtain a construction permit from the State Water Resource Control Board (SWRCB). The permit requirement applies to grading and construction sites of "ONE" acre or larger. The owner operator can comply by submitting a "Notice of Intent" (NOI), develop and implement a STORM WATER POLLUTION PREVENTION PLAN (SWPPP) and a monitoring program and reporting plan for the construction site. For additional information and to obtain a copy of the NPDES State Construction Permit contact the SWRCB at (916) 657-1146. Additionally, at the time the county adopts, as part of any ordinance, regulations specific to the N.P.D.E.S., this project (or subdivision) shall comply with them. 10.E HEALTH 001 MAP - SSD OK BASED Status: Conditions: GENERAL CONDITIONS ON PERC INEFFECT Informational The Department of Environmental Health will permit domestic sewage disposal for the individual lots at this sub -division as per Western soils surrvey map book, follows: For each 100 gallons of septic tank capacity, 40 sq. ft. of bottom area of leach line. THERE EXISTING RESIDENCES ON THE TWO LOTS OF THIS PARCEL MAP. NO FURTHER SOILS INFORMATION IS NECESSARY AT THIS TIME. ---------------------- 10.FIRE 001 MAP-#50-BLUE DOT Status: Conditions: GENERAL CONDITIONS REFLECTORS INEFFECT Informational Blue retroreflective pavement markers shall be mounted on private streets, public streets and driveways to indicate location of fire hydrants. Prior to installation, placement of markers must be approved by the Riverside County Fire Department. 10.FIRE 002 MAP-#13-HYDRANT Status: Conditions: GENERAL CONDITIONS SPACING INEFFECT Informational Schedule H fire protection. An approved standard fire hydrant (6"x4"x2 1/2") shall be located within 500 feet of the driveway entrance as measured along approved vehicular travelways. Minimum fire flow shall be 500 GPM for 2 hour duration at 20 PSI. 10.FLOOD RI 001 MAP FLOOD HAZARD Status: Conditions: GENERAL CONDITIONS RPT INEFFECT Informational This is a proposal to divide 5.11 acres into 2 residential lots in the Antelope Valley area. The site is located on the southside of Scott Road approximately 1000 feet east of Dailey Road. The site lies at the base of a small hill and virtually receives no tributary offsite runoff. Except for nuisance nature local runoff that may traverse portions of the property, the project is considered free from ordinary storm flood hazard. However, a storm of unusual magnitude could cause some damage. New construction should comply with all applicable ordinances. 10.PLANNING 001 MAP - MAP ACT Status: Conditions: GENERAL CONDITIONS COMPLIANCE INEFFECT Informational This land division shall comply with the State of California Subdivision Map Act and to all requirements of County Ordinance No. 460, Schedule H, unless modified by the conditions listed herein. 10.PLANNING 002 MAP -FEES FOR REVIEW Status: Conditions: GENERAL CONDITIONS INEFFECT Informational Any subsequent review/approvals required by the conditions of approval, including but not limited to grading or building plan review or review of any mitigation monitoring requirement, shall be reviewed on an hourly basis, or other appropriate fee, as listed in ounty Ordinance No. 671. Each submittal shall be accompanied with a letter clearly indicating which condition or conditions the submittal is intended to comply with. 10.PLANNING 004 MAP - LANDSCAPE Status: Conditions: GENERAL CONDITIONS MAINTENANCE INEFFECT Informational The land divider, or any successor -in -interest to the land divider, shall be responsible for maintenance and upkeep of all slopes, landscaped areas and irrigation systems within the land division until such time as those operations are the responsibility of the individual home owners, a homeowners association, or any other successor -in -interest. 10.PLANNING 008 MAP - ZONING Status: Conditions: GENERAL CONDITIONS STANDARDS INEFFECT Informational Lots created by this TENTATIVE MAP shall be in conformance with the development standards of the R-A zone. 10.PLANNING 009 MAP - 90 DAYS TO Status: Conditions: GENERAL CONDITIONS PROTEST INEFFECT Informational The project applicant has 90 days from the date of approval of these conditions to protest, in accordance with the procedures set forth in Government Code Section 66020, the imposition of any and all fees, dedications, reservations and/or other exactions imposed on this project as a result of the approval or conditional approval of this project. 10.PLANNING 010 MAP - NO OFFSITE Status: Conditions: GENERAL CONDITIONS SIGNAGE INEFFECT Informational There shall be no offsite signage associated with this land division, except as otherwise provided by Ordinance No. 679.3 (Kiosk Program). 10.PLANNING 011 MAP - OFFSITE SIGNS Status: Conditions: GENERAL CONDITIONS ORD 679.4 INEFFECT Informational No offsite subdivision signs advertising this land ivision/development are permitted, other than those allowed under Ordinance No. 679.4. Violation of this condition of approval may result in no further permits of any type being issued for this subdivision until the unpermitted signage is removed. 10.PLANNING 012 MAP - NPDES Status: Conditions: GENERAL CONDITIONS COMPLIANCE (1) INEFFECT Informational Since the project will disturb one (1) acre or more, the land divider/permit holder shall comply with all of the applicable requirements of the National Pollution Discharge Elimination System (NPDES) and shall conform to NPDES Best Management Practices for Stormwater Pollution Prevention Plans during the life of this permit. 10.PLANNING 013 MAP - ORD 810 OPN Status: Conditions: GENERAL CONDITIONS SPACE FEE INEFFECT Informational Prior to the issuance of either a certificate of occupancy or prior to building permit final inspection, the applicant shall comply with the provisions of Riverside County Ordinance No. 810, which requires payment of the appropriate fee set forth in the Ordinance. Riverside County Ordinance No. 810 has been established to set forth policies, regulations and fees related to the funding and acquisition of open space and habitat necessary to address the direct and cumulative environmental effects generated by new development projects described and defined in this Ordinance. The fee shall be paid for each residential unit to be constructed within this land division. In the event Riverside County Ordinance No. 810 is rescinded, this condition will no longer be applicable. However, should Riverside County Ordinance No. 810 be rescinded and superseded by a subsequent mitigation fee ordinance, payment of the appropriate fee set forth in that ordinance shall be required. 10.PLANNING 014 MAP - ORD NO. 659 Status: Conditions: GENERAL CONDITIONS (DIF) INEFFECT Informational Prior to the issuance of either a certificate of occupancy or prior to building permit final inspection, the applicant shall comply with the provisions of Riverside County Ordinance No. 659, which requires the payment of the appropriate fee set forth in the Ordinance.
