PC09-006Resolution No. PC09-006 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MENIFEE APPROVING EXTENSION OF TIME NO. 2009-073 FOR THE FIRST ONE-YEAR EXTENSION FOR TENTATIVE TRACT MAP NO. 32101 Whereas, on February 2, 2004, Diamond Brothers Rancon, LLC, the applicant, filed a formal planning application with the Riverside County for Environmental Assessment No. 39421, Change of Zone No. 6929 (modifying the boundaries), and Tentative Tract Map No. 32101, to subdivide approximately 69.32 gross acres into 197 single family lots at the southwest corner of Newport Road and Briggs Road; and, Whereas, on November 17, 2004, the Riverside County Planning Commission held a duly noticed public hearing on Environmental Assessment No. 39421, Change of Zone No. 6929 (modifying the boundaries) and Tentative Tract Map No. 32101, to subdivide approximately 69.32 gross acres into 197 single family lots at the southwest corner of Newport Road and Briggs and at the meeting the Riverside County Planning Commission tentatively approved Change of Zone No. 6929 and approved Tentative Tract Map No. 32101; and, Whereas, on March 29, 2005, the Riverside County Board of Supervisors held a duly noticed public hearing on Environmental Assessment No. 39421, Change of Zone No. 6929 (modifying the boundaries) and Tentative Tract Map No. 32101, to subdivide approximately 69.32, gross acres into 197 single family lots at the southwest corner of Newport Road and Briggs and at the meeting the Riverside County Board of Supervisors approved Change of Zone No. 6929 and approved Tentative Tract Map No. 32101; and Whereas, Jeff Comerchero on behalf of Diamond Brothers Rancon LLC, filed an application with Riverside County for the first one-year Extension of Time for Tentative Tract Map No. 32101 to extend the map through March 29, 2009, which application automatically extended Tract Map No. 32101 for sixty calendar days from its expiration date through May 29, 2008 (per section 66452.6(e) of the California Subdivision Map Act); and, Whereas, on July 15, 2008, California Senate Bill 1185 was signed into law, which added sections 66452.11 through 66452.13 to the Subdivision Map Act (California Government Code) by automatically extending the life of any tentative tract map, vesting tentative tract map, or tentative parcel map for one additional year, if the map approval had not expired by July 15, 2008 but would expire before January 1, 2011; and Whereas, the extension of Tentative Tract Map No. 32101 was not processed by County staff in a timely manner or in accordance with the Subdivision Map Act prior to the original expiration date of March 29, 2008 or prior to the extended expiration date of May 29, 2008 and upon transmittal of the extension of time to the City of Menifee staff, City staff contacted the applicant and the applicant agreed to the additional recommended conditions of approval and had County staff processed the extension in accordance with the applicable time frames, the expiration date would have been extended to March 29, 2009 and therefore, Tentative Tract Map No. 32101 would then fall within the parameters of SB 1185 and would automatically extended for one year, through March 29, 2010; and Whereas, on August 25, 2009, the City of Menifee Planning Commission, considered Planning Application No. 2009-073 for the first one-year extension for Tentative Tract Map No. 32101 (in compliance with Ordinance No. 460 and the Resolution PC09-006 Extension of Time 2009-073 California Subdivision Map Act, which both allow up to five one-year extensions) and considered materials in the staff report and accompanying documents; and Whereas, environmental review of the requested extension is not required, because the County of Riverside -approved Tentative Tract Map No. 32101 received approval of a Environmental Assessment No. 39421 on March 29, 2005, which analyzed and mitigated all potential environmental impacts from the development of the project and the Environmental Assessment was reviewed in light of the additional conditions (set forth in the staff report and incorporated into the attached Conditions of Approval) and it was determined that there was no need for additional environmental review. NOW, THEREFORE, the Planning Commission of the City of Menifee resolves and orders as follows: 1. The Findings set out above are true and correct. 2. Planning Application No. 2009-073 is approved, as follows: (a) The first one-year extension for Tentative Tract Map No. 32101 is approved and valid through March 29, 2009, but automatically extended by SB1185 to March 29, 2010; and (b) The Conditions of Approval set forth in Exhibit A to this resolution are approved as part of the first time extension for Tentative Tract Map No. 32101; and (c) The Conditions of Approval set forth in Exhibit A have been modified and added to for the public health, safety and welfare of the City of Menifee; and (d) The Conditions of Approval set forth in Exhibit A supersede all previous conditions of approval placed on Tentative Tract Map No, 32101 and all previous conditions of approval are rendered null and void; and (e) The Conditions of Approval set forth in Exhibit A have been agreed to by an authorized representative of Diamond Brothers Rancon LLC, as indicated by the signature at the end of the Conditions of Approval. If these facilities are replaced with "all weather crossing" that differ from what was modeled in the study, they must be designed to convey the 100 year storm flows without increasing the water surface and adversely affecting adjacent properties. This will have to be demonstrated to the District, and the appropriate changes and revisions will need to be made to the CLOMR which has already been completed. The District will need to be paid all appropriate fees for the review of these revisions to the CLOMR and the subsequent LOMR that should be done once all construction has been completed. 10.FLOOD RI 003 XXM-10 YR CURS - 100 Status: Conditions: YR ROW INEFFECT Informational The 10 year storm flow shall be contained within the curb and the 100 year storm flow shall be contained within the street right of way. This may require the construction of temporary drainage facilities or offsite construction and grading. 10.FLOOD RI 017 MAP FLOOD HAZARD Status: Conditions: REPORT INEFFECT Informational Tract Map 32101 is a proposal to subdivide 58.6 acres into 197 residential lots with a minimum lot size of 5,600 square foot and 4 open space lots in the Menifee area. The project site is located on the southwest corner of Briggs Road and the realignment of Newport Road. The site is subject to 4815-7295-0532.1 12 sheet flow from a tributary area of 11 acres from the east. The development is proposing a perimeter street (Briggs Road) and an inlet on the east side of this road to collect these flows and convey them into the onsite storm drain system. It is not clear how the sheet flows will be collected and it appears that if the assumed inlet were to become plugged with debris the storm flows would be conveyed south in Briggs Road. This would be a diversion. However, this can be addressed during final engineering without the redesign of lot configuration. The onsite storm flows for the tract would be collected in an internal storm drain system and conveyed to the storm drain system within the adjacent developments to the west (Tract Maps 25253 and 32102). This drainage system outlets flows to the District owned and maintained Salt Creek Channel. This development shall construct, or wait for the other developments to construct, a facility from the site to Salt Creek Channel. Salt Creek is considered to be an adequate outlet by the District, therefore a detention basin to mitigate the increased runoff would not be necessary. 10.FLOOD RI 018 MAP EMP - ENERGY Status: Conditions: GENERAL CONDI-_IONS DIISSEPATOR INEFFEC7 Informational Energy Dissipators, such as rip -rap, shall be installed at the outlet of a storm drain system that discharges runoff flows into a natural channel or an unmaintained facility.
