PC09-02Resolution No. 09-02
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE APPROVING
EXTENSION OF TIME NO. 2009-089 FOR THE FIRST ONE-YEAR EXTENSION FOR
TENTATIVE TRACT MAP NO. 32314
Whereas, on April 21, 2004, Wesco Homes and Development, Inc., the
applicant, filed a formal planning application with the Riverside County for Environmental
Assessment No. 39539, Change of Zone No. 6966 (to amend the Zoning Map
designation from "One -Family Dwellings — 10,000 sq. ft. minimum - R-1-10,000" to "One -
Family Dwellings — R-1"), and Tentative Tract Map No. 32314, to develop approximately
9.7 gross acres at the southwest corner of Murrieta Road and Thornton Avenue with
approximately 33 single-family detached homes with a minimum lot size of 7,200 square
feet; and,
Whereas, on December 15, 2004, the Riverside County Planning Commission
held a duly noticed public hearing on Environmental Assessment No. 39539, Change of
Zone No. 6966(to amend the Zoning Map designation from "One -Family Dwellings —
10,000 sq. ft. minimum - R-1-10,000" to "One -Family Dwellings — R-1"), and Tentative
Tract Map No. 32314, to develop approximately 9.7 gross acres at the southwest corner
of Murrieta Road and Thornton Avenue with approximately 33 single-family detached
homes with a minimum lot size of 7,200 square feet and at the meeting the Riverside
County Planning Commission tentatively approved Change of Zone No. 6966 and
approved Tentative Tract Map No. 32314; and,
Whereas, on February 8, 2005, the Riverside County Board of Supervisors held
a duly noticed public hearing on Environmental Assessment No. 39539, Change of Zone
No. 6966(to amend the Zoning Map designation from "One -Family Dwellings — 10,000
sq. ft. minimum - R-1-10,000" to "One -Family Dwellings — R-1"), and Tentative Tract Map
No. 32314, to develop approximately 9.7 gross acres at the southwest corner of Murrieta
Road and Thornton Avenue with approximately 33 single-family detached homes with a
minimum lot size of 7,200 square feet and at that meeting the Riverside County Board of
Supervisors approved Tentative Tract Map No. 32314 and introduced an ordinance that
approved Change of Zone 6966; and,
Whereas, on May 10, 2005, the Riverside County Board of Supervisors, as part
of the Policy Calendar approved Change of Zone No. 6966 to amend the Zoning Map
designation from "One -Family Dwellings — 10,000 sq. ft. minimum - R-1-10,000" to "One -
Family Dwellings — R-1 "); and,
Whereas, on January 22, 2008, Dorian Johnson on behalf of Wesco Homes and
Development, Inc, filed an application with Riverside County for the first one-year
Extension of Time for Tentative Tract Map No. 32314 to extend the map through
February 8, 2009, which application automatically extended Tract Map No. 32314 for
sixty calendar days from its expiration date through April 9, 2008 (per section 66452.6(e)
of the California Subdivision Map Act); and,
Whereas, on July 15, 2008, California Senate Bill 1185 was signed into law,
which added sections 66452.11 through 66452.13 to the Subdivision Map Act (California
Government Code) by automatically extending the life of any tentative tract map, vesting
tentative tract map, or tentative parcel map for one additional year, if the map approval
had not expired by July 15, 2008 but would expire before January 1, 2011; and
Planning Commission Resolution PC09-02
Wesco Tract Map 32314 — Extension of time 2009-089
Whereas, the extension of Tentative Tract Map No. 32314 was not processed
by County staff in a timely manner or in accordance with the Subdivision Map Act prior to
the original expiration date of February 8, 2008 or prior to the extended expiration date
of April 9, 2009 and upon transmittal of the extension of time to the City of Menifee staff,
City staff contacted the applicant and the applicant agreed to the additional
recommended conditions of approval and had County staff processed the extension in
accordance with the applicable time frames, the expiration date would have been
extended to April 9, 2009 and therefore, Tentative Tract Map No. 32314 would then fall
within the parameters of SIB 1185 and would automatically extended for one year,
through April 9, 2010; and
Whereas, on August 11, 2009, the City of Menifee Planning Commission, as part
of their Consent Calendar, considered Planning Application No. 2009-089 for the first
one-year extension for Tentative Tract Map No. 32314 (in compliance with Ordinance
No. 460 and the California Subdivision Map Act, which both allow up to five one-year
extensions) and considered materials in the staff report and accompanying documents;
and
Whereas, environmental review of the requested extension is not required,
because the County of Riverside -approved Tentative Tract Map No. 32314 received
approval of a Environmental Assessment No. 39539 on February 8, 2005, which
analyzed and mitigated all potential environmental impacts from the development of the
project and the Environmental Assessment was reviewed in light of the additional
conditions (set forth in the staff report and incorporated into the attached Conditions of
Approval) and it was determined that there was no need for additional environmental
review.
NOW, THEREFORE, the Planning Commission of the City of Menifee resolves
and orders as follows:
1. The Findings set out above are true and correct.
2. Planning Application No. 2009-089 is approved, as follows:
(a) The first one-year extension for Tentative Tract Map No. 32314 is approved and
valid through April 9, 2009, but automatically extended by S131185 to April 9,
2010; and
(b) The Conditions of Approval set forth in Exhibit A to this resolution are approved
as part of the first time extension for Tentative Tract Map No. 32314; and
(c) The Conditions of Approval set forth in Exhibit A have been modified and added
to for the public health, safety and welfare of the City of Menifee; and
(d) The Conditions of Approval set forth in Exhibit A supersede all previous
conditions of approval placed on Tentative Tract Map No, 32314 and all previous
conditions of approval are rendered null and void; and
(e) The Conditions of Approval set forth in Exhibit A have been agreed to by an
authorized representative of Wesco Homes and Development, Inc., as indicated
by the signature at the end of the Conditions of Approval .

REPORT INEFFECT Informational
Tentative Tract 32314 is a proposal to subdivide 9.7 acres into 35
residential lots in the Sun City area. The project site is located on the north
side of Esther Lane approximately 700 westerly of Murrieta Road. The
property is impacted by offsite flows that outlet from an existing 51" storm
drain on the western boundary of the site. This facility was constructed as
part of the drainage improvements for the adjacent Tract 22483 and
conveys runoff from a watershed of about 86 acres. The developer proposes
to construct an underground storm drain to connect to the existing 51"
storm drain. This proposed underground facility would convey the flows to
another proposed facility at the corner of Esther Lane and Murrieta Road.
The proposal of this drainage scheme is dependent upon the development
to the east (Tract Map 30507) to construct the infrastructure necessary to

accept the flows from this tract's proposed storm drain. If the developer
wishes to proceed with this project before Tract Map 30507 installs their
proposed facilities, then this development shall be redesigned to construct
the necessary flood control improvements to convey storm flows into the
District's Line G-G. The onsite storm runoff for the development would be
collected and conveyed into Sun City Line G-G Channel with a proposed
underground drainage facility. Sun City Line G-G is considered to be an
adequate outlet therefore a separate means of mitigating for increased
runoff would not be required by the District. The tentative map depicts a
filtration basin system at the southeast corner of the tract. This
acknowledgement should be sufficient to allow the Planning Department to
make the finding in the Environmental Assessment that water quality
mitigation is addressed.
