and, Whereas, on December 15, 2004, the Riverside County Planning Commission held a duly noticed public hearing on Environmental Assessment No. 39539, Change of Zone No. 6966(to amend the Zoning Map designation from "One -Family Dwellings — 10,000 sq. ft. minimum - R-1-10,000" to "One -Family Dwellings — R-1"), and Tentative Tract Map No. 32314, to develop approximately 9.7 gross acres at the southwest corner of Murrieta Road and Thornton Avenue with approximately 33 single-family detached homes with a minimum lot size of 7,200 square feet and at the meeting the Riverside County Planning Commission tentatively approved Change of Zone No. 6966 and approved Tentative Tract Map No. 32314; and, Whereas, on February 8, 2005, the Riverside County Board of Supervisors held a duly noticed public hearing on Environmental Assessment No. 39539, Change of Zone No. 6966(to amend the Zoning Map designation from "One -Family Dwellings — 10,000 sq. ft. minimum - R-1-10,000" to "One -Family Dwellings — R-1"), and Tentative Tract Map No. 32314, to develop approximately 9.7 gross acres at the southwest corner of Murrieta Road and Thornton Avenue with approximately 33 single-family detached homes with a minimum lot size of 7,200 square feet and at that meeting the Riverside County Board of Supervisors approved Tentative Tract Map No. 32314 and introduced an ordinance that approved Change of Zone 6966; and, Whereas, on May 10, 2005, the Riverside County Board of Supervisors, as part of the Policy Calendar approved Change of Zone No. 6966 to amend the Zoning Map designation from "One -Family Dwellings — 10,000 sq. ft. minimum - R-1-10,000" to "One - Family Dwellings — R-1 "); and, Whereas, on January 22, 2008, Dorian Johnson on behalf of Wesco Homes and Development, Inc, filed an application with Riverside County for the first one-year Extension of Time for Tentative Tract Map No. 32314 to extend the map through February 8, 2009, which application automatically extended Tract Map No. 32314 for sixty calendar days from its expiration date through April 9, 2008 (per section 66452.6(e) of the California Subdivision Map Act); and, Whereas, on July 15, 2008, California Senate Bill 1185 was signed into law, which added sections 66452.11 through 66452.13 to the Subdivision Map Act (California Government Code) by automatically extending the life of any tentative tract map, vesting tentative tract map, or tentative parcel map for one additional year, if the map approval had not expired by July 15, 2008 but would expire before January 1, 2011; and Planning Commission Resolution PC09-02 Wesco Tract Map 32314 — Extension of time 2009-089 Whereas, the extension of Tentative Tract Map No. 32314 was not processed by County staff in a timely manner or in accordance with the Subdivision Map Act prior to the original expiration date of February 8, 2008 or prior to the extended expiration date of April 9, 2009 and upon transmittal of the extension of time to the City of Menifee staff, City staff contacted the applicant and the applicant agreed to the additional recommended conditions of approval and had County staff processed the extension in accordance with the applicable time frames, the expiration date would have been extended to April 9, 2009 and therefore, Tentative Tract Map No. 32314 would then fall within the parameters of SIB 1185 and would automatically extended for one year, through April 9, 2010; and Whereas, on August 11, 2009, the City of Menifee Planning Commission, as part of their Consent Calendar, considered Planning Application No. 2009-089 for the first one-year extension for Tentative Tract Map No. 32314 (in compliance with Ordinance No. 460 and the California Subdivision Map Act, which both allow up to five one-year extensions) and considered materials in the staff report and accompanying documents; and Whereas, environmental review of the requested extension is not required, because the County of Riverside -approved Tentative Tract Map No. 32314 received approval of a Environmental Assessment No. 39539 on February 8, 2005, which analyzed and mitigated all potential environmental impacts from the development of the project and the Environmental Assessment was reviewed in light of the additional conditions (set forth in the staff report and incorporated into the attached Conditions of Approval) and it was determined that there was no need for additional environmental review. The developer proposes to construct an underground storm drain to connect to the existing 51" storm drain.
