Pursuant to the power of termination as set forth in Section 885.010 of the California Civil Code, Grantor, and its successors and assigns, shall have the right, at its election, to reenter and take possession of the Property, with all improvements thereon, and terminate and revest in Grantor the Property if Grantee or its successors and assigns shall: Use the Property for any use other than civic facilities; or 2. Develop the Property with improvements containing more than sixty thousand (60,000) square feet of building area, unless the City of Menifee, at its sole cost and expense, amends the applicable specific plan to allow for additional square footage of building area in accordance with all legal requirements, including the California Environmental Quality Act, and Grantee shall be solely responsible for complying with any revised or new mitigation measures resulting from such specific plan amendment. The foregoing restriction of 60,000 square feet shall terminate on January 1, 2035.
