THIS DECLARATION TERMINATING COVENANT AND AGREEMENT TO
HOLD PROPERTY AS SINGLE PARCEL FOR AUDIE MURPHY RANCH
("Terminating Declaration") is made by RICHMOND AMERICAN HOMES OF
MARYLAND, INC., a Maryland corporation ("Declarant").
PREAMBLE:
A. Declarant recorded that certain Covenant and Agreement to Hold Property as
Single Parcel on February 7, 2014 as Document No. 2014-0052703 of Official Records of
Riverside County, California (the "Covenant') against the following real property (collectively,
the "Property") in the City of Menifee, County of Riverside, California, described as follows:
Lots 97 and 103 of Tract No. 31390-2 as shown on a map
Recorded in Book 436 at Pages 55 to 60, inclusive, of Maps, in the
Office of the Riverside County Recorder.
B. The Covenant imposed on the Property an obligation to hold the two parcels
comprising the Property as a single parcel.
C. The Covenant provides that it may be terminated when released by the City of
Menifee ("City") upon submittal of a request by the owner of the Property, together with
applicable fees and evidence that the Covenant is no longer required.
D. Declarant has agreed that Lot 103 of Tract No. 31390-2 will be maintained by
City of Menifee CFD No. 2012-1 (Audie Murphy Ranch) and owned in fee by the Audie
Murphy Ranch Community Association, which is the homeowners association established to
govern the Audie Murphy ,Ranch master -planned community of which the Property is a portion.
Therefore, the Covenant is no longer necessary.
E. Declarant, as the sole owner of the Property, desires to terminate the Covenant in
its entirety so that it no longer encumbers the Property, and the City has agreed to release the
Covenant.
NOW, THEREFORE, Declarant hereby declares as follows:
1. Termination of Covenant. Effective upon recordation of this Terminating
Declaration, this Covenant is terminated, revoked and of no further force or effect.
2. Release by City. By signing below, the City hereby releases the Covenant as to
the Property.

3. Counterparts. This Terminating Declaration may be executed in counterpart,
each of which shall be an original, and which when taken together shall constitute one
instrument.
This Terminating Declaration has been executed on 2015, to be
effective as of the date of its recordation.
