11-236 RESOLUTION NO. 2011-236 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, REQUESTING THE RIVERSIDE LOCAL AGENCY FORMATION COMMISSION TO INITIATE PROCEEDINGS FOR REORGANIZATION (LOCATED IN THE VICINITY OF GOETZ/RAILROAD CANYON/NEWORT ROADS) TO INCLUDE DETACHMENTS FROM THE CITY OF CANYON LAKE AND CONCURRENT ANNEXATIONS TO THE CITY OF MENIFEE WHEREAS, the City Council of the City of Menifee desires to initiate proceedings pursuant to the Cortese-Knox Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code, for the reorganization of certain property identified in Attachments 1 and 2 and incorporated here in this reference; and WHEREAS, the territory proposed for sphere amendments and for reorganization of boundaries is uninhabited pursuant to the definition contained within Government Code Section 56046, and the proposed property is identified in Attachments 1 and 2 attached hereto and by this reference incorporated herein; and WHEREAS, the City Council finds that the proposed sphere amendments and boundary reorganization will facilitate carrying out its responsibility for future planning and the logical and orderly development of the City; and WHEREAS, discussions have ensured with the City of Canyon Lake staff, and City of Canyon Lake would present a companion resolution requesting the initiation of proceedings; and WHEREAS, the reason for the proposed sphere amendments and reorganization are as follows: 1. The annexation to Menifee and detachment from Canyon Lake in Attachment 1 would modify the boundaries of the two cities to place the ultimate rights-of-way of Newport and Goetz Roads entirely within one municipal jurisdiction. WHEREAS, the City Council finds that the proposed boundary reorganization would be exempt under Section 15061 (b) (3) of the California Environmental Quality Act Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the Riverside County Local Agency Formation Commission ("LAFCO") is hereby requested to take proceedings pursuant to the Cortese-Knox Hertzberg Local Government Reorganization Act of 2000 for the areas shown in the attached maps (Attachments 1 and 2). SECTION 2. The City Clerk is authorized and directed to file a certified copy of this Resolution with the Executive Officer of LAFCO together with such other information and documents as may be required by the Executive Officer.
