A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA,
REQUESTING THAT THE STATE OF CALIFORINA OFFICE OF PLANNING AND
RESEARCH GRANT A ONE YEAR EXTENSION OF TIME FOR THE COMPLETION
AND THE ADOPTION OF THE CITY'S GENERAL PLAN
Whereas, Section 65301 of the California Government Code requires the
legislative body of a newly incorporated city to adopt a general plan within 30 months
following incorporation; and,
Whereas, Section 65361 of the California Government Code authorizes the
Director of the Office of Planning and Research (OPR) to grant an extension of this 30
months deadline for newly incorporated cities; and,
Whereas, the City of Menifee incorporated on October 1, 2008; and,
Whereas, the City Council determined to prepare a General Plan consisting of
the seven mandatory Elements (i.e., Land Use, Conservation, Open Space, Circulation,
Noise, Safety, and Housing) and two optional Elements (Economic Development and
Community Design; and
Whereas, on September 28, 2009, the City of Menifee entered into an
Agreement with The Planning Center, and various sub consultants such as Urban
Crossroads (traffic and noise specialists), Dudek (biology specialists), Earth Consultants
International (geology specialists) and Discovery Works, Inc (archaeology specialists), to
assist the City with preparation of the General Plan) and related Environmental Impact
Report for the amount of$1,050,276.00; and,
Whereas, the City Council determined a process for and appointed a General
Plan Advisory Committee; and,
Whereas, the City conducted four (4) public workshops within the Community to
involve the community and develop the vision and values; and,
Whereas, a workshop was held with the Planning Commission on the land use
map; and,
Whereas, Consultants, the City General Plan Advisory Committee, City Staff,
Planning Commission, the City Council and interested citizens have worked diligently to
prepare a General Plan; and,
Whereas, due to the nature of complexity of the land use involved, the General
Plan Advisory Committee has held eighteen (18) meetings; however, only ten (10)
General Plan Advisory Committee meetings had been contemplated by the City's
schedule for preparation of the General Plan and additional meetings are requested;
and,
Whereas, as set out in Govt. Code Section 65361(a)(4), local review procedures
have resulted in delaying a decision on the General Plan by the Planning Commission
and City Council within the thirty months period prescribed by the California Government
Code; and,
Whereas, as set out in Government Code Section 65361(a)(6) other reasons
which support a request for an extension include the delay in obtaining a Regional

Housing Needs Assessment number mid-cycle, additional time needed to prepare a
Climate Action Plan as a component of the general plan and addressing AB32 and
SB375; and,
Whereas, attached to this Resolution as Exhibit A are a detailed budget and
schedule for preparation and adoption of the general plan, including plans for citizen
participation and expected interim action, which provides for adoption within the one
year extension period; and,
Whereas, attached to this Resolution as Exhibit B are a set of proposed
policies and procedures which would ensure during the extension of time granted
pursuant to this section, that the land use proposed in an application for a subdivision,
rezoning, use permit, variance, or building permit will be consistent with the general plan
proposal being considered or studied; and
Whereas, this request for extension and any extension granted are exempt from
CEQA pursuant to Government Code Section 65361(g); and
Whereas, the City Council of the City of Menifee conducted a noticed public
hearing to consider a request for an extension of time from the Office of Planning and
Research (OPR) to complete the preparation of the General Plan; and,
Whereas, no person spoke in opposition to the proposed extension at the City
Council's public hearing conducted on March 1, 2011; and,
Now, therefore, the City Council of the City of Menifee resolves and orders as
follows:
1. The findings set out above are true and correct.
2. The City Council has determined that an extension of time is necessary to
complete all elements of the General Plan, including but not limited to the
housing element.
3. The Community Development Director and/or her designee are directed to
submit an application to the State of California Office of Planning and
Research for a one year extension of time for completion of the City's
General Plan.
