09-109 RESOLUTION NO. 09-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE ADOPTING COUNCILMANIC DISTRICTS FOR THE 2010 GENERAL MUNICIPAL ELECTION WHEREAS, the City of Menifee incorporated on October 1, 2008; and WHEREAS, at the time of incorporation, the voters elected five at-large City council members and determined that future council members would be chosen by district at the first regular municipal election; and WHEREAS, the City Council has set the first regular municipal election for November, 2010; and WHEREAS, Govt. Code Section 34884 requires that before the first day on which candidates may run for City Council in that election (i.e. by June, 2010), the City Council must establish the boundaries of the five councilmanic districts; and WHEREAS, that section also sets the criteria for such districts, which are that the districts must be as nearly equally in population as follows and also may be based upon topography, geography, cohesiveness, contiguity, integrity and compactness (collectively "compactness") as well as communities of interest; WHEREAS, the City Council has utilized the services of National Demographic Consultants (NDC)to provide the City Council with the information to adopt such districts; and WHEREAS, NDC has obtained current population and other data in order to draw such districts according to the statutorily required criteria described as"equal population, Federal Voting Rights Act' and other traditional criteria of"communities of interest, visible (natural and person-made) boundaries, compactness and contiguity and contiguity in office; and NDC made an initial presentation to the Council on June 16, 2009, and has conducted three advertised public workshops on the boundaries for districts on June 25, June 27 and June 30; and NDC also developed and provided "participation kits"to assist the public in drawing possible district boundaries; and NDC and the City received 30 separate possible plans for the five districts; and NDC also has made a presentation to the Council evaluating such plans according to the required criteria in order to assist the as to population; and The Council has reviewed the balancing of the required population criteria with a 3%to 6.5% deviation, contiguity by non-census geography of community, compactness and incumbent pairings and has reviewed the summary of the ten good plans; and The Council has chosen NDC Plan No. 4 and has directed NDC to prepare street by street boundaries for adoption; and This action is exempt from CEQA review pursuant to Section 15061(b) (3) of the Guidelines because there is no possibility that it will have a significant effect on the physical environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE DOES RESOLVE AND ORDER AS FOLLOWS: Resolution 09-109 District Boundaries 1. The findings set out above are true and correct. 2. Pursuant to the requirements of Govt. Code Section 34884 and state and federal law, the City Council hereby adopts the five councilmanic districts set out on NDC 4 plan, attached and incorporated as Exhibit A, with the specific street by street boundaries set out on Exhibit B.
