2018-255 Commercial Vehicle Parking ORDINANCE NO. 2018-255 AN ORDINANCE OF THE CITY OF MENIFEE AMENDING 12.20.140 OF THE MENIFEE MUNICIPAL CODE TO REGULATE COMMERCIAL VEHICLE PARKING WHEREAS, in accordance with California Vehicle Code Section 22507.5, local municipalities may, by ordinance or resolution, prohibit or restrict the parking or standing, on any street, or portion thereof, in a residential district, of commercial vehicles having a manufacturer's gross vehicle weight rating of 10,000 pounds or more; and WHEREAS, in accordance with California Vehicle Code Section 22507.5c, local municipalities, for purposes of implementing commercial vehicle parking restrictions in residential districts, may, by ordinance, define the term "residential district" in accordance with its zoning ordinance; and WHEREAS, this ordinance is not effective unless the legislative body of the local authority holds a public hearing on the proposed ordinance prior to its adoption, with notice of the public hearing given in accordance with Section 65090 of the Government Code; and WHEREAS, the City Council now desires to amend Section 12.20.140 of the City of Menifee Municipal Code to define the term "residential district" in accordance with its zoning ordinance and to regulate commercial vehicle parking on undeveloped private property. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 12.20.140 "Commercial Vehicles" of Chapter 12.20 "Vehicle Parking" of Title 12 "Vehicles and Traffic" of the Menifee Municipal Code is hereby amended to read as follows (deletions are shown in stFike- through, and additions shown in red with double-underlining): § 12.20.140 COMMERCIAL VEHICLES. (A) No person shall park or leave standing a commercial vehicle having a manufacturer's gross vehicle weight rating of more than 10,000 pounds, or any commercial trailer or semi-trailer regardless of weight, on any street or highway within a residential district or on any undeveloped private property. UB As used in this section "residential district street, highway, or right of way" means the full width of a public street. hiahway. or right-of- way which is located within, or adjacent to, a residential zone as defined in County of Riverside Ordinance No 348 ( ) Cn The City Engineer or his or her designee shall post signs to give notice of the parking restrictions contained in this section at major entry points into the city. (-G)fD This section shall not apply under the following conditions: (1) Any commercial vehicle making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted streets or highways or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted streets or highways for which a building permit has previously been obtained; (2) Any vehicle parked in connection with, and in the aid of, the performance of a service to or on a property in the block in which such vehicle is parked; (3) Any school or passenger bus under the jurisdiction of the Public Utilities Commission; (4) Any vehicle owned by a city, county, state, public entity or licensed contractor engaged in the installation, maintenance, or repair of any public property, utility or highway; (5) Any authorized emergency vehicle as defined by the California Vehicle Code. SECTION 2. This ordinance was introduced on November 7, 2018, and a second reading occurred on December 5, 2018. SECTION 3. The ordinance will be effective 30 days from the date of its adoption.
