AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE,
CALIFORNIA, AMENDING SECTION 9.28.090 "PERMITTED,
CONDITIONALLY PERMITTED, ADMINISTRATIVE DESIGN REVIEWS AND
PROHIBITED USES" OF CHAPTER 9.28 "ECONOMIC DEVELOPMENT
CORRIDOR ZONING DISTRICTS" OF TITLE 9 "PLANNING AND ZONING" OF
THE MENIFEE MUNICIPAL CODE
WHEREAS, upon its incorporation, the City of Menifee ("City") adopted Riverside County
Land Use Ordinance No 348 ("Ordinance No. 348") as the applicable land use code for the City,
pending completion of the City's own General Plan and Zoning Code; and
WHEREAS, Ordinance No. 348 provided for the location of commercial facilities for the
storage of recreational vehicles, including but not limited to boats and recreational vehicles within
various zoning classifications; and
WHEREAS, On June 2, 2009, the City Council approved Conditional Use Permit 3286
Revised Permit No. 2 ("CUP 3286") for the development of the fourth and final phase of the
Champion Self Storage facility, which was to be adjacent to Salt Creek, near the northwest corner
of Berea Rd. and Normandy Rd.; and
WHEREAS, the fourth phase of the Champion Self Storage facility covers approximately
2.29 gross acres, upon which, among other things, the outdoor storage of recreational vehicles is
contemplated; and
WHEREAS, concurrent with the approval of CUP 3286, the property on which the
Champion Self Storage facility is located was rezoned from Single Family Residential (R-1) to
General Commercial (C-1/C-P); and
WHEREAS, following its incorporation, the City came to understand that there had been
a number of recreational vehicle storage facilities permitted without an adequate assessment of
the level of need for such facilities; and
WHEREAS, following its incorporation, the City also came to understand that there were
a number of unpermitted uses reported where property owners had allowed the commercial
storage of recreational vehicles without any permit or appropriate site preparation; and
WHEREAS, on June 16, 2009, through the adoption of Ordinance 2009-48U, the City
adopted a short-term moratorium against the granting of any plot plan or conditional use permit
for any commercial recreational vehicle storage otherwise allowed in Ordinance No. 348;the initial
moratorium period was 45 days; and
WHEREAS, the moratorium against the granting of any plot plan or CUP for any
commercial recreational vehicle storage facility was extended for an additional 10 months and 15
days on June 21, 2009, then extended again for an additional one year on June 15, 2010; and
WHEREAS, on June 21, 2011, the City further extended the ban on the commercial
recreational vehicle storage until such time as a General Plan and thereafter the Zoning Code
was completed and such Zoning Code identified an area of the City in which such facilities
properly can be located from a land use perspective; and
WHEREAS, the property that was the subject of CUP 3286, and potentially other
properties, were subject to the moratoria and extensions referenced in the preceding three
paragraphs (collectively, the "Moratoria"); and
WHEREAS, on November 8, 2015, the City adopted Ordinance 2015-180 establishing a
series of new Economic Development Corridor zoning districts, including the Economic
Development Corridor-Newport Road ("EDC-NR") zoning district, and setting standards for
development in those districts; and
WHEREAS, the property that was the subject of CUP 3286 was, through the adoption of
Ordinance 2015-180, rezoned to be included in the EDC-NR zoning district; and
WHEREAS, as a general proposition, outdoor storage (including vehicle storage) is
allowed in the EDC-NR zone, subject to specific standards, as set forth in Menifee Municipal Code
("MMC') section 9.28.190, however, RV storage facilities must be within an enclosed building
pursuant to MMC section 9.28.090, Table 9.28-A.
WHEREAS, the City initiated Code Amendment DCA 2017-182 to amend the MMC to
allow the approval of the second or later phase of a multi-phase project that includes outdoor
recreational vehicle storage in the EDC-NR zoning district, for which an approval was granted
prior to November 18, 2015 (the "Ordinance") ; and
WHEREAS, on June 28, 2017, the Planning Commission held a duly advertised public
hearing on the Ordinance, opened the hearing to receive public testimony, and reviewed all
written public comments, staff report materials and accompanying documents related to the
Ordinance and considered the requirements of the California Environmental Quality Act (CEQA)
(Public Resources Code Section 21000 et. seq.) with regard to the possible impacts that the
Ordinance may have upon the environment; and
WHEREAS, at the June 28, 2017 Planning Commission public hearing, based upon all
materials and testimony considered, the Planning Commission adopted a resolution
recommending that the City Council find the Ordinance exempt from environmental review under
the California Environmental Quality Act and adopt the Ordinance; and
WHEREAS, on August 2, 2017, the City Council held a duly noticed public hearing
concerning the Ordinance, introduced and conducted a first reading of the Ordinance, and
considered testimony and evidence at the Public Hearing held with respect thereto; and
WHEREAS, on August 16, 2017, the City Council conducted a second reading of the
Ordinance; and
WHEREAS, the City Council has considered the requirements of CEQA; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE DOES ORDAIN
AS FOLLOWS:
SECTION 1. That the City Council find, for the reasons detailed upon that Notice of
Exemption, that the Ordinance is exempt from further environmental review and authorize staff
to sign and forward a Notice of Exemption.
SECTION 2. The City Council hereby finds that the Ordinance is consistent with the
City's General Plan, including the following Goals and Policies of the City's General Plan:
Goal LU-1: Land uses and building types that result in a community where residents at all
stages of life, employers, workers, and visitors have a diversity of options of where they
can live, work, shop, and recreate within Menifee.
Policy LU-1.9: Allow for flexible development standards provided that the potential
benefits and merit of projects can be balanced with potential impacts.
Goal LU-2: Thriving Economic Development Corridors that accommodate a mix of
nonresidential and residential uses that generate activity and economic vitality in the City.
Policy LU-2.1: Promote infill development that complements existing neighborhoods and
surrounding areas. Infill development and future growth in Menifee is strongly encouraged
to locate within EDC areas to preserve the rural character of rural, estate, and small estate
residential uses.
Goal ED-1: A diverse and robust local economy capable of providing employment for all
residents desiring to work in the city.
Policy ED-1.2: Diversify the local economy and create a balance of employment
opportunities across skill and education levels, wages and salaries, and industries and
occupations.
SECTION 3. The City Council of the City of Menifee finds that the Ordinance is consistent
with the requirements of the City of Menifee Municipal Code regarding the process of amending
the Municipal Code.
SECTION 4. The City Council of the City of Menifee hereby amends Chapter 9.28
"Economic Development Corridor Zoning Districts" of the MMC by amending Section 9.28.090
"Permitted, Conditionally Permitted, Administrative Design Reviews and Prohibited Uses"to read
as follows (deletions are shown in S+ket,hFe6igI4, and additions shown in double-underlining):
(A) Permitted, conditionally permitted or administrative design review
approvals for the Economic Development Corridor zoning districts are
provided in Table 9.28-A"Permitted and Conditional Uses". A use listed as
a "permitted use" is a land use activity permitted by right in the area
designated within the Table. Such use may be established within an
existing structure without city land use review (but may be subject to city
business license requirements). If no structure exists upon a property
where a "permitted use" is proposed, that structure shall be subject to an
administrative design review by the Director. Similarly, uses listed as
allowed under an "administrative design review" or"conditional use permit"
review shall be subject to review for both the land use activity and the
structure in which that activity shall be conducted. These approvals have
been determined to be compatible with the values, character and intensity
of anticipated uses described in the General Plan. A use identified in the
table that is referenced by ars hyphen "2 asteFiskr-(") is expressly
prohibited: provided. however, that notwithstanding anything to the
contrary in this Chapter 9.28. applications or approvals for the second or
later phase of a multi-phase project that includes outdoor recreational
vehicle storage in the Economic Development Corridor-Newport Road
zoning district, for which an approval was granted prior to November 18.
2015 by way of conditional use permit or plot plan, shall be permitted
subject to all requirements imposed through the conditional use permit
and/or plot plan approval processl.
(B) Uses not listed are dependent upon both the compatibility of the use
with the purpose and function of the district, and the anticipated impacts,
including, but not limited to, aesthetics, generation of traffic, types of traffic,
parking requirements, hazards, and light and/or noise generation. The
Director, pursuant to Chapter 9.03"Rules and Interpretation", may approve
or conditionally approve a non-listed activity found to be compatible with
other uses permitted within the district and which is of the same character
and intensity as other uses permitted within the district.
(C) The establishment of permitted uses, for either new construction or an
activity within an existing facility, may be subject to review and approval
pursuant to Chapter 9.38 "Administrative Design Review". The
establishment of conditional uses, for either new construction or an activity
within an existing facility, is subject to review and approval pursuant to
Chapter 9.50 "Conditional Use Permits". All temporary uses are subject to
review and approval pursuant to Chapter 9.48 "Temporary Uses".
(D) Projects and land uses approved under discretionary review shall not
initiate, commence or conduct such activity until all applicable conditions of
approval are addressed and met. Violation of this section constitutes
grounds for revocation of the permit.
(E) Residential uses shall not exceed 15% of the total Economic
Development Corridor acreage. Residential developments are allowed as
"stand alone" projects but not allowed on EDC parcels directly adjacent to
the freeway. New residential development in the Economic Development
Corridor Zoning Districts are required to include a commercial, office or
institutional component and/or enter into an agreement with the city for the
development of a commercial, office or institutional facility on another
property within the same Economic Development Corridor Zoning District
and within a specified time period.
(F) Land use identifies the primary activity occurring on a parcel of land
and/or within a defined area (such as a suite within a structure). Accessory
uses directly related to the primary activity comprising an incidental (10%
or less) portion of the floor area and/or total gross sales shall be allowed
as an ancillary use to the primary use.
SECTION 5, The City Council of the City of Menifee hereby amends Chapter 9.28
"Economic Development Corridor Zoning Districts" of the MMC by amending Table 9.28-A
"Permitted and Conditional Uses" to read as follows (deletions are shown in strike thFeugh, and

SECTION 6. Notice of Adoption. The City Clerk shall certify to the passage and adoption
of this Ordinance, and shall cause the same to be published within fifteen (15) days after passage
in accordance with law, and shall cause this Ordinance and its certification, together with proof of
publication, to be entered in the Book of Ordinances of the City of Menifee.
SECTION 7. Effective Date. This Ordinance shall take effect and be in full force and
operation thirty (30) days after its adoption.
SECTION 8. Severability. If any section, subsection, subdivision, sentence, clause,
phrase, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance.The City Council hereby declares that it would have adopted
this Ordinance, and each section, subsection subdivision, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
This Ordinance was introduced and ready by title on August 2, 2017 and PASSED, APPROVED AND
ADOPTED THIS 16th DAY OF AUGUST, 2017.
