2017-216 Speed limits of certain Street SEGMENTS ORDINANCE NO. 2017-216 AN ORDINANCE OF THE CITY OF MENIFEE AMENDING 12.04.010 OF THE MENIFEE MUNICIPAL CODE TO UPDATE THE PRIMA FACIE SPEED LIMITS ON CERTAIN STREET SEGMENTS IN THE CITY OF MENIFEE WHEREAS, in accordance with California Vehicle Code Sections 22357 and 22358, local municipalities have the power to increase or decrease prima facie speed limits for local streets; and WHEREAS, in accordance with California Vehicle Code Section 40802 and provisions of the California Manual on Uniform Traffic Control Devices (MUTCD), Engineering and Traffic Surveys must be performed on those local streets every five (5) or seven (7), or ten (10) years when the use of radar or other electronic devices which measure the speed of moving objects are utilized to enforce the prima facie speed limits for those streets; and WHEREAS, the City's police officers use a radar, laser, or other electronic device on certain street segments in the City to measure the speed of vehicles and to enforce prima facie speed limits; and WHEREAS, all City radar, laser, and other electronic devices used to measure the speed of a vehicle meet the minimal operational standards of the National Traffic Safety Administration, and are calibrated at minimum every three years by an independent certified laser or radar repair and testing or calibration facility; and WHEREAS, the City's police officers have successfully completed a radar operator course approved and certified by the Commission on Police Officers Standards and Training, of not less than twenty four (24) hours on the use of police traffic radar; and WHEREAS, the City conducted an Engineering and Traffic Survey in 2017 which recommended speed limits for certain street segments as set forth in Exhibit "A" attached hereto; and WHEREAS, the results of the Engineering and Traffic Survey conform to the requirements of the California Vehicle Code; and WHEREAS, the City Council now desires to amend Section 12.04.010 of the City of Menifee Municipal Code to adopt the prima facie speed limits for certain street segments as recommended in the 2017 Engineering and Traffic Survey; and City of Menifee Page 2 of 7 WHEREAS, City staff has concluded those speed limits set forth in Exhibit "A" attached hereto are justified for their associated street segments in accordance with California Vehicle Code Sections 22357 and 22358 in that they are most appropriate to facilitate the orderly movement of vehicular traffic and are reasonable and safe for those street segments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 12.04.020 "Speed Limits" of Chapter 12.04 "Speed Limits" of Title 12 "Vehicles and Traffic" of the Menifee Municipal Code is hereby amended to read as follows: (A) Reduced speed zones for detour routes. Whenever a portion of a city highway is being used or is about to be used as a detour route under a reconstruction project of a highway and the City Engineer/Director of Public Works determines that the existing speed limit upon the highway is more than is reasonable and safe because of increased vehicular traffic and a reduced speed zone is warranted and necessary, he or she may temporarily fix the appropriate lower rate as provided in Cal. Vehicle Code § 22358 which will facilitate the orderly movement of traffic and will be reasonable and safe upon that portion of the highway for the period the highway is used as a detour route. Thereupon, the prima facie speed limit so fixed shall be effective during the period appropriate signs are erected and maintained along that portion of the highway by the Director of Public Works. (B) Twenty-five miles per hour. The prima facie speed limit is 25 miles per hour: (1) On Trumble Road between McLaughlin Road and Rouse Road, a total distance of approximately 0.48 miles: (C) Thirty miles per hour. The prima facie speed limit is 30 miles per hour: [None at this time]. (D) Thirty-five miles per hour. The prima facie speed limit is 35 miles per hour: (1) On Bradley Road between Potomac Drive and McCall Boulevard, a total distance of approximately 1.6 miles; (2) On Chambers Avenue between Murrieta Road and Bradley Road, a total distance of approximately 0.96 mile; City of Menifee Page 3 of 7 (3) On East Drive (Kabian Park Road) between San Jacinto Road and Goetz Road, a total distance of approximately 0.4 mile; (4) On Encanto Drive between a point 770 feet south of EI Pico Lane and Shadel Road, a total distance of approximately 0.86 mile; (5) On Holland Road between Byers Street and Murrieta Road, a total distance of approximately 0.5 mile; (6) On McCall Boulevard between Murrieta Road and Encanto Drive, a total distance of approximately 1.2 miles; (7) On Mountain View Place between Newport Drive and San Jacinto Road, a total distance of approximately 0.63 mile; (8) On San Jacinto Road between Mountain View Place and East Drive, a total distance of approximately 0.34 mile; (9) On Shadel Road between Encanto Drive and Sherman Road, a total distance of approximately 0.46 miles; and (10) On Trailhead Drive between Menifee Road and Lindenberger Road, a total distance of approximately 0.45 miles. (E) Forty miles per hour. The prima facie speed limit is 40 miles per hour: (1) On Antelope Road between La Piedra Road and Tally Road, a total distance of approximately 1.9 miles; (2) On Antelope Road between the centerline of Highway 74 and Mapes Road, a total distance of approximately 1.0 mile; (3) On Briggs Road between Watson Road and Mapes Road, a total distance of approximately 0.5 mile; (4) On Corson Road between Murrieta Road and Evans Road, a total distance of approximately 0.5 miles; (5) On Evans Road between Holland Road and Craig Avenue, a total distance of approximately 0.5 miles; (6) On Evans Road between Craig Avenue and Garbani Road, a total distance of approximately 0.5 miles; (7) On La Ladera Road between Normandy Road and Honeyrun Road, a total distance of approximately 0.8 mile; (8) On La Piedra Road between Antelope Road and Menifee Road, a total distance of approximately 0.80 mile; (9) On Lindenberger Road between Scott Road and the south terminus of Lindenberger Road, a total distance of approximately 0.4 miles; (10) On McCall Boulevard between Acqua Drive and Briggs Road, a total distance of approximately 0.5 miles; City of Menifee Page 4 of 7 (11) On McCall Boulevard between Valley Boulevard and Murrieta Road, a total distance of approximately 0.4 mile; (12) On Murrieta Road between Newport Road and Chambers Avenue, a total distance of approximately 2.5 miles, (13) On Rouse Road between Murrieta Road and Bradley Road, a total distance of approximately 1.0 mile; (14) On Sherman Road between Holland Road and La Piedra Road, a total distance of approximately 0.5 miles; (15) On Sherman Road between 800 feet south of Ethanac Road to State Route 75, a total distance of approximately 0.5 miles; (16) On Tally Road between Antelope Road and Tate Road, a total distance of approximately 0.6 mile; and (17) On Watson Road between Briggs Road and Sherman Road, a total distance of approximately 2.5 miles. (F) Forty-five miles per hour. The prima facie speed limit is 45 miles per hour: (1) On Bradley Road between Craig Avenue and Newport Road, a total distance of approximately 1.50 miles; (2) On Bradley Road between Newport Road and Potomac Drive, a total distance of approximately 0.6 mile; (3) On Bradley Road between McCall Boulevard and Rouse Road, a total distance of approximately 1.1 miles; (4) On Briggs Road between Matthews Road and the centerline of State Route 74, a total distance of approximately 1.4 miles; (5) On Briggs Road between the centerline of State Highway 74 and Watson Road, a total distance of approximately 0.5 mile; (6) On Craig Avenue between Murrieta Road and Bradley Road, a total distance of approximately 1.0 mile; (7) On the south side of Ethanac Road between Trumble Road and Sherman Road; and on the full width of Ethanac Road between Sherman Road and Mathews Road, a total distance of approximately 0.8 mile; (8) On Garbani Road between Antelope Road and Menifee Road, a total distance of approximately 1.0 mile; (9) On Goetz Road between Newport Road and a point 634 feet north of Manganese Road (City of Perris city limits), a total distance of approximately 3.0 miles; (10) On Mathews Road between Ethanac Road and Palomar Road, a total distance of approximately 0.5 mile; City of Menifee Page 5 of 7 (11) On McCall Boulevard between Encanto Drive and Antelope Road, a total distance of approximately 0.8 mile; (12) On Menifee Road between Garbani Road and Newport Road, a total distance of approximately 1.0 mile; (13) On Menifee Road between Newport Road and a point 640 feet north of Aldergate Drive, a total distance of approximately 1.1 mile; (14) On Newport Road between the centerline of Interstate 215 freeway and Menifee Road, a total distance of approximately 1.0 mile; (15) On Palomar Road between State Route 74 and Watson Road, a total distance of approximately 0.5 miles; (16) On Rouse Road between Encanto Drive and Dawson Road, a total distance of approximately 0.72 miles; (17) On Valley Boulevard between McCall Boulevard and a point 1,300 feet south of Honeyrun Road, a total distance of approximately 1.4 miles; and (18) On Palomar Road between Watson Road and Mapes Road, a total distance of approximately 0.5 miles; (19) On the westerly side of Menifee Road between a point 400 feet south of Tulita Lane (City of Murrieta limits) and Scott Road, a total distance of approximately 0.5 mile}.- (20) On Sherman Road between State Route 74 and Mapes Road, a total distance of approximately 0.6 miles; and (21) On Trumble Road between State Route 74 and Mapes Road, a total distance of approximately 0.4 miles. (G) Fifty miles per hour. The prima facie speed limit is 50 miles per hour: (1) On southbound Briggs Road between Golden J. Road and Scott Road, a total distance of 0.5 miles; (2) On the south side of Ethanac Road between Goetz Road and Barnett Road, a total distance of approximately 1.75 miles; (3) On Garbani Road between Menifee Road and Briggs Road, a total distance of approximately 1.0 mile; (4) On Holland Road between Murrieta Road and Haun Road, a total distance of approximately 1.75 miles; (5) On the southerly side of Mapes Road between Trumble Road and Menifee Road, a total distance of approximately 1.75 miles; (6) On Matthews Road between Ethanac Road and Palomar Road, a total distance of approximately 0.55 miles; (7) On Matthews Road between Palomar Road and Menifee Road, a total distance of approximately 0.64; City of Menifee Page 6 of 7 (8) On Menifee Road between Scott Road and Garbani Road, a total distance of approximately 1.0 mile; (9) On Murrieta Road between Scott Road and Newport Road, a total distance of approximately 3.0 miles; (10) On Murrieta Road between Chambers Avenue and Ethanac Road, a total distance of approximately 1.5 miles; and (11) On Newport Road between Murrieta Road and the centerline of 1-215, a total distance of approximately 1.98 miles. (H) Fifty-five miles per hour. The prima facie speed limit is 55 miles per hour: (1) On Domenigoni Parkway between Menifee Road and Briggs Road, a total distance of approximately 1.28 miles; (2) On McCall Boulevard between Antelope Road and Menifee Road, a total distance of approximately 1.0 mile; and (3) On Menifee Road between Simpson Road and McCall Boulevard, a total distance of approximately 2.4 miles. (1) Sixty miles per hour. The prima facie speed limit is 60 miles per hour: [None at this time]. SECTION 2. The City Council of the City of Menifee hereby declares: (1) that the action taken in Section 1 hereinabove is based on a 2017 Engineering and Traffic Survey conducted by the City; and (2) that the prima facie speed limits provided in Exhibit "A" attached hereto for their associated street segments are most appropriate to facilitate the orderly development of vehicular traffic and are reasonable and safe for those street segments. SECTION 3. The Public Works Department is hereby authorized and directed to install and/or upgrade any and all appropriate signs giving notice of said speed limits. SECTION 4. The ordinance will be effective 30 days from the date of its adoption.
