2017-209 Change of Zone No. 2016-172 Amending Zoning Ord for Menifee East Specific Plan ORDINANCE NO. 2017-209 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, APPROVING CHANGE OF ZONE NO. 2016-172, AMENDING CITY OF MENIFEE ZONING ORDINANCE FOR THE MENIFEE EAST SPECIFIC PLAN Whereas, on March 4, 2016, the applicant, Pulte Group, filed a formal application with the City of Menifee for a Change of Zone application to amend the City of Menifee Zoning Ordinance for the Menifee East Specific Plan located south of Newport Road, north of Rockport Road and east of Laguna Vista Drive within the City of Menifee (the"Project"); and Whereas, pursuant to the requirements of the California Environmental Quality Act (CEQA) an Initial Study ("IS") and Addendum to Environmental Impact Report No. 327 ("Addendum") have been prepared to analyze and mitigate the Project's potentially significant environmental impacts; and Whereas, on March 8, 2017, the Planning Commission held a hearing on the Project and recommended that the City Council approve Change of Zone No. 2016-172. NOW, THEREFORE, The City Council of the City of Menifee does Ordain as follows: Section 1: Environmental Determination. A. An Addendum to Environmental Impact Report No. 327 was completed forthe Change of Zone and is being concurrently adopted by the City Council pursuant to Resolution No. 17-603. Section 2. Change of Zone Findings. In accordance with the provisions of the City of Menifee Zoning Ordinance, the City Council hereby makes the following finding(s) for Change of Zone No. 2016-172. A. The proposed change of zone is in conformance with the adopted General Plan for the City. The General Plan land use of the site is Specific Plan (Menifee East Specific Plan). The proposed Change of Zone meets the requirements of the Specific Plan land use designation as currently amended. The proposed change of zone to amend the zoning within the Menifee East Specific Plan is amended as attached in Exhibit 1"to this Ordinance. The Change of Zone supports the following General Plan goals and policies: Project Design LU-1.1 Concentrate growth in strategic locations to help preserve rural areas, create place and identity, provide infrastructure efficiently, and foster the use of transit options. The proposed Project is located within a partially urbanized area within an area zoned for residential use, with single-family residential homes to the south of 1 the subject site across Rockport Road. The Project would, therefore help preserve rural areas of the City. LU-3.4 Require that approval of new development be contingent upon the project's ability to secure appropriate infrastructure services. The subdivision includes Conditions of Approval which require roadway improvements prior to map recordation. Therefore, the Project is contingent upon the securitization of these improvements. In addition, the subdivision has been reviewed and conditioned for consistency with the requirements for domestic water, fire protection, sewage disposal, fences, and electrical communication facilities. C-1.1 Require roadways to: • Comply with federal, state and local design and safety standards. The Project includes Conditions of Approval which require the dedication and installation (or bonding) of roadway improvements consistent with the City's General Plan and the City's Public Works Department Standard Details. CD-6.1 Recognize the importance of street trees in the aesthetic appeal of residential neighborhoods and require the planting of street trees throughout the City. The proposed Project will include street trees throughout the project site. I would recommend bulking this up with a discussion of some General Plan policies and goals. Much of this can be cut and pasted from the Tract Map resolution. B. I feel like we should also have a finding that the Change of Zone bears a substantial and reasonable relationship to the public health, safety, and welfare. Then just include a description about how the Change of Zone is beneficial to the public or will promote orderly development or something like that. Section 3. Amendment to the Official Zoning Map The City Council hereby approves Change of Zone No. 2016-172 amending the official zoning map of the City of Menifee by changing the zoning map and text within the Menifee East Specific Plan as shown in attached Exhibit "1" to this Ordinance. Section 4. Effective Date of Ordinance. This Ordinance shall take effect and be in full force and operation thirty (30) days after its second reading and adoption. Section 5. Severability If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection subdivision, sentence, clause, phrase, or 2 portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. Section 6. City Clerk Action The City Clerk is authorized and directed to cause this Ordinance to be published within fifteen (15) days after its passage in a newspaper of general circulation and circulated within the City in accordance with Government Code Section 36933(a) or, to cause this Ordinance to be published in the manner required by law using the alternative summary and posting procedure authorized under Government Code Section 36933(c).
