2013-123 Final adoption of certain county ordinances 2009-66 ORDINANCE NO. 2013-123 AN ORDINANCE OF THE CITY OF MENIFEE AMENDING CERTAIN PROVISIONS OF ORDINANCE NO. 2009-66 TO CORRECT CLERICAL ERRORS AND ERRATA APPEARING IN THAT ORDINANCE AND TO RE-ADOPT BY REFERENCE CERTAIN PROVISIONS OF THE RIVERSIDE COUNTY CODE PREVIOUSLY ADOPTED BY REFERENCE BY THE CITY OF MENIFEE The City Council of the City of Menifee ordains as follows: SECTION 1. On December 1, 2009, the City Council of the City of Menifee ("City") adopted Ordinance No. 2009-66 which was enacted to permanently adopt specific ordinances and resolutions of the County of Riverside that had been previously adopted for an initial period of 120 days following the effective date of the incorporation of the City of Menifee and extended for an additional year pursuant to the provisions of Government Code Section 57376. SECTION 2. Since adoption of Ordinance No. 2009-66, it has come to the attention of the City that certain non-substantive references and other provisions of Ordinance No. 2009-66 contain clerical errors and errata that must be corrected for the record. SECTION 3. Accordingly, the title of Ordinance No. 2009-66 is hereby amended to read in its entirety as follows: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, PROVIDING THAT CERTAIN ORDINANCES AND RESOLUTIONS OF THE COUNTY OF RIVERSIDE (INCLUDING LAND USE ORDINANCES AND RESOLUTIONS) SHALL BE ADOPTED BY REFERENCE AND SHALL REMAIN IN FULL FORCE AND EFFECT UNTIL OTHERWISE REPEALED, SUPERSEDED OR AMENDED BY CITY ORDINANCE" SECTION 4. Exhibit A to Ordinance No. 2009-66 is hereby amended and set forth in full as Exhibit 1A to this Ordinance to correct the following two numerical references to the Riverside County Codes that were in effect upon adoption of Ordinance No. 2009-66 and otherwise correctly described in Exhibit A to that Ordinance: 1. Ordinance No. 694 is corrected to read Ordinance No. 695; and 2. The placement of Ordinance 853 is corrected by moving it to appear prior to Ordinance 865." SECTION 5. In all other respects, Ordinance No. 2009-66 remains unchanged and in full force and effect, permanently adopting the referenced provisions of law effective February 1, 2010. SECTION 6. This Ordinance no 2013-123 has is hereby adopted in accord with all procedures set forth in Government Code Section 50022.2-50022.7 and in accord with all other procedures required to adopt or re-adopt existing provisions of law by reference. City of Menifee Ordinance No. 2013-117 Amendment to Violations and Penalties SECTION 7. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance, and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, phrases or portions might be declared invalid or unconstitutional.
