2010-81 Removal of GPIP ORDINANCE NO. 2010-81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE RESCINDING CERTAIN ADMINISTRATIVE PROVISIONS OF COUNTY LAND USE ORDINANCE NO. 348, AS ADOPTED BY THE CITY, RELATING TO THE GENERAL PLAN IMPLEMENTATION PROCESS THE CITY COUNCIL OF THE CITY OF MENIFEE DOES ORDAIN AS FOLLOWS: SECTION 1. FINDINGS The City Council finds as follows: A. The City of Menifee was incorporated on October 1, 2008, and, as required by state law, adopted the Riverside County General Plan, including its implementing regulations and policies, and the City had continued its use of the Riverside County General Plan pending adopting of its own General Plan as well as use of Riverside County Land Use Ordinance No. 348, which contains a number of provisions derived from the General Plan. B. The County of Riverside adopted its current General Plan, the Riverside County Integrated Project (RCIP), in 2004. C. The RCIP includes Land Use Designations for each property within the unincorporated portions of Riverside County as well as four (4) Foundation Components that limit the types of land use designations within the component areas. D. The purpose of the Foundation Components was to protect the certainty of the General Plan by limiting the number of times land could change designations, thus providing some "certainty" that the land use designations would remain. E. A property owner must utilize the General Plan Implementation Process or GPIP in order to initiate a change in a Foundation Component. F. The GPIP is a multi-step advisory process with a cost of at least $10,000 resulting in Board of Supervisors' permission (or not) to file an application for a General Plan amendment. G. City Staff has determined that the rescission by the City of the GPIP process will result in a faster, more streamlined, cost-effective and fairer General Plan amendment process as set out in Ordinance No. 348. H. This ordinance is exempt from CEQA pursuant to Section 15061 (b) (3) of the CEQA Guidelines. I. This ordinance was adopted on an interim basis while staff reviewed the change in process and, based upon support from applicants and improved processing efficiency, now should be made a permanent change to Ordinance No. 348; J. This ordinance has been considered by the Planning Commission and at a duly noticed public hearing at which the City Council heard all testimony, pro and con. 4829-0913-2547.1 1 SECTION 2. The following Sections of Riverside County Land Use Ordinance No. 348, as adopted by the City, are hereby repealed: Section 2.1 (b) Section 2.4 (b), (c), (d) and (e) Section 2.5, subsections (c), (d), (e) and (f) Section 2.6, subsections (b), (c), (d) and (e) Section 2.7 (c), (d), (e) and (f) SECTION 3.
