AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA,
PROVIDING THAT CERTAIN ORDINANCES AND RESOLUTIONS OF THE COUNTY OF
RIVERSIDE (INCLUDING LAND USE ORDINANCES AND RESOLUTIONS) SHALL REMAIN
IN FULL FORCE AND EFFECT AS CITY ORDINANCES FOR AN ADDITIONAL PERIOD OF
ONE YEAR OR UNTIL OTHERWISE SUPERSEDED BY CITY ORDINANCES; AND MAKING
TWO TECHNICAL CHANGES TO THE MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF MENIFEE DOES ORDAIN AS FOLLOWS:
SECTION 1. COUNTY ORDINANCES TO REMAIN IN EFFECT.
(a) Pursuant to the provisions of California Government Code Section 57376, all
ordinances of the County of Riverside which have been applicable within the territory now
incorporated as the City of Menifee, to the extent that they applied before incorporation, remained in
full force and effect as ordinances of the City of Menifee for a period of 120 days after incorporation
or until February 1, 2009, and thereafter the effectiveness of such ordinances and resolutions was
extended for an additional year.
(b) It now it is necessary to extend certain County ordinances and resolutions again until
otherwise repealed or superseded by City ordinances or action.
(c) Each ordinance or resolution of the County of Riverside set out on Exhibit A,
attached and incorporated here, which have remained in effect as set out in this ordinance shall
remain in effect as a City ordinance or resolution until the Council adopts an ordinance or resolution
repealing or superseding it, whichever occurs first. Any City ordinance or resolution enacted within
that period to supersede a County ordinance or resolution must specifically refer to the County
ordinance or resolution and state an intention to supersede it.
(d) All other ordinances of the County shall be of no further force and effect as City
ordinances as of February 1, 2009.
(e) The purpose of this ordinance is to allow additional time for the City to prepare its
own ordinances (such as those which will be revised after completion of the General Plan) or until
otherwise replaced, if replaced (bingo, mobile home rent control).
SECTION 2. SUBSTITUTION OF REFERENCES TO "CITY."
Those County ordinances and resolutions referred to in Section 1 reflect the County's
governmental structure and contain references to officials, titles, commissions and other
designations which are not part of the structure of the City. In order to effectively administer such
County ordinances and resolutions, this ordinance also provides for the substitution of the
appropriate City official, title or designation, including but not limited to those which follow:
(a) Whenever"Board of Supervisors"or"Board"is used in the County Code or relevant
county ordinances or resolutions, it shall mean the Menifee City Council.
(b) Whenever"County"or"County of Riverside"is used in the County Code or relevant
County ordinances, it shall mean the jurisdictional limits of the City of Menifee unless a different
geographical or jurisdictional area is clearly indicated by the context.

(c) Whenever"unincorporated territory of the County of Riverside"issued in the County
Code or relevant County ordinances, it shall mean the City of Menifee unless a different
geographical area is clearly indicated by the context.
(d) Whenever 'Planning Commission," 'Board of Zoning Adjustment," "Board of
Appeals,""Zoning Administrator or any similar reference to a County person or body is used, it shall
mean the Menifee City Council or those agencies or officials acting as the agents of the City of
Menifee.
SECTION 3. RENUMBERING: Chapter 11.20 of the Menifee Municipal Code, "Fireworks"hereby
is renumbered as Chapter 11.19.
SECTION 4. PARKING. Chapter 12.20.070 (a) of the Menifee Municipal Code is amended to
read as follows:
(b) No person shall park or leave standing any truck, trailer or semi-trailer, including but
not limited to those used primarily for hauling manure, garbage, livestock, poultry or other
product giving off a noxious or unpleasant odor, located upon, or in a City highway or right of
way or property adjacent thereto, or within two hundred (200) feet from, any premises zoned
primarily for residential occupancy and in use for that purpose, except in an emergency or when
necessary for the purpose of loading or unloading such vehicle.
SECTIONS. EFFECTIVE DATE.
This ordinance shall take effect on February 1, 2010 at the same time as the termination
of Ordinance No. 2008-14. The City Clerk shall certify the adoption of this Ordinance and shall
cause the same to be posted as required by law.
