2008-16 Prima Facie speed ORDINANCE NO. 2008-16
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENIFEE,
CALIFORNIA, SUPERSEDING COUNTY OF RIVERSIDE ORDINANCE 452
(AS AMENDED THROUGH 452.224) RELATING TO PRIMA FACIE SPEED
LIMITS, AS THEY PERTAIN TO STREETS WITHIN THE CITY OF MENIFEE,
AS SETTING AND CONFIRMING CITY SPEED LIMITS
THE CITY COUNCIL OF THE CITY OF MENIFEE DOES ORDAIN AS FOLLOWS:
SECTION 1. FINDINGS. The City Council of the City of Menifee finds as follows:
(A) On the basis of engineering and traffic surveys, the Menifee City Council
determines that the prima facie limit applicable under the California Vehicle Code is more than
is reasonable or safe upon certain portions of the city streets and highways of the City of
Menifee described in this ordinance, and therefore the prima facie speed limit on those streets is
herein fixed at a lower rate.
(B) On the basis of engineering and traffic surveys, said Council determines that a
speed greater than the prima facie limit of 25 miles per hour applicable under the California
Vehicle Code would facilitate the orderly movement of vehicular traffic and would be reasonable
and safe upon the portions of the city highways of the City of Menifee hereinafter described, as
to which the prima facie speed limit,is herein fixed at a higher rate.
(C) Said Council hereby finds that the prima facie speed limits hereinafter set forth
are most appropriate to facilitate the orderly movement of traffic and are reasonable and safe,
as to the respective portions of city highways described.
SECTION 2. PRIMA FACIE SPEED LIMITS SET.
The prima facie speed limits on the portions of city highways shall be those set out in
this ordinance.
(A) The prima facie speed limits established by this Ordinance shall be effective
when appropriate signs giving notice thereof are erected on such city streets and highways.
It shall be the responsibility of the City Engineer/Director of Public Works, or his designee, to
erect and maintain such signs.
(B) This Ordinance shall not be effective as to any designated portion of a street,
roadway or highway which lies outside the city limits of the City of Menifee.
(C) This ordinance is adopted pursuant to, and subject to the limitations and
exceptions of, Section 21 and Section 22357 to 22359, inclusive, of the California Vehicle
Code.
(D) Such prima facie limits may be revised by amendment to this Ordinance.
SECTION 3. REDUCED SPEED ZONES FOR DETOUR ROUTES.
Whenever a portion of a City highway is being used or is about to be used as a detour
route under a reconstruction project of a highway and the City Engineer/ Director of Public

h
Works determines that the existing speed limit upon said highway is more than is reasonable
and safe because of increased vehicular traffic and a reduced speed zone is warranted and
necessary, he or she may temporarily fix such appropriate lower rate as provided in Section
22358 of the California Vehicle Code which will facilitate the orderly movement of traffic and will
be reasonable and safe upon that portion of the highway for the period the highway is used as a
detour route. Thereupon the prima facie speed limit so fixed shall be effective during the period
appropriate signs are erected and maintained along that portion of the highway by the Director
of Public Works.
