determines that the hazard posed indicates the need for placement away

Pursuant to Section 9.1.040(b) (21) of City of Menifee Municipal Code, the Community
Development Director has the authority to approve minor temporary use permits that are
exempt from CEQA.
FINDINGS:
This project is subject to City Ordinance No. 2009-022, and is therefore subject to the
following findings:
1) The temporary use is compatible with the zoning, nature, character, and use of the
surrounding area.
The zoning of the subject site is Specific Plan (No. 247) Planning Area 1 — Commercial. A
temporary event, such as the one proposed, can occur in any zone. The event will occur
within an existing parking lot that will service businesses in the future, once buildouts are
complete. The center has 681 parking spaces; the proposed event will occupy approximately
5% of the total parking spaces. The proposed event will not conflict with the operations of
the rest of the center as it is still under construction and is deemed compatible with the
zoning, nature, character, and use of the surrounding area.
2) The temporary use will not adversely affect the adjacent uses, buildings or
structures.
Surrounding uses will ultimately include a Starbucks, a CVS Pharmacy and a McDonald's
fast food restaurant, once all construction is completed, however, the uses are under
construction or are under building review at the time of the proposed event. The event will
not adversely affect these uses or proposed construction activities, because the site has
adequate parking and it is not anticipated to generate a significant amount of traffic. The
Stater Bros building serves as a buffer between the event and neighboring residences to the
south of the site. The project will not adversely impact adjacent uses, buildings, structures,
or any neighborhood parks.
3) The nature of the proposed temporary use is not detrimental to the public health,
safety or welfare of the community.
This temporary event has been reviewed and/or conditioned by the City Community
Development Department, Riverside County Fire Department, and Riverside County Sheriff.
Each of these departments is tasked with protecting a different aspect of public health,
safety, and general welfare. Therefore, as conditioned, the project will not be detrimental to
public health, safety, and welfare.
CONDITIONS OF DEVELOPMENT:
The conditions of development have been attached for your files. The enclosed conditions
of approval should be included with any other Building and Safety Department plan check
submittals.

1. Project Description. Temporary Outdoor Event No. 2017-184 "Stater Bros
Employee Appreciation Event": The use hereby permitted is Community

2. Indemnification. Applicant/developer shall indemnify, defend, and hold harmless
the City of Menifee and its elected city council, appointed boards, commissions,
committees, officials, employees, volunteers, contractors, consultants, and
agents from and against any and all claims, liabilities, losses, fines, penalties,
and expenses, including without limitation litigation expenses and attorney's fees,
arising out of either the City's approval of the Project or actions related to the
Property or the acts, omissions, or operations of the applicant/developer and its
directors, officers, members, partners, employees, agents, contractors, and
subcontractors of each person or entity comprising the applicant/developer with
respect to the ownership, planning, design, construction, and maintenance of the
Project and the Property for which the Project is being approved. In addition to
the above, within 15 days of this approval, the developer/applicant shall enter
into an indemnification agreement with the City. The indemnification agreement
shall be substantially the same as the form agreement currently on file with the
City.
3. Definitions
The words identified in the following list that appear in all capitals in the attached
conditions of TOE No. 2017-184 shall be henceforth defined as follows:

The development of the premises shall conform substantially with that as shown
on the plot plan marked Exhibit A, dated June 14, 2017, on file with TOE 2017-
184.

5. Parking
The guests and vendors of this event shall park within the existing paved parking
spaces within the shopping center and shall not park on surrounding vacant
properties.
6. Temporary Use Shall not Block
The activities at the event shall not block, restrict or impair any of the following:
a. The public's view of another business or activity.
b. The public's view of the signage for another business or activity.
c. The view or visibility of the operator of any motor vehicle.
d. The movement of any pedestrian or motor vehicle.
e. The points of ingress and egress to the site.
7. Food Services Allowed
The Applicant has hired caterers to cater the event. All vendors have obtained
the required clearances from Riverside County Health to operate as a caterer.
8. Building Department
Applicant shall obtain building permits for any electrical, plumbing, and
mechanical equipment and comply with all requirements of the Building and
Safety Department.
The Applicant is working with Building and Safety to obtain a building permit for
the tent. The Applicant shall obtain the required permits prior to erecting the tent.
9. Hours of Operation
The event will be held from 12:00 PM to 3:00 PM on July 9, 2017. The Applicant
will set up and take down the event on the same day.
10. Comply with Ordinances/Codes
The use of these premises as described for the Temporary Outdoor Event shall
comply with the standards of Ordinance No. 348 and all other applicable
Riverside County ordinances and State and Federal codes. The use of the
premises shall conform substantially with that as shown on APPROVED EXHIBIT
A, dated June 14, 2017, unless otherwise amended by these conditions of
approval.
11. Comply with Ordinance 2009-024
All lighting shall comply with any applicable provisions of Menifee City Ordinance
No. 2009-024. Any outside lighting shall be hooded and directed so as not to
shine directly on adjoining property or public right-of-way.
12. Event Expiration Date
This approval for an arts showcase shall be valid for the date of July 9, 2017,
only; otherwise it shall be null and void and of no effect whatsoever.
13. Clean Site When Done
The site shall be cleared of all garbage, debris, and litter no later than the
termination date of this approval as specified in the Community Development
Department condition labeled "EVENT EXPIRATION DATE".

14. Remove Event Temporary Structures
Any temporary structures placed on the property for this use shall be removed
upon the completion of this event on July 9, 2017.
16. Refuse
All refuse generated at the premises shall at all times be stored in approved
containers and shall be placed in a manner so that visual and environmental public
health nuisances are minimized.
16. City Property
If City property is damaged or destroyed as a result of the use, the permittee will
reimburse the City for the actual cost of repair or replacement (including labor
and overhead).
17. Post Permit
The TOE approval letter (along with any other required permits) shall be posted
on the premises where the event is conducted and/or a copy of the permit must
be in the possession of the person responsible for the event at all times while it is
occurring.
18. Signage
Only one banner sign shall be allowed, not to exceed 60 sq. ft. in total area,
mounted on a frame of an attractive permanent material, dealing only with the
advertisement of the event itself. In addition, six (6) 11"x14" directional signs
shall be allowed to be distributed throughout the parking lot.
