Denver Councilmember Temporary Outdoor Event No. 2017-184 "Stater Bros Employee Appreciation Event': The use hereby permitted is Community Development Department approval for a private employee appreciation event at the new Stater Bros site located at the southeast corner of Newport Road and Menifee Road. The Applicant is proposing a 40 foot by 100 foot tent, which will house tables and chairs for the attendees. The event will be catered by four (4) food vendors that have been approved by Riverside County Health. The event will take place on Sunday, July 9, 2017, from 12:00 PM to 3:00 PM. The applicant anticipates approximately 350 attendees through the duration of the event (3 hours). EXISTING ZONING and GENERAL PLAN LAND USE: Existing General Plan Land Use: Menifee East Specific Plan (SP 247) Existing Zoning: Specific Plan No. 247, Planning Area 1 (Commercial) APPLICATION SUMMARY: Date of Submittal: June 14, 2017 Date of Approval: July 3, 2017 APPROVAL: On July 3, 2017, the City of Menifee Community Development Department approved the above-referenced case subject to the attached final conditions of approval. Action taken on this case is considered final after expiration of the ten (10) day approval period. 29714 Haun Road Menifee,CA 92586 Phone 951.672.6777 Fax 951.6793843 ww.cltyofinenlfee.us Planning Approval Letter Planning Application No.TOE 2017-184 July 3,2017 City of Menifee Ordinance No. 2010-73 Pursuant to Section 9.1.040(b) (21) of City of Menifee Municipal Code, the Community Development Director has the authority to approve minor temporary use permits that are exempt from CEQA. FINDINGS: This project is subject to City Ordinance No. 2009-022, and is therefore subject to the following findings: 1) The temporary use is compatible with the zoning, nature, character, and use of the surrounding area. The zoning of the subject site is Specific Plan (No. 247) Planning Area 1 — Commercial. A temporary event, such as the one proposed, can occur in any zone. The event will occur within an existing parking lot that will service businesses in the future, once buildouts are complete. The center has 681 parking spaces; the proposed event will occupy approximately 5% of the total parking spaces. The proposed event will not conflict with the operations of the rest of the center as it is still under construction and is deemed compatible with the zoning, nature, character, and use of the surrounding area. 2) The temporary use will not adversely affect the adjacent uses, buildings or structures. Surrounding uses will ultimately include a Starbucks, a CVS Pharmacy and a McDonald's fast food restaurant, once all construction is completed, however, the uses are under construction or are under building review at the time of the proposed event. The event will not adversely affect these uses or proposed construction activities, because the site has adequate parking and it is not anticipated to generate a significant amount of traffic. The Stater Bros building serves as a buffer between the event and neighboring residences to the south of the site. The project will not adversely impact adjacent uses, buildings, structures, or any neighborhood parks. 3) The nature of the proposed temporary use is not detrimental to the public health, safety or welfare of the community. This temporary event has been reviewed and/or conditioned by the City Community Development Department, Riverside County Fire Department, and Riverside County Sheriff. Each of these departments is tasked with protecting a different aspect of public health, safety, and general welfare. Therefore, as conditioned, the project will not be detrimental to public health, safety, and welfare. CONDITIONS OF DEVELOPMENT: The conditions of development have been attached for your files. The enclosed conditions of approval should be included with any other Building and Safety Department plan check submittals. Please contact the Community Development Department at 951-723-3745, if you have questions or need additional information.
