Property Owner also acknowledges that the Agreement benefits the property, in that it allows for the provision of water service to the property. 4. Property owner shall indemnify and hold District, its officers, directors, employees, agents, successors and assigns ("District Indemnified Parties") harmless from and against any and all costs, claims, liability, actions, damages, expenses (including reasonable attorneys'fees) (collectively, "Costs")arising out of, or by reason of the property owner's private water system facilities to the District's remote water service. Declarant affirms that the circumstances of the water pressure condition, and the installation, operation and maintenance of a pressure regulator, touch and concern the land in that they relate to and affect the use of the property. The terms of this Agreement may be enforced by District or its successors or assigns. In the event of any controversy, claim or dispute relating to this Agreement of the breach thereof, which District is or shall attempt to enforce, District shall be entitled to recover from said party reasonable expenses, attorney's fees and costs, if the District prevails in such controversy.
