The trailer will be used as a changing/locker room for the football team. The trailer will be located south of La Piedra Road, west of Haun Road, and east of Sherman Road on APN 360-100-016. FINDINGS: This project is subject to City Ordinance No. 2009-022, and is therefore subject to the following findings: 1) The temporary use is compatible with the zoning, nature, character, and use of the surrounding area. The property is zoned for"Mixed Use" per the Specific Plan, and is designated Specific Plan in the General Plan. The "Mixed Use" land use category, as shown in Figure 8 and Table 2 of the Town Center Specific Plan, allows for"Civic/Educational' land uses. In addition, temporary events such as the one proposed can occur in any zone. The proposed temporary trailer will be located within the Santa Rosa Academy campus on the southerly athletic fields. The trailer will be used as a changing/locker room for the Santa Rosa Academy football team. The temporary trailer, due to its location, will not negatively impact the availability of parking or significantly impact the surrounding uses. The project is compatible with the land uses to the north and south which will be required to be developed consistent with the Town Center Specific Plan. Currently, these properties are vacant. The project site is separated from the Economic Development Corridor land use to the east by the Paloma Wash and Haun Road. Large lot residential properties are located to the west; however, these properties will be located on the opposite side of the Santa Rosa Athletic Academy athletic fields at a distance of approximately 1,200 feet. Therefore, the project will be compatible with surrounding land uses. 2) The temporary use will not adversely affect the adjacent uses, buildings or structures. As previously stated, surrounding uses include vacant land to the north, east, and south and large lot residential properties to the west. The project will not adversely affect these uses, because the site has adequate parking, the users of the trailer will not generate additional parking demand beyond what currently exists, and the hours of operation will coincide with the hours set for existing athletic activities. Therefore, the project will not adversely impact the adjacent uses, buildings, or structures. 3) The nature of the proposed temporary use is not detrimental to the public health, safety or welfare of the community. This temporary event has been reviewed and/or conditioned by the City Engineering Department, Riverside County Fire Department, Riverside County Sheriff, and Riverside County Environmental Health. Each of these departments is tasked with protecting a different aspect of public health, safety, and general welfare. The project has also been conditioned to obtain all applicable building permits, including permits for Planning Approval Letter for Planning Application No.2014-165 August 13,2014 the trailer, from the Building and Safety Department. Project Description Temporary Outdoor Event No. 2014.165 proposes a temporary 12' x 60' trailer to be located on the Santa Rosa Academy athletic field for a period of one (1) year. The trailer will be used as a changing/locker room for the football team. The trailer will be located south of La Piedra Road, west of Haun Road, and east of Sherman Road on APN 360-100-016. Access will be from the existing paved south parking lot of the Santa Rosa Academy. 2. Indemnification The developer/applicant shall indemnify, protect, defend, and hold harmless, the City and County and any agency or instrumentality thereof, and/or any of its officers, employees and agents (collectively the "City and.County") from any and all claims, actions, demands, and liabilities arising or alleged to arise as the result of the applicant's performance or failure to perform under this Temporary Outdoor Event (TOE) permit or the City's and County's approval thereof, or from any proceedings against or brought against the City or County, or any agency or instrumentality thereof, or any of their officers, employees and agents, to attack, set aside, void,annul, or seek monetary damages resulting from an action by the City or County, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning TOE No. 2014-165. 3. Definitions The words identified in the following list that appear in all capitals in the attached conditions of TOE No. 2014-165 shall be henceforth defined as follows: APPROVED EXHIBIT A = Site Plan for TOE 2014-165, dated August 6, 2014, APPROVED EXHIBIT B = Elevations for TOE 2014-165, dated August 6, 2014. APPROVED EXHIBIT C = Floor Plans for TOE 2014-165, dated August 6, 2014. i 4. Conform to Exhibits The development of the premises shall conform substantially with that as shown on Approved Exhibit A, B, and C, dated August 6, 2014, on file with TOE 2014- 165. 5. Install Skirting on Temporary Trailer Skirting around the base of the temporary trailer shall be installed to screen the piers underneath the trailer. The skirting shall utilize the same material used for the trailer siding and the trim on the skirting shall match the trim on the trailer. 6. Temporary Use Shall not Block The use of the temporary trailer shall not block, restrict or impair any of the following: a. The public's view of another business or activity. b. The public's view of the signage for another business or activity. c. The view or visibility of the operator of any motor vehicle. d. The movement of any pedestrian or motor vehicle. e. The points of ingress and egress to the site. 7. No Water or Sewer Service The proposed trailer shall not contain any restroom facilities and shall not be connected to water or sewer services. Users of the proposed temporary trailer may use the restrooms within the existing Santa Rosa Academy campus. 8. Building and Safety Department Applicant shall obtain building permits for the proposed trailer and any electrical connections and/or equipment, and comply with all requirements of the Building and Safety Division. 9. Comply with Ordinances/Codes The development of these premises shall comply with the standards of Ordinance No. 348 and all other applicable Riverside County ordinances and State and Federal codes. The development of the premises shall conform substantially with that as shown on APPROVED EXHIBIT A, dated August 6, 2014, unless otherwise amended by these conditions of approval. 10.Comply with Ordinance 2009.024 All lighting shall comply with any applicable provisions of Menifee City Ordinance No. 2009-024. Any outside lighting shall be hooded and directed so as not to shine directly on adjoining property or public right-of-way. 11.Compliance with Other Agency Comments The site shall be in compliance with attached comments from the following agencies: • Riverside County Fire Department • Riverside County Department of Environmental Health • Riverside County Sheriffs Office 12. Permit Expiration Date This approval temporary trailer shall be valid for the date(s) of August 7, 2014 to August 7, 2015, only; otherwise it shall be null and void and of no effect whatsoever. 13. Clean Site When Done The site shall be cleared of all garbage, debris, and litter and the site shall be restored to its original condition no later than the termination date of this approval as specified in the Planning Divisions condition labeled "PERMIT EXPIRATION DATE". 14. Remove Event Temporary Structures Any temporary structure placed on the property for this use shall be removed upon the completion of this event as specified in the Planning Division's condition labeled "PERMIT EXPIRATION DATE". 15. Expansion of Use The temporary trailer shall be used as a changing/locker room for the athletic teams only with an incidental portion of the trailer's floor space designated for "offices". Any deviation or expansion of this use shall require the appropriate Community Development Department's review and approval prior to such deviation or expansion. 16. Refuse All refuse generated at the premises shall at all times be stored in approved containers and shall be placed in a manner so that visual and environmental public health nuisances are minimized. 17. City Property If City property is damaged or destroyed as a result of the use, the permittee will reimburse the City for the actual cost of repair or replacement (including labor and overhead). 18. Performance Bond The applicant shall submit a performance bond, $1,500 cash deposit, or other surety device, to ensure that any temporary structures used will be removed from the site within a reasonable time following the event and that the property will be restored to no worse than its former condition. 19. Post Permit The TOE approval letter (along with any other required permits) shall be posted on the premises where the trailer is located. END OF CONDITIONS I The undersigned, as the applicant or representative of the applicant in the above noted approval, hereby acknowledge receipt of these Conditions, have no questions regarding the requirements contained herein and applied to the approval of the request and shall abide by all such Conditions.
