10-152 RESOLUTION NO. 10-152 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, ORDERING THE SUBMISSION OF A PROPOSED ORDINANCE TO THE QUALIFIED ELECTORS OF THE CITY OF A CERTAIN MEASURE RELATING TO TERM LIMITS FOR COUNCILMEMBERS AT THE GENERAL MUNICIPAL ELECTION OF THE CITY OF MENIFEE TO BE HELD IN THE CITY OF MENIFEE ON TUESDAY, NOVEMBER 2, 2010, AS CALLED BY RESOLUTION NO. 10-147 WHEREAS, a General Municipal election on Tuesday, November 2, 2010, has been called by Resolution No. 10-147, adopted on June 15, 2010; and WHEREAS, pursuant to the authority provided by statute a petition has been filed with the legislative body of the City of Menifee, California, signed by more than ten percent of the number of registered voters of the City to submit a proposed ordinance relating to term limits; and WHEREAS, the City Clerk has examined the records of registration and ascertained that the petition is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council has not adopted the ordinance; and WHEREAS, the City Council is thus required by statute to submit the proposed ordinance to the voters; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Menifee, California, that: SECTION 1. That the City Council, pursuant to its right and authority, does order submitted to the voters at the General Municipal Election the following questions: Shall the ordinance relating to Term Limits be adopted? Any person who has served two successive terms or eight YES consecutive years as a Councilmember shall be ineligible to serve again in that office until an intervening period of two years has elapsed. Any person who serves as a Councilmember for two or more years of an appointed or elected term shall be considered to have served a term. Terms completed prior to this measure taking effect shall NO not be counted in determining eligibility. SECTION 2. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 4. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. SECTION 5.
