10-189 Resolution No. 10-189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE RECOMMENDING AMENDMENT AN AMENDMENT TO SPECIFIC PLAN No. 208 (APN 360-050-001 and 002) —CVS Whereas, on April 06, 2010 the applicant, Milestone Management, filed a formal application with the City of Menifee for the construction of a 16,951 square foot CVS pharmacy/drugstore with a drive thru window and to allow the sale of beer, wine and distilled spirits for offsite consumption, and an amendment of Specific Plan 208 to allow a pharmacy/drugstore in Planning Area 2-4; and Whereas, on November 9, 2010, the City of Menifee Planning Commission held a public hearing at which it considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 1,000 feet of the project site boundaries; and Whereas, on November 9, 2010, based on the materials at the public hearing, the City of Menifee Planning Commission recommended approval of 2010-064 PP CVS, 2010-065 CUP and CVS 2010-066 SPA CVS; Whereas, on December 7, 2010, the City of Menifee City Council considered public testimony and materials in the staff report and accompanying documents, which hearing was publicly noticed by a publication in a newspaper of general circulation, an agenda posting, and notice to property owners within 1,000 feet of the project site boundaries; and Whereas, on December 7, 2010, the City of Menifee City Council made the following findings for 2010-066 SPA CVS: 1. As part of the approval of this project, the developer has requested staff has recommended amending the Cal Neva Specific Plan No. 208 to allow a pharmacy/drugstore with a drive thru in Planning Area 2-4. 2. The Specific Plan as amended is consistent with the General Plan (Government Code 65453); 3. This amendment is consistent with the remainder of Specific Plan 208, as adopted and subsequently amended. 4. A Mitigated Negative Declaration has been prepared for this project to be adopted by separate resolution. NOW, THEREFORE, the City Council of the City of Menifee resolves and orders as follows: 1. The Findings set out above are true and correct. 2.
