A Resolution of the City Council of the City of Menifee
making findings related to the Menifee Town Center
project's compliance with the Office of Planning and
Research's General Plan extension
WHEREAS, Stark Menifee Land, LLC submitted applications for certain discretionary
entitlements, including a General Plan Amendment, a Specific Plan Amendment and a
Development Agreement, related to the Menifee Town Center Project (Project) in June 2009;
and
WHEREAS, an Environmental Impact Report (SCH #2009091022) related to the Project
has prepared and circulated, and on January 18, 2011 after duly noticed public hearing, the City
Council found it to be complete and adequate in scope in accordance with applicable law by
Resolution No. 11-195; and
WHEREAS, on January 18, 2011, after duly noticed public hearing, the City Council
adopted General Plan Amendment by Resolution No. 11-196 that designated the Project site as
"Mixed-Use"; and
WHEREAS, on April 5, 2011, after duly noticed public hearing, the City Council
introduced Ordinance 2011-89 approving a Specific Plan Amendment and Ordinance 2011-
90 approving a Development Agreement for the Project, and found the Project consistent
with the General Plan, as amended; and
WHEREAS, on March 28, 2011, after the date of the staff report publication for the
April 5, 2011 hearing, the City received a letter from the Office of Planning and Research
approving it request for extension to the time to prepare its General Plan, subject to certain
conditions of approval (OPR Letter); and
WHEREAS, the OPR Letter allows the City to approve discretionary land use
entitlements, including development agreements, but requires that it make written findings,
based on substantial evidence in the record; and
WHEREAS, City Council has reviewed this matter and prepared a report containing
an analysis of the OPR Letter (a copy of the report is on file with the City Clerk and
incorporated herein by reference as if set forth in full).
NOW, THEREFORE, BE IT RESOLVED:
The City Council makes the following findings of fact:
1. There is a reasonable probability that the Project will be consistent with the future
adopted general plan, including a housing element that will be consistent with the
state housing element law; and
2. There is little or no probability that the Project will be detrimental to or interfere
with the implementation of the future general plan, including a housing element
that is consistent with state law.
